AGENDA STATEMENT CITY COUNCIL MEETING DATE: February 4,1997 SUBJECT: City Manager's Employment Agreement Report by Agency Negotiating Team - Vice Mayor Burton and Councilmember Barnes EXHIBITS ATTACHED: Draft Agreement RECOMMENDATION: Approve amendment to City Manager's Employment Agreement FINANCIAL STATEMENT: Sufficient funding is available in the 1996-97 Budget DESCRIPTION: Pursuant to Council direction, the City's Negotiating Team (Vice Mayor Burton and Councilmember Barnes) has met with the City Manager regarding terms and conditions of employment. The City's Negotiating Team is recommending that the City Council approve a new ;-. agreement with the City Manager. The new agreement includes the following substantive changes to the current agreement: 1. Provide the City Manager with the equivalent of a 2.75% increase to base pay for Fiscal Year 1996-97, by increasing the City Manager's base pay effective February 1, 1997 and contributing a one-time lump sum to the City Manager's deferred compensation plan. 2. Increase the City Manager's auto allowance by $40 per month. 3. Increase the City's contribution to the City Manager's Life Insurance Plan by $100 per year. 4. Increase the City Manager's General Leave by one day. 5. AMBROSE This AGREEM.ENT is m~de and entered into this 1st day of February, 1997, by and between the CITY OF DUBLIN, a Municipal Corporation, and hereinafter referred to as the "CITY", and RlCHARD C. Capacit~, and Term The crTY hereby employs AMBROSE as City Manager for a term commencing on February 1, 1997. Expen~ The City shall pay AMBROSE the sum of $440 per month for his use of his personal automobile for CITY purposes. The CITY shall also pay for AMBROSE'S membership dues in professional organizar.ions, such as, but not limited to, the International City ^1anagc::mcl1t .ksodat10n. 4. Leave a. Vacation - Illness AMBROSE has been credited with 27 days of annual leave for vacation or illness, as of May 11 1996. AMBROSE shall be entitled to an additional one (1) day of annual leave for the period Febmary I, 1997 to April 30, 1997, so that his annual leave for the period May 1, 1996 through April 30, 1997 shall be 28 days for vacation or illness. AMBROSE :>hall be entitled thereafter to an annual leave of 28 days for vacation or illness, commencing May I of each year. :. AMBROSE will be allowed to carry over t.o the next year unused annual l~ve days for the prior year, which will be placed in a sick. leave bank.. Carry over of unused leave shall be limited for sick leave use only. The mrodmum cany Over shall not cause the sick leave bank balance to exceed a total of 45 days. " b. Management Leave Ambrose shall be entitled to six (6) days per year of "Managem~nt Leave". This leave is treated differently than other leave, in t.hat if Ambrose is unable to use this leave by May 1 st of each year, AMBROSE will be compensated for any unused Management Leave at that time. Such compensation shall he based upon A....\1BROSE'S base salaxy identified in paragraph 2. c. Payments upon Resignation Or Termination In the event tha.t AMBROSE'S services are terminated for any reason, AMBROSE shall be compensated for any unu~ed annual le:we and m.:mrtgement leave. Such compensation shall be based upon A.\1BROSE'S base salary identified in paragraph 2. :. Benf'>nts The CITY will provide AMBROSE with the following benefits: ~u A PBRS Retirement Program, w1th the CITY paying both the employer and the employee contributions to PERS for the regular program. In addition, .A1v1BROSE shall be eligible for the PERS Third Level 1959 Survivor Benefits. The CITY shall pay tlle ponion required by PfRS. and AMBROSE shall pay $2 per month. b. The option to select medical inSurance coverage from among the plans offered by the Public Employees' Retirement System Medical and Hospital Care Act. The CrTY shall pay that ponion of AMBROSE'S medical insurance premium which i:5 equal to me highest premium paid by the CITY on behalf of any other CITY employee. c. The CITY shall provide fully paid family dental insurance coverage for AMBROSE, In addition, .AMBROSE shall be a partidpant in the CITY DentaVOptical Reimbursement Trust Fund pursuant to the same regulations as the City Council adOpts for full-time ernploy~es, with the exception that the amount identified in Section ID of the Administrative Requirements of the CTIY of Dublin D~nt.aVOpticaJ/Health E>",!,ense Reimbursement Plan shall be $1,300 for AMBROSE. d. The eITI shall pay the insurance premium cost for Long Term Disability Insurance for AMBROSE. t. The CITY shall contribute up to $350 per year as a premiwn for a tenn life insurance policy for AMBROSE. The CITY shall also pay AMBROSE'S preminm for the CITY'S Group Life Insurance Program. f. The OT'! shall agree to AMBROSE'S partidpation in a Deferred Compensation Plan contribution to said Plan shall be at the sole expense of AMBROSE except for a one.time contribution to be made by CITY no later than March 1,1997, in the amount of $1,727. 6.
