The project is overbudget by $14,722 for the two years, was underbudget by $26,754 in 1995-96, and overbudget by $41,476 for Fiscal Year 1996-97. This is primarily due to the unbudgeted need to purchase landscaping improvements and the repair to slopes eroded in last winter's heavy rains. This will require a budget transfer from unallocated General Fund Reserves in the amount of $41,476 for Fiscal Year 1996-97. DESCRIPTION: On August 13, 1996, the City Council awarded the Dougherty Hills Slope Repair Project to Gordon N. Bail, Inc. The Slope Repair Project reconstructed landslide areas in the Dougherty Hills Open Space. Cause of the damage was apparently a combination of heavy rains and weak soil conditions. Locations of the project were: The northeast and southeast comers of Topaz Circle; the northeast and southeast comers of Jade Circle; and the southwest end of Crossridge Drive. The bid documents for this project had the contractor remove unstable slope areas, install subdrains, replace Vee Ditches, remodel a drainage inlet and replace excavated soil with more structuraily stable material. The work included removal of private landscaping along the privately owned slopes behind homes along Crossridge Road. The contractor, Gordon N. Ball, Inc., has filed claim against the City for extra work in the amount of $130,000. This claim is unresolved at this time. The City's position is that this extra work is not justified, and the dispute will go to arbitration under the terms of the contract. At this time, Staff recommends that Council accept the contract with Gordon N.
