DESCRIPTION:
Proposition 209 was passed by the voters in the recent November election.
The proposition amends the state constitution by adding Section 31 to Article 1.
Section 31 (a) reads:
The state shall not discriminate against, or grant
preferential treatment to, any individual or group on the
basis of race, sex, color, ethnidty, or national origin in the
operation of public employment, public education, or -
public contracting.
Subsequent to its passage, Proposition 209 was challenged in Federal district
court by a group called Coalition For Economic Equity. Judge Thelton Henderson
issued two rulings. The first ruling certified a defendant class that includes all state
offidals and all local government entities. The City has received a Notice of
Certification of Defendant Class from the District Court. (Exhibit 1.) Therefore, as
a member of the defendant class the City is legally bound by Judge Henderson's
ruling in this action.
The second ruling that Judge Henderson made was to preliminarily enjoin
enforcement of Proposition 209. This means that the City cannot take any action
with respect to implementing Proposition 209. However, as the Notice of

~:~fication of Defendant Class states, there are several actions that the City can .
1. The City can identify, review, and analyze existing affimlative action
programs.
2. The City can voluntarily adopt, retain, ame1,1d, or repeal any affirmative
action program.
3. The City can defend against private actions seeking remedies under
Proposition 209.
The City has no affirmative action programs currently in place. The City can
still implement such programs if its wishes, but if Proposition 209 is upheld by the
courts, the status of these programs would be uncertain.
With regard to the Notice of Certification of Defendant Class, there is no
action that the City presently needs to take.
Staff recommends the Council receive the report.
