SUBJECT: Agreement Between the Cities of Dublin, Livermore and Pleasanton
to Develop a Joint Exercise of P~wers Agreement for Fire Services

RECOMMENDATION: 1. Adopt the Interim Agreement.
2. Authorize the Mayor to execute the Agreement
3. Authorize the City Manager to continue participation in the
development of a Joint Exercise of Powers Agreement for
Fire Services
4. Appoint One City Council member and at least Two
altemate members from the City Councif to the Policy
Committee to represent the City of Dublin as provided for in
the Interim Agreement
_ FINANCIAL STATEMENT: Na direct costs are anticipated other than the City Manager's Staff
;::~ time.
DESCRIPTION: At fhe City Council meeting of July 23, 1996, the City Council
authorized the City Manager to c~ntinue working with the cities of Pleasanton and Livermore for the
purposes of developing an interim Joint Exercise of Powers Agreement.
The interim agreement would provide a provide a framework for the cities to develop a Joint Exercise of
Powers Authority which would have as a purpose to provide consolidated fire management of Valley fire
operations.
The City Council adoption of this interim agreement will enable the City to keep its options open with
respect to further evaluation of a three-city fire JPA in the future. - --- - ~
It is Staffs recommendation that the Council adopt the interim agreement, authorize the Mayor to
execute the agreement, authorize the City Manager to continue participati~n in the development of a
Joint Exercise of Powers agreement and appoint a member of the City Council and at least two
altemates from the City Council to represent the City on the Poficy Committee as provided f~r in the
agreement.

AGREEMENT BETWEEN THE CITIES OF DUBLIN,
LIVERMORE AND PLEASANTON TO DEVELOP A
JOINT EXERCISE OF POWERS AGREEMENT FOR
FIRE PROTECTION SERVICES
THIS AGREEMENT is entered into on the effective date hereinafter set forth by and
between the participating agencies signatory hereto (hereinafter "Participating Agencies).

WHEREAS, the Participating Agencies recognize benefits of combining their respective fire
service providers into one provider; and
WHEREAS, the fire service providers currently providing services to the Participating
Agencies have demonstrated their ability to combine services for efficiencies and economies; and
WHEREAS, Title 1, Division 7, Chapter 5 of the Government Code authorizes the
Participating Agencies to enter into agreement for the joint exercise of any power common to them;
. NOW, THEREFORE, FOR THE MUTUAL ADVANTAGES TO BE DERIVED
THEREFROM IT IS AGREED BY AND BETWEEN THE PARTIES HERETO AS
FOLLOWS:
GENERAL PROVISIONS
Section 1.1 Purpose. 1bis agreement is to authorize the formation of a committee and technical
staff to prepare a Joint Exercise of Powers Agreement between the Participating
Agencies, for fire protection services.
Section 1.2 Effective Date. 1bis agreement shall become effective when signed and executed
by all Participating Agencies.
Section 1.3 Policv Committee. For purposes of providing direction to the technical staff
preparing the agreement there will be a policy committee consisting of three (3)
members. The membership of the policy committee will consist of (1) member from
the city council of each Participating Agency. Each city shall appoint sufficient
alternate members from the city council who may act in the absence of a member
appointed by that city council.

Section 1.4 Meetings of the Policy Committee. All meetings of the policy committee shall be
public meetings.
(a)
Regular Meetings. There will be three planned meetings. The proposed meeting
schedule is as follows: October 1996, December 1996, and February 1997. The fInal
meeting will be timed to complete the proposed Joint Exercise of Powers Agreement
no later than February 7, 1997.

(b) Special Meetings. The policy committee shall hold sufficient special meetings to
insure completion of the project in a timely manner.
(c) Location of Meetings. Meeting locations will be mutually selected by the policy
committee.
(d) Call. Notice. and Conduct of Meetings. All meetings of the policy committee shall
be called, noticed, held and conducted in accordance with the provisions of the
Government Code. The host city shall be responsible for all required public notices.
Section 1.5 Required Votes. All actions taken to develop the proposed agreement must receive
unanimous approval.
Section 1.6 Minutes. The host city shall be responsible for preparation and distribution of
minutes. The minutes shall be forwarded in a timely manner to each Policy
Committee Member, City Manager and Fire Chief.

Section 1.7 Limitations. The purpose of the Joint Powers Agreement will be to provide fire
protection services for the Dublin, Livermore and Pleasanton areas; its purpose will
not be to determine if, when or how any of the three cities approve development
within their respective jurisdictions.
ORGANZA TIONAL ST.RUCTURE
Section 2.1 Chairperson and Vice-Chairperson. The Policy Committee shall select a
Chairperson and Vice-Chairperson from its membership.
Section 2.2 Technical Staff. The City Managers and Fire Chiefs, from each Participating
Agency, shall work as a group to prepare the Joint Exercise of Powers Agreement.
The technical staff shall select a Chairperson and Vice-Chairperson to coordinate
technical staff efforts.
PURPOSE
Section 3.1 General Powers. The purpose of the Policy Committee and technical staff will be
to develop a Joint Exercise of Powers Agreement for Fire Protection Services and .

consistent with their individual agency policies, to be submitted to each City Council
for consideration.
EXPENSES
Section 4,1 Reimbursement of Expenditures. Expenses for the services of outside contractors
and materials necessary for the development of a Joint Exercise of Powers
Agreement will be shared equally by the Participating Agencies.
Section 4.2 Limitations on Expenditures. Expenses shall be limited to those necessary for the
development of the Joint Exercise of Powers Agreement.

Section 5.1
Termination. This Agreement shall terminate upon the following, whichever occurs
first:
(a)
The Joint Exercise of Powers Agreement for Fire Protection Services has been
approved by all three participating agencies.
(b)
Anyone of the Participating Agencies 'withdraws by giving written notice to the
other participating agencies.

Section 6.1 Notices. All notices pursuant to this Agreement shall be sent to:
