The proposed assessment for the upcoming Fiscal Year is yet to be calculated and will be presented to the City Council at the time that approval of the preliminary Engineer's Report is requested. DESCRIPTION: The conditions of approval for the Dublin Ranch Phase I project require the developer to participate in the formation of a landscaping and lighting district to pay for the costs of street lighting. Several months ago, the City Council reviewed a proposal from Shea Homes, the master developer of Dublin Ranch Phase I, regarding installation of decorative street lighting throughout the Dublin Ranch development. The City Council determined that the decorative lighting would be appropriate for the development if the cost of the lighting and its maintenance were borne by the developer and property owners within the development. Since the maintenance cost for decorative lighting is higher than the maintenance cost for standard "cobra head" lighting located in other areas of the City, Staff has recommended that a separate street lighting maintenance assessment district be formed for the Dublin Ranch development. MSSH Dublin Development LLC, a Shea Homes Limited Partnership, is the master developer for Phase 1 of the Dublin Ranch development. MSSH has submitted a petition requesting that the City form this proposed street lighting maintenance assessment district. The City Attorney has indicated that it is possible to annex additional properties to the District at a later date with the consent of the property owners, i.e., the Lin family. It is proposed that the Engineer's Report for this District be formulated to include future escalation of costs based on inflationary increases in labor and material costs, as well as the cost of energy. In addition, the report is proposed to address future replacement of lighting should-the current fixture design be discontinued by the manufacturer. The proposed assessment for the upcoming Fiscal Year will depend on the number of lights to be installed and the estimated date that the City would assume maintenance of the lights. The proposed assessment will be presented to the City Council at the time that the Preliminary Engineer's Report is brought back for approval. The schedule for formation of this assessment district provides that Staff will return to the City Council at the April 6th meeting with proposed resolutions for formation of the District and approval of the Preliminary Engineer's Report, and that public hearings will be held at May and/or June meetings. Staff recommends that the City Council adopt the resolution initiating proceedings for Landscaping and Lighting Assessment District No. 99-1. Page 2 v .. .b • - = __. -- - RESOLUTION NO. - 99 - A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF DUBLIN INITIATING PROCEEDINGS FOR LIGHTING AND LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 99-1 (STREET LIGHTING MAINTENANCE—DUBLIN RANCH PHASE 1) WHEREAS, the City Council of the City of Dublin proposes to form an assessment district pursuant to the Landscaping and Lighting Act of 1972 (Section 22500 and following, Streets and Highways Code) for the following improvements (hereinafter"Improvements"): The operation, maintenance, and repair of street lighting facilities within the development area known as Dublin Ranch Phase 1, as identified on the boundary map Exhibit A attached hereto. WHEREAS, the proposed assessment district shall be designated Lighting and Landscape Maintenance District No. 99-1, Dublin, Alameda County, California, and shall include the land shown on the map designated "Assessment Diagram, Lighting and Landscape Maintenance District No. 99-1, City of Dublin, Alameda County, California," which map is on file with the City Clerk and is hereby approved. NOW, THEREFORE, BE IT RESOLVED that the City Engineer is hereby designated Engineer for the purpose of these formation proceedings and that the City Council hereby directs the Engineer to prepare and file with the City Clerk a report in accordance with Article 4 of Chapter 1 of the Landscaping and Lighting Act of 1972.
