This is the same as the 1995-96 assessment, DESCRIPTION: In 1983, the City formed Landscaping and Lighting Assessment District No. 83-2 for the purpose of maintaining landscaping within Tract 4719. The District originally included Stagecoach Park and Stagecoach Road north of the City Limit, but now includes only roadway landscaping along Stagecoach Road and on the "interior slopes" (Coral Way and Agate Way)within the Dublin Bills Estates development. The maintenance cost for Stagecoach Park, as well as the undeveloped Dougherty Mills Park, is paid by the City through the Park Maintenance Operating Budget and is not a part of this Assessment District. The cost of maintenance of the Stagecoach Road landscaping is spread 60%to the Amador Lakes development(divided among the 552 condominium lots) and 40%to the Dublin Mills Estates development (divided among 150 single-family lots). All of the "interior slope" maintenance cost is spread evenly to the 150 single-family lots. • The estimated June 30, 1996, reserve for this District is projected to be $35,071. The actual reserve will not be known until the City closes its books and accrues the necessary revenues and expenses. In the past, portions of the reserve have been used for landscape renovations, particularly following the disastrous • freeze several years ago. In addition, a portion of the reserve has been used in recent years to keep the assessment to property owners as low as possible. The level of service in this District has been tailored to the available funds (i.e.,low assessment, small reserve) as much as possible rather than requesting to increase the assessment in order to perform additional work. This District has quite a large landscaped area which is supported by relatively few property owners._ - ' _._ _ _ _ For Fiscal Year 1996-97,no change is recommended with respect to the method of determining the assessments. The District boundary remains the same.. The assessment to the single-family property owners in the Dublin Bills Estates development is proposed to be$228.72 per single-family home. The Amador Lakes-Apartments propertyis proposed to be assessed at a rate of$38.68 per dwelling unit(or '$21,35.1.36 for the.entire apartment development). This is the same as the 1995-96 assessment. The proposed scope of work for 1996-97 includes a Capital Improvement Project to upgrade parts of the irrigation system and replace plant material. Staff scheduled a neighborhood meeting for property owners in this assessment district on July 10th; however, no property owners attended the meeting. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution. • • Page 2 RESOLUTION NO. -96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING ENGINEER'S REPORT,CONFIRMING DIAGRAM AND ASSESSMENT AND ORDERING LEVY OF ASSESSMENT CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (STAGECOACH ROAD) WHEREAS, by its Resolution No.25-96, a Resolution Directing Preparation of Annual Report for City = of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2(the"District"),this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972;and WHEREAS, said report was made and filed with the City Clerk and duly considered by this Council and found to be sufficient in every particular, whereupon it was determined that said report should stand as Engineer's Report for all subsequent proceedings under and pursuant to the aforesaid Resolution and that July 23, 1996,at 7:00 p.m.in the Council Chambers,Dublin Civic Center, 100 Civic Plaza,Dublin, California,was appointed as the time and place for a hearing by the Council on the question of the levy of the proposed assessment,notice of which hearing was mailed, published and posted in accordance with Government Code Section 54954.6; and WHEREAS, at the appointed time and place, said hearings were held,and all persons interested desiring to be heard were given an opportunity to be heard, and all matters pertaining to said levy were heard and considered by this Council,and this Council thereby acquired jurisdiction to order said levy and confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the cost and expenses thereof; NOW,THEREFORE,BE IT RESOLVED that the City Council of the City of Dublin does hereby approve that: - (a) The property owners owning more than fifty percent of the area of assessable land within the District had not,at the conclusion of said hearing,filed written protests against the said proposed levy, or against the -. