Dublin Unified School District Request to Operate a
Telecommunications Project within the Public Thoroughfare

School District as a Licensee of Pacific Bell for Installing a
Telecommunications System within the Public Right-of-Way; or
give staff direction and continue the matter.

DESCRIPTION:
The Dublin Unified School District (District) is proposing to install a communications system nenvork
(Metropolitan Area Dark Fiber Network) v.¡ithin some of the City's rights-of-way and private property
utility easements that wiII interconnect the schools and the district office. The system will utilize fiber
optic cables approximately 1" in diameter and most of them will be connect::d to existing Pacific Bell
h:L..:phone poles and some Pacific, Gas and Electric utility poles (see project location map, Exhibit B).
The purpose of this communications system network is to provide instructional material delivery, lnter':~t
accessibility, and other telephone and data communication between the schools, school libraries and the
district office, and possibly other city agencies in the future. The network system will eventually link
other future school sites within the Eastern Dublin area. The proposed system is proprietary and will not
be offered on a profit-basis, or otherwise provided to any facilities or parties other than the school district.

The District has applied for an encroachment permit with the City for some minor underground work 'at
the school frontages where cables from telephone poles will connect to the school facility. The permit fee
would be approximately $ 240. The District is required to add or upgrade a number ofpo1e anchors for,
mitigating impacts of additional pole stress. Staff has requested that residents be notified prior to the
work being done and has suggested that the notice indicate the benefit being provided to the City's
schools. The District's telecommunications contractor (All Star Telecom) will provide ongoing
maintenance of the system.
The District must also obtain a license from Pacific Bell for subleasing space on their telephone poles. As
a requirement of this license, the District must obtain pennission from the City for using the public rights-
of-way. Other telecommunications providers that provide a public service, (e.g., MCI or Sprint) would
need to obtain a Certificate of Public Convenience from the California Public Utilities Commission for
subleasing Pacific Bell's pole space. In this instance, City approval would not be required unless an
encroachment permit was required for an underground installation. The attached Resolution, Exhibit A,
approves the District as a licensee of Pacific Bell to lease pole and conduit space for installing the
communication lines for a telecommunications system within the City's public rights-of-way.
The City has recently received additional requests from private telecommunication system providers
offering service on a profit-basis to install underground systems within the public rights-of-way. Staff is
currently working on a comprehensive telecommunications policy that will address the City's authority to
regulate telecommunication service providers that locate facilities within the public right-of-way.
Conclusion
Staff recommends that the City Council approve the District as a licensee of Pacific Bell to install a
telecommunications system within the City's public right-of-way.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

A RESOLUTION APPROVING THE DUBLIN UNIFIED SCHOOL DISTRICT AS A LICENSEE
OF PACIFIC BELL TO LEASE POLE AND CONDUIT SPACE FOR INSTALLING THE
COMMUNICATION LINES FOR A TELECOMMUNICATIONS SYSTEM FOR THE USE OF
THE SCHOOL DISTRICT AND OTHER CITY AGENCIES
WHEREAS, the Dublin Unified School District (District) has entered into a Licensing Agreement
with Pacific Bell to lease pole space for the purpose of installing a fiber optic network which
interconnects the schools and the District office; and
WHEREAS, the fiber optic cables to be utilized are approximately one-half inch in diameter and
will be connected to existing Pacific Bell telephone poles which are located in the City's right-of-way;
and
WHEREAS, the purpose of the fiber optic network is to provide telephone and data
communication between the schools and with the District office and possibly other City agencies in the
future; and
WHEREAS, said telecommunications system is proprietary and will not be offered on a profit-
basis or otherwise provided in any manner to any facilities other than the school district or other City
agencIes.
BE IT HEREBY RESOLVED by the Council of the City of Dublin that the Dublin Unified School
District is approved to be a licensee of Pacific Bell to lease pole and conduit space for installing
communication lines for a telecommunications system for the use of school district and other city
agencies. This approval does not authorize use of the fiber optic network for private entities or for any
use not specified above.
