Initiate General Plan Study for the property located at 7197 Village

DESCRIPTION:
At the June 16, 1998, City Council meeting, Staff was instructed to agendize this item for City Council
. discussion. At the present time, this property is designated as retail/office by the General Plan which
permits a variety of commercial uses; including automotive service stations and related uses. The current
Zoning designation is zoned C-2 which also allows office, retail and commercial school uses, as shown in
Exhibit 1. ' .
A General Plan Amendment study will look at whether changes to the retail/office General Plan
designation for this property should be made to allow commercial or other residential uses in the future
which are not authorized in the current C-2 Zoning district. The recent closure of the BP Service Station
at this site has resulted in a vacant site which is unsightly. The closure may affect the compliance with
State requirements for replacement of underground tanks. There have been a number of suggestions for
potential reuse of the property and the Downtown Task Force has been studying the future of the Village
Parkway area. The extent to which the current zoning may already accommodate a reuse depends on
whether the envisioned use fits within the C~2 Zoning designation.
Two options are presented for City Council consideration at this time:
1. Initiate a General Plan Amendment to study appropriate uses at this site. This could
include a variety of uses beyond strictly commercial.

Review permitted retail/office uses, conditionally permitted uses and existing C-2 uses and
decide that no action is necessary (any new use would then need only to conform to the.
present retail/office category).

. Should the City Council wish to pursue option #1 above, the Council may wish to consider adopting an .
interim zoning ordinance prohibiting any uses which may conflict with the contemplated General Plan
Amendment. It would be recommended that such an ordinance would be adopted as an urgency ordinance '
to take effect immediately, requiring a four-fifths vote at the time it was adopted. The initial interim
Zoning Ordinance would be effective for 45 days. The interim Ordinance should also identify what uses
are contemplated by the General Plan Amendment study. The Council can extend the interim moratorium
for up to one year, ten months and 15 days after a noticed public hearing. Both the initial interim
ordinance and any ordinance extending the moratorium require findings that there is a current and
immediate threat to the public health, safety or welfare and that the approval of any entitlements for use
would result in a threat to the public health, safety or welfare. Staff believes that the Council can make
the required findings, given the fact that the BP site has remained vacant for three months, and that the
required tank replacement has not occurred. These conditions negatively affect the public welfare by
exposing the public to fire hazards and the potential for graffiti in the buildings. If the Council wishes to
consider an interim zoning ordinance, staff can prepare such an ordinance for the Council's consideration
at its July 21 meeting.
RECOMMENDATION:
Review the options available and either:
1. Instruct staff to initiate a General Plan study for the property located at 7197 Village Parkway.
a. If a General Plan Study is to be initiated: Provide direction regarding preparation of an interim
zoning ordinance imposing a moratorium on uses inconsistent with the proposed General Plan
Amendment. Staff will return at the July 21 meeting with suggested land 'uses for this site and
proposed interim Moratorium Ordinance.

2. Concur that the uses included in the current C-2 zoning are appropriate at this time and take no
action.
