No financial impact associated with this item.
DESCRIPTION: In 1988, Congress enacted the Drug-Free Workplace Act. This
statute requires that all grantees directly receiving monies from any Federal agency will maintain a drug-
free workplace. In the past, the City was considered a "sub-recipient" because federal funds were
. received indirectly (Le., ISTEA revenue was received from the State Department of Transportation).
However, as adirect recipient of Federal grant funds (Department of Justice) , the City of Dublin and its
employees must comply now with these requirements.
In summary, the Act requires the following:

a. Publication of and distribution to employees a statement prohibiting all controlled substances in
the workplace;
b. Establishment of a drug-free awareness program to inform employees of dangers and penalties
of drug use, and of available counseling;
c. Notice to employees that they must abide by the statement, and must give the employer notice
within five days of any conviction for a drug related offense in the workplace;
d. Notice to the granting agency of such conviction;
e. Personnel action regarding any such employee convicted, including both discipline and a
requirement that the employee participate in a drug abuse program; and
f. Good faith efforts to maintain a drug-free workplace.

Attached is the proposed Drug Free Workplace Policy for the City of Dublin. City staffhave been
provided an opportunity to review the administrative policy. Administrative policies are implemented by
the City Manager in the course of managing City operations. This is an informational item presented to
City Council for review and comment. Staff requests that the City Council receive the report.

ADMINISTRATIVE POLICY
DRUG FREE WORKPLACE
CITY OF DUBLIN
I. Policy Statement
In 1988, Congress enacted the Drug Free Workplace Act. This statute requires that all grantees receiving
monies from any Federal agency certify that the agency will maintain a drug free workplace. As a recipient
of Federal grants, the City of Dublin and its employees must comply with these requirements.
It is the policy of the City of Dublin that the manufacture, distribution, dispensing, possession, use,
consumption, being under the influence of controlled substances while on duty, while in or on City vehicles
or equipment, or while on stand by is prohibited.
This policy shall apply to all employees of the City.
II. Purpose
The City of Dublin has a responsibility to ensure the safe and efficient delivery of municipal services to the
public. In addition, the City has a responsibility to its employees to provide them with a safe environment
in which to work. If the City is to fulfill these responsibilities, the City must act to maintain a drug free
workplace. This policy is established toward this end.

To provide each employee a copy of this policy.
To enforce the provisions of this policy.
To inform employees of the dangers of drug use in the workplace. To increase awareness of the
dangers of drugs in the workplace, the City will distribute appropriate literature for the review of all City
employees as part of the ongoing drug awareness efforts.
4. Through various programs available through the City's health plans, to encourage employees suffering
from drug abuse, to seek voluntary counseling or treatment.
IV. Employee Responsibilities
1. To acquaint themselves with and abide by the provisions of this policy.
2. To notify their Department Head or Personnel Officer of any criminal drug statute conviction for a
violation occurring in the City workplace. Said notification shall be made no later than five days after such
conviction.
V. Policy Violation
Employees who violate the provisions of this policy will be subject to disciplinary action up to and including
termination; or, at the discretion of the City, as a condition of continued employment be required to
participate in and successfully complete a drug free abuse or assistance program approved by the City.

This policy shall be communicated to all employees.
