SUBJECT:
Acceptance of Storm Drain Easement and Summary Vacation of
Storm Drain Easement, Dublin Ranch Phase 1, portions of Parcels
K, L and 0 of Tract No. 6925

. FINANCIAL STATEMENT:
None
DESCRIPTION: Part of the improvements for the Dublin Ranch Master Planned
Development includes a storm drain line that runs within a 20 foot wide storm drain easement from South
Dublin Ranch Drive, south through Parcels K, L and 0 to the creek located to the south of the project.
Due to changes to the location of a pool and recreation center in Parcel L, the storm drain from South
Dublin Ranch Drive needs to be realigned. The new storm drain aligrunent is presently outside of the
existing easement that was dedicated to the City as a part of the previously City approved Tract Map
6925. Staff is recommending that this existing storm drain easement be vacated in favor of the new
proposed 20 foot wide storm drain easement that is correctly located where the storm drain line is
proposed to be constructed on the improvement plans (see exhibit attached that shows both the existing
and new storm drain easements). It is recommended that the new storm drain easement be accepted and
the existing storm drain easement be summarily vacated.
The Streets and Highways Code provides that an easement may be summarily vacated if it is being
replaced with a correctly aligned new easement. Additionally, an existing Storm Drain Easement (S.D.E.)
may be summarily vacated as long as there are no improvements existing within the S.D.E.
Staff recommends that the City Council adopt the resolution.

ACCEPTING A STORM DRAIN EASEMENT
LOCATED ON PORTIONS OF PARCELS K, L & 0 OF TRACT NO. 6925
(STREETS AND HIGH\V A YS CODE CHAPTER 4)

WHEREAS, the 20 foot wide Storm Drain Easement (S.D.E.) offered for dedication to the City of
Dublin, as described and shovm in Exhibit A attached hereto, has been determined to be' located in the
alignn1ent that is required for proposed storm drain improvements; and
WHEREAS, this new 20 foot wide Storm Drain Easement which is offered for dedication to the
City of Dublin in the desired location for the storm drain improvements is intended to supersede the
existing 20' Storm Drain Easement located on Portions of Parcels K, L and 0 of Tract No. 6925; and
WHEREAS, it is to the benefit of the City to accept said S.D.E. as provided in Chapter 4 of the
Streets and Highways Code;
NOW, THEREFORE, BE IT RESOLVED that the 20 foot wide S.D.E. which is generally located
on portions of Parcels K, L and 0 of Tract No. 6925, and is more particularly described on Exhibit A
attached hereto, is accepted by the City of Dublin
BE IT FURTHER RESOLVED that the City Clerk is directed to submit a certified copy ofthis .
Resolution to the County Recorder for recording.

SUMMARILY VACATING A STORM DRAIN EASEMENT
LOCATED ON PORTIONS OF PARCELS K, L & 0 OF TRACT NO. 6925
(STREETS AND HIGHWAYS CODE CHAPTER 4)
WHEREAS, the 20 foot wide Storm Drain Easement proposed to be vacated, as described and
Sho\\rIl as "old easement" in Exhibit A attached hereto, has been determined to not be located in the
alignment that is required for proposed storm drain improvements; and
WHEREAS, the 20 foot wide Storm Drain Easement (S.D.E.) proposed to be vacated, as described
and shown as "old easement" in Exhibit A attached hereto, does not contain existing utilities or services;
and
'WHEREAS, a new 20 foot wide Storm Drain Easement has been offered for dedication to the City
of Dublin in the desired location for the storm drain improvements which supersedes the necessity of this
S.D.E.; and
WHEREAS, it is to the benefit of the City to vacate said S.D.E. as provided in Chapter 4 of the
Streets and Highways Code;
