SUBJECT:
Correspondence from the City of San Ramon Requesting an
Amendment to the Dougherty Regional Fire Authority (DRF A) By-
Laws Allowing a Modification to the Termination Provisions

RECOMMENDATION:

Consider the City of San Ramon's request to amend the DRF A Joint
Exercise of Powers Agreement. Consider adopting the attached
resolution amending the Agreement to allow for notice of
termination to be given at any time prior to September 30, 1996.
Such an amendment would continue to require a minimum of 12
months written notice of termination.
FINANCIAL STATEMENT:
No fmancial impact.
DESCRIPTION: The cities of Dublin and San Ramon are parties to a joint powers
agreement for the provision of fire prevention and suppression services which forms the Dougherty
Regional Fire Authority (DRF A). The Authority currently serves all of the City of Dublin and the
southern half of San Ramon. The northern half of San Ramon is curtently served by a separate fire
district: San Ramon Valley Fire Protection District (SRVFPD).
In February of 1996, the City of San Ramon received a written proposal from the San Ramon Valley Fire
Protection District to provide fire protection services to the southern part of San Ramon. Following
receipt of this proposal, the City of San Ramon formed a Public Safety Committee. The Committee is
charged with reviewing the proposal received from SR VFPD and with identifying other alternatives to the
provision of fire protection services.
The San Ramon Public Safety Committee has met regularly over the past several months. To date, the
Committee has narrowed the service options to four, one of which is the proposal from SRVFPD. The
Committee has indicated a need for additional time to explore the remaining options before presenting a
recommendation to the San Ramon City Council. As indicated in the attached letter from Mayor Kinney,

additional time to consider fire service options. ~. .. ...
Pursuant to Article VIII, Section 8.2 of the Joint Exercise of Powers Agreement, termination of the
agreement "shall not under any circwnstances become effective until June 30, next succeedinw .
minimum of twelve (12) months following the giving of written notice of termination by City Co~'
resolution to the other member agency's City Manager."
In response to the City of San Ramon's request, the Dublin City Council may wish to consider amending
the joint exercise of powers agreement to allow for notice of tennination to be given at any time prior to
September 30, 1996. All other provisions of the agreement shall remain in tact, including the minimum
12-month notice requirement. This additional time will also provide the City of Dublin an opportunity to
explore its own fire services options.
If the City Council wishes to grant this extension, then it is recommended that the Council adopt the
attached resolution amending the Joint Exercise of Powers Agreement.

~\S you are av.'are, the City Council of the City of San Ramon has been presented a proposal for fire
services by the San Ramon Valley Fire Protection District.

In this regard, a Public Safety Advisory Committee has been appointed by the Council with the
specific charge of considering the desirability and feasibility of a single fire service provider for the
City of San Ramon. The District's proposal was presented to the Committee for consideration as
one of the alternatives available to the City.
At the City Council meeting of Tuesday, May 28, 1996, the Committee advised the Council that
they had narrowed the options under consideration down to four, one of which is the proposal from
San Ramon Valley Fire Protection District. The Committee has indicated it is in need of additional
time to explore the remaining options before it is able to bring forward a recommendation to the
Council. After hearing the Committee's preliminary report the Council voted unanimously to seek
additional time for consideration of the remaining options.
I <:.m, therefore, requesting that the City of Dublin either consider amending the Dougherty Regional
Fire Authority Joint Powers Agreement by-laws to allow a shortened notification period for
termination of the JP A or to waive the one year notice requirement. The Committee believes that
a recommendation can be made to the Council, so that action could be taken by October I, 1996.

vVHEREAS, by Resolution No. 88-15, t.he City Council approved the "Joint
Exercise of Powers AgreementIDougheny Regional Fire AuthOrity," which was
subsequently executed by the Mayor;
WHEREAS, the I'Joint Exercise of Powers Agreement/Doughtrt)' Regional Fire
Authority" can be amended, as proVided in Section 9.4 of said Agreement upon,
approval of the City Councils of the Cities of Dublin and San Ramon; and
WHEREAS, the CiLY COW1Cils of lhe Cilles of Dublin and San Ramon
approved the "First Amendment to Joint Exercise of Powerf: Agre.e.me.nt/Dougherty
Regional Fire Authority," effective December 15, 1988;
WHEREAS, the City Manager has presented to the Counal and has
rec.ommended approval of the. "Second Amendment to Joint Exercise of Powers

SECOND AMENDMENT TO JOINT EXERCISE OF POWERS AGREEMENT/
DOUGHERTY REGIONAL FIRE AUTHORITY
THIS AGREEMENT is entered into between the City of Dublin and the City of San
Ramon, being !he Member Agencies signatory to the Joint Exercise of Powers
AgreemenVlJougherty Regional Fire Authority ("Agreement").
THIS SECOND AMENDMENT to the Agreement i~ entered into as of the date of
approval by the City of Dublin or the City of San Ramon, whichever occurs later.
IT IS HEREBY AGREED between the City of Dublin lUld the City ofSM. fuunon that
the: Agrec:m~nt shall be amended as follows:
I. Delete Section 8.2 Effective nates of Termination.
2. Add new Section 8.2. to read as follows:
IISection 8.2 Effective Dates of Termination. Such terminatioo shall not under
