Dublin/Pleasanton Extension Project EIR Mitigation
Monitoring and Reporting Plan Excerpts
RECOMMENDATION: /,~ ,~ ~),~) Adopt Resolution and authorize Mayor to execute Memorandum
~ ~ of Understanding; 2) Adopt Resolution for the commitment of
_ funding for the proposed Parallel Road to and south of Dublin
Boulevard.
FINANCIAL STATEMENT: This Memorandum of Understanding w/Il implement the
requirements of the BART Dublin/Pleasanton Extension mitigation that BART will contribute up to $1
million in mitigation funds for the improvement and widening of Dublin Boulevard (currently underway)
and the construction of the new Parallel Road south of Dublin Boulevard which will connect the Interstate
680 hookramps to the West Dublin/Pleasanton BART Station.
DESCRIPTION: In February of 1990, the San Francisco Bay Area Rapid Transit
District Board of Directors certified the Environmental Impact Report for the Dublin/Pleasanton
Extension Project and adopted a Mitigation Monitoring and Reporting Plan for purposes of complying
with the mitigation measures adopted by the BART Board and included in the Environmental Impact
Report.
Section 23 of the Mitigation Monitoring and Reporting Plan provides that BART will enter into a
Memorandum of Understanding with the City of Dublin for contribution by BART of funds for the new
parallel road and the widening of Dublin Boulevard. BART s contribution wall constitute 24~ of the

actual project cost, not to exceed $1 million. This mitigation measure also requires that the funds will be
contributed before January I, 1996 and only upon implementation of the improvements.
The City is currently under contract for the Dublin Boulevard Widening Project. It is estimated at this
time that 24% of the actual cost of this project (BART's share) will amount to approximately $727,000 of
the $1 million that BART is to contribute for both projects. The remaining $273,000 will be allocated
towards the new parallel road project.
The timing in the mitigation monitoring plan which requires implementation of the improvements prior to
January 1, 1996 does not present a problem to the City for the widening of Dublin Boulevard; however, it
does present a problem for the new parallel road. This problem partially results from the fact that the City
is no longer the lead agency for the segment of the parallel road from Amador Plaza Road to Golden Gate
Drive. This portion of the parallel road project is included within the 1-580/1-680 Flyover and Hookramp
Project which is being undertaken by the Alameda County Transportation Authority (ACTA). This
flyover project is approximately $5.6 million short in local match funds which are required to be secured
before the project can be constructed. The City of Dublin is desirous of using the BART mitigation funds
towards the local match requirement which is related to the parallel road portion of the flyover project.
City Staffhas had extensive discussions w/th BART Staff and BART legal counsel regarding BART's
obligation to contribute these funds. BART has indicated that based on the deadline in the mitigation
monitoring program, the City could satisfy the requirement of implementation of the improvements, if the
City Council adopted a resolution committing to funding its share of the local match necessary to
construct the parallel road portion of the 1-580/1-680 Flyover Project (see attached resolution) and is able
to demonstrate that it has acquired right-of-way toward the development of this project.
The City of Dublin does have an irrevocable offer of dedication of property for the purposes of the
parallel road development from Enea Plaza which was to be implemented upon construction of the new
paralleI road. Since the ACTA timeframe for developing the new parallel road is a_tier the BART deadline
of January 1, 1996, Staff has been working with the new owner of the Enea Plaza property, St. Michael
Investments, regarding their consideration of deeding the property to the City of Dublin for the parallel
road prior to January 1, 1996 in order that the BART funds could be obligated. It is anticipated that th/s
agreement will be presented to the City Council at the City Council meeting November t 4, 1995 for
Council consideration.
Recommendation: It is Staffs recommendation that the Council'adopt the attached resolutions and
authorize the Mayor to approve the Memorandum of Understanding with the Bay Area Rapid Transit
District. Subject to a successful completion of agreement with St. Michael Investments and Enea Plaza,
this action on the part of the Council will ensure that BART will pay its share of mitigation costs toward
the new parallel road. Council action will also guarantee that BART will commence payment to the City
for its share of the Dublin Boulevard Widen/ng.