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel 2 3 from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram,to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 1996-97 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area(above Agate Way and Coral Way) shall be evenly spread over Lots 1 through 150 of Tract 4719. • Lots 152 and 153, being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. • • • 5 SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. The district was formed as an alternative to utilizing a homeowner's association.to maintain the landscaping. The activities funded by this assessment district include irrigation maintenance (including utility costs), weeding, pruning, fertilizing, and other activities associated with maintenance of landscapes. The assessment for this district is spread between the property owners of the Amador Lakes Apartments, who pay 60% of the cost of Stagecoach Road landscape maintenance, and the property owners of the 150 single-family homes of the Dublin Hills Estates development, who pay 40% of the cost of Stagecoach Road landscape maintenance and 100% of the cost of the interior slopes landscape maintenance. The assessment for the 1996-97 tax year is proposed to be as follows: Single-family lots: $228.72 per lot; Amador Lakes apartment lots: $38.68 per apartment This is the same as the 1995-96 assessment. Copies of the Preliminary Engineer's Report for this assessment district are available at fir City Offices, 100 Civic Plaza, Dublin, California 94568. Protests must be received no later than the close of the public hearing as listed above. Your protest should include both the street address of the property and the assessor's parcel number (APN) of the property. The Landscaping and Lighting Act of 1972 provides that a majority protest, which would consist of property owners of over 50% of the land area of the property being assessed, would cause the abandonment of the assessment. Please feel free to call the Public Works Department at (510) 833-6630 if you have any questions. 1�- • STAGECOACH ROAD (TRACT 4719) rt,f LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NEWSLETTER ttirav Fir FACTS ABOUT THE ASSESSMENT DISTRICT This assessment district was formed in 1983 for the purpose of maintaining certain landscaping improvements along Stagecoach Road and on the"interior slopes" of the Dublin Hills Estates development(Coral Way and Agate Way). The following areas are being maintained by the City at the present time: • • Landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between Amador Valley Boulevard and the northerly City Limit. • Slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48 of Tract 4719. These are the Interior slopes"which face houses on Agate Way and Coral Way. In order to arrive at the annual assessment, estimated maintenance costs for the ensuing year are divided among residents of the single-family homes of Dublin Hills Estates and the owners of the Amador Lakes Apartments as follows: • Sixty percent(60%) of the annual cost of maintaining the landscaping within and along Stagecoach Road has been assigned to the 552 apartment/condominium lots of Amador Lakes, distributed on an equal basis. The remaining 40% of this annual cost has been divided equally among the 150 single- family lots in Dublin Hills Estates. • The cost of maintaining the excavated slopes, concrete culverts, and landscaping on the interior slopes of the single-family area (Agate Way and Coral Way) is divided evenly among the 150 Dublin Hills Estates lots. The funds collected through assessments are accounted for separately from other City funds. These funds can only be used for specified expenses within the boundaries of.the Assessment.District: Each year,the City is required to notify you of public hearings that are being held regarding the proposed ...assessment for the upcoming fiscal year. The public hearing notice is included in the envelope with this newsletter. These public hearings are held at regular City Council meetings. This year, only one hearing will be held, as the assessment is not proposed to be increased. The hearing will be held on July 23rd at 7:00 p.m. LANDSCAPING Near the end of the 1995-96 fiscal year, approximately$1,400 remained in the budget for plant replacement. The City used this money to plant shrubs on the interior slopes (Agate Way and Coral Way) and on the end caps of these streets. For Fiscal Year 1996-97, it is proposed to undertake a Capital Improvement Project in the amount of$10,000 to upgrade the landscaping and irrigation within the District. It is proposed to replant the landscaping at the monument corners on Stagecoach Road,fill in open areas where trees and plants have died, and make improvements within the District to the master plan that was reviewed and approved several years ago. The$10,000 is to come from staffing changes by MCE,the City's maintenance contractor,through rebidding of t subcontractors'work and through the use of reserves. There are no proposed increases to the District assessments =- this upcoming fiscal year. 15 RECOMMENDED ASSESSMENT n., The recommended assessment for the 1996-97 fiscal year is$228.72 per single family lot and $38.68 per apartment dwelling unit. This is the same as the 1995-96 assessment. INFORMATIONAL MEETING An informational meeting has been scheduled for 7:00 p.m. on July 10, 1996, in the Regional Meeting Room of the Dublin Civic Center.
