DESCRIPTION: · . On January 21, 1997, the City Council iDitiated a General Plan Study for the 200 acre Nielsen Ranch property located east of the tenninus of Brittany Drive and Brittany Lane., The applicant wishes to process a single family subdivision on the land. All planning and environmental concerns were to be addressed by the General Plan Study itself. ' ,_.. '... . ;;, . ',.. .'., '" . ~. ~ I ,. To date, the 'applicant has not proceeded with'any work on'eitherplaiming:oroenvironmental information on the property. At the August 5, 1997 City Council meeting, the Council asked that this matter be added to the agenda of September 2, 1997 for review. The applicant was advised of this action and will appear at this meeting. . A RESOLUTION OF THE CITI' COUNCIL OF THE CITY OF DUBLIN "''''''''''''''''''''''''' INITIATING A GENERAL PLAN AMENDMENT STUDY FOR THE NIELSEN PROPERTI' WHEREAS, a General Plan Amendment request has been made by Vince Fletcher on behalf of Bud Nielsen, the Applicant for an approximately 200 acre parcel located west of the terminus of Brittany Drive and Brittany Lane. Th~ predominant land use designation proposed for the site is residential; and WHEREAS, the Applicant has stated that they would pay the processing costs for the General Plan Amendment Study; and WHEREAS, the proposed project area is not within the City of Dublin's Western Extended Planning Area and the Sphere of Influence; and WHEREAS, Section 65358 (a) ofthe State ofCalifomia Government Code states that an amendment to a general plan shall be in a manner specified by the legislative body; and WHEREAS, the initiation request has been reviewed in accordance with the provisions ofthe California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines; and . WHEREAS, the Staff Report submitted one recommendation that the City Council initiate a General Plan Amendment Study for the Nielsen Ranch project; and WHEREAS, the City Council did hear and consider all said reports, recommendations and testimony hereinabove set forth and is in support of a General Plan Amendment study to detennine the appropriate land use and General Plan designation for the property before making a decision as to the merits of requested specific entitlements. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby initiate a General Plan Amendment Study for the Nielsen project; and the Staff is authorized to retain consultant services to complete necessary staff reports. BE IT FURTHER RESOLVED that the Applicant shall pay for all processing costs involved with the General Plan Amendment Study. PASSED, APPROVED, AND ADOPTED this 21st day of January, 1997.
