AGENDA STATEMENT CITY COUNCIL MEETING DATE: JANUARY 9, 1996 SUBJECT: Vice Mayor Selection Process Report by Elizabeth Silver, City Attorney and Kay Keck, City Clerk EXIDBITS ATTACHED: 1) Resolution No. 5-87 adopted January 12, 1987 2) Memorandum from City Attorney dated November 26, 1990 RECOMMENDATION: t$v Consider and provide appropriate direction to Staff FINANCIAL STATEMENT: None In 1987, the Council determined that immediately following certification of the results of the general municipal election in even numbered years, the Council would select one of its members to serve as Vice Mayor and that the person selected would serve in such capacity until their successor was selected following the next general municipal election. Thus, a 2-year term for the position of Vice Mayor was established and has been practiced since that time. Staff recommends that the City Council discuss Councilmember Barnes' request. If the Council determines that it wishes to change this procedure, direction should be given to Staff to amend the attached Resolution. OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************************** ESTABLISHING RULES FOR THE SELECTION OF MAYOR AND VICE MAYOR WHEREAS, Section 36801 of the California Government Code provides for the selection.by the Council of one of its members as mayor and one of its members as vice mayor; and, WHEREAS, the City has consolidated its general municipal election with the statewide general election. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby adopts th~ following rules: 1. ELECTION OF MAYOR AND VICE MAYOR. (a) Time. Immediately fallowing certification of the results of the general municipal election in even numbered years, the Council shall select one of its members as mayor and one of its members as vice mayor. (b) Term. The mayor and vice mayor shall serve in such capacities until their successors are selected following the next general municipal election. 1987. Silver city Attorney Procedure for Election of Mayor and Mayor Pro Tern Once the new council members are sworn in and seated, the next order of business is to elect one member as mayor and one member as mayor pro tern (vice-mayor). (Government Code 5 36801.) The City's Rules of Conduct for Council meetings (ReSOlution No. 145-86) provide that meetings shall be conducted pursuant to Robert's Rules of Order. (Sec. 11(h).) Robert's Rules of Order (1984 Paperback Edition) provide the following guidance for the election of the mayor and mayor pro tern: 1. Nominations do not need to be seconded '(po 171, Ch. XVII) . 2. More than one person can be nominated (p. 50, 5 23). 3. Nominations continue for a reasonable period of time; a motion to close is not in order until a reasonable time has been given (p. 171, ch. XVII). 4. Names are voted on in the order nominated until one person receives at least three votes (p. 50, 5 23). The Council will thus vote first on the first person nominated and if that person fails to receive three votes, the Council will vote on the second name and so forth until one person receives a majority vote (p. 50, 5 23). c- ,-Ic..i .. ;I 0 TO: RE: DATE: PAGE: Honorable Mayor and Members of the Council Procedure for Election of Mayor and Mayor Pro Tern November 26, 1990 2 5. Following voting on each name, the mayor should announce the number of votes received, the number of votes required (three) and whether the nominee has been elected (p. 73, S 38). 6. Members may abstain from voting (p. 72, S 38). 7. A majority vote is required to elect a mayor (p. 72, S 38). Thus, a tie vote (2-2, 1 abstention) results in no action (p. 73, 5 38). 8. Once the mayor is elected, the same process continues to elect the mayor pro tern. 9. Following election of mayor and mayor pro tern, the newly-elected officers should be given the opportunity to say a few words.
