FINANCIAL STATEMENT:
DESCRIPTION:
The Applicant has stated (see Exhibit A) that they would pay for all
processing costs for the General Plan Amendment Study and
associated other entitlements. This project is not a high priority on
the 1996-97 Council adopted priority list and adequate City staff
time is not available for completing this project in a timely manner.
A Contract Planner will need to be retained to assist Staff in
processing this application, if the City Council authorizes the Study.
No costs will be borne by the City.
In March, 1996, Vince Fletcher, representing Kiper Development, Inc. on behalf of Bud Nielsen,
property owner, requested a General Plan Amendment Study for an approximately 200 acre parcel located
east of the terminus of Brittany Drive and Brittany Lane in Western Dublin. At the City Council meeting
of April 9, 1996 meeting, this matter was tabled. A new request has been filed by Mr. Fletcher
(November 21, 1996). The area is within the City of Dublin's adopted Sphere ofInfluence. This site was
part of the former Western Dublin Specific Plan General Plan Amendment Project Area; and many

environmental issues were addressed in that Specific Plan EIR. Additional information regarding this
proposal was given to the Planning Commission and City Council by residents in the Brittany Lane area.
The Applicant wishes to process a single family subdivision on the land. Access would be from
Brittany Drive and Brittany Lane. The single issue before the City Council is whether a General Plan
Amendment Study should be authorized. All other planning and environmental concerns will be
addressed by the General Plan Study itself. If the Study is initiated, subsequent public hearings will be
held before the Planning Commission and City Council covering potential annexation, General Plan,
Planned Development and other entitlements.

approvals of said 200 acre parcel. Our preliminary layout shows 69 lots similar in square footage
to the surrounding neighborhood. 'We recognize this will require annexation and a general plan

INITIATION OF A GENERAL PLAN AMENDMENT STUDY

Mayor Houston stated there has been a request to table this General Plan
Amendment Study for a 200 :t acre parcel east of the terminus of Brittany Drive and
Bi-ittany Lane to an undetermined time. He encouraged interested parties to get
together and try to work out some of the issues.

Vince Fletcher stated.he respectfully requested that this item be tabled. They will
go walk the site with interested parties and share some ideas.
On motion of Cm. Moffatt, seconded by Cm. Burton, and by unanimous vote, the
City Council tabled the Nielsen Ranch GPA and ErR.
Cm. Burton asked if he would be available to get people's cards so he can contact
them since they have gone to the trouble of comir(g here to hear this tonight.

the winner, and a esolution was adopted declaring "Dublin Tow to be the City's
official song. Mr. St ali feels that if the song were to be pro ssionally recorded, it
could be used to genera ride in the community, could b vehicle by which Dublin
communicates with the res f the world, and if market , could provide a means to
raise money for worthy projec in the community. e estimated cost to profession-
ally produce the song will be $5, and the City; auld receive 1,000 taped copies.
Steve Stewart stated he was very please in the report the reasons why the City
should produce this and make it availabl 0 e people. He felt this was a good and
very fair question. The first thing tha ames to ind is community pride. He shared
a short note from i\1ayor Cathie Br Tn which was 1 luded vlith the song for
Livermore. Livermore doesn't e a corner on pride. fact, he stated he's not a\Vare
of any other city that has de . nated an entire week to eel -ate pride. He read from
the proclamation that w presented to him in 1993. People ed to hear it and learn
it before they will be Ie to sing it for years to come. With regal to the issue of
unity, there are so any ways to divide people, but this project unite eople in a real
physical sense. is Council Chamber filled with those who would like raise their
voices in ce ration of home town pride and spirit, he felt was un precede d. He
could co e up with dozens of reasons to do this. Pride is an intangible; it is a ,. eling. :".

RESOLUTION NO. 96 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
INITIATING A GENERAL PLAN AMENDMENT STUDY FOR THE NIELSEN PROPERTY
WHEREAS, a General Plan Amendment request has been made by Vince Fletcher on behalf of
Bud Nielsen, the Applicant for an approximately 200 acre parcel located west of the terminus of Brittany
Drive and Brittany Lane. The predominant land use designation proposed for the site is residential; and
\VHEREAS, the Applicant has stated that they would pay the processing costs for the General
Plan Amendment Study; and
WHEREAS, the proposed project area is not within the City of Dublin's Western Extended
Planning Area and the Sphere of Influence; and
WHEREAS, Section 65358 (a) of the State of California Government Code states that an
amendment to a general plan shall be in a manner specified by the legislative body; and
WHEREAS, the initiation request has been reviewed in accordance with the provisions of the
California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section
15306, Class 6 of the State CEQA Guidelines; and
WHEREAS, the Staff Report submitted one recommendation that the City Council initiate a
General Plan Amendment Study for the Nielsen Ranch project; and
WHEREAS, the City Council did hear and consider all said reports, recommendations and
testimony hereinabove set forth and is in support of a General Plan Amendment study to determine the
appropriate land use and General Plan designation for the property before making a decision as to the
merits of requested specific entitlements.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby initiate a General
Plan A..mendment Study for the Nielsen project; and the Staff is authorized to retain consultant services to
complete necessary staff reports.
BE IT FURTHER RESOLVED that the Applicant shall pay for all processing costs involved
with the General Plan Amendment Study.
PASSED, APPROVED, AND ADOPTED this 21st day of January, 1997.
