The Phase I construction will provide the following elements: 1 - 90 Foot Diamond 1 Soccer (regulation) 4 Tennis Courts (Lighted) Play Area with Water Feature Skate Park Restroom/Concession Building Parking Lot 2 - 60 Foot Diamonds 1 Soccer (overlap with diamond) 2 Basketball Courts (Lighted) Picnic Area Plaza and Promenade Perimeter Trail Streetscape and Entries At the February 16, 1999 meeting of the Dublin City Council, the Council authorized Staff to advertise for bids for Contract No. 99-04, Emerald Glen Park Phase 1. As the Engineer's Estimate of $4,206,593 exceeded the available budget by approximately $833,593, four alternates were identified in the bid documents. The alternates were as follows: 1) delete water spigot and drainage at play area; 2) delete copper metal roof on concession and restroom building and add painted - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - F :\ernrldgle\phase 1 \cc54bidaward.doc COPIES TO: Bidders lTEMNO.~ aluminum roofing; 3) delete 3 scorekeepers booths, add 3 posts to mount call light; and 4) add 48" Rf"'?, Class III. BID RESULTS The City received five bids for the project (Attachment 1). The low bidder is Valley Crest with a base bid of $3,663,563.60 The day following the bid opening, the City received a letter from Valley Crest (Attachment 2) asking to withdraw their bid and return their bid bond. They requested relief under Section 5100 of the State Public Contract Code which allows a bid to be withdrawn if a mistake is made in completing the bid and not due to an error in judgment, carelessness in inspecting the site or reading the plans and specifications. Staff has reviewed the supporting evidence supplied by Valley Crest which indicates that clerical errors were made in computer entries and then transferred to the bid form, that the wrong subcontractor was listed on the bid form and that the amount for labor was mistakenly left out of their restroom calculations on the bid form. Staff recommends that the City Council approve the request for withdrawal of the bid and return of the bid bond. Goodland Landscape Construction, Inc. with a base bid of $3,988,000 submitted the next lowest bid. Depending on the alternates selected, the total bid amount varies from $3,938,005 to $4,011,800 as shown on the following table. With a 10 percent contingency, the total funds needed are $4,412,980. ADDITIONAL lMPROVEl\ŒNT COSTS As a part of the project, the City will need to purchase granite and contract the services of a specialist to complete the granite work in the playground. This item was not included in the bid because the City needs to go to a certain source to obtain the correct granite specified for the park. The cost for the granite and professional services is $75,700. Also, in advance of awarding the construction contract for the park improvements, the City Council awarded a separate contract for removal of selected trees that were not part of the overall design of the park. The total cost of this contract was $11,800. These two additions, along with the bid submitted by Goodland Landscape Construction, Inc. and a 10% contingency brings the total funds needed for improvements to $4,500,480. As reported to the Council is previous Staff reports, the increase in improvement costs is primarily attributable to the following factors: 1) infrastructure improvements for future park phases; 2) inflationary construction costs; 3) additional program and enhanced design elements; and 4) street frontage improvements. -}.- ;')ROJECT BUDGET The 1998-2003 Capital Improvement Program includes $3,808,775 for Emera]d Glen Park Phase 1. The total estimated project budget is $5,147,850 resulting in a shortfall of $1,339,075. A comparison between the approved budget for the project and the revised budget for the project is shown below. Inspection costs have increased due to the addition of a construction management firm to oversee the project construction. The increase in misceIJaneous costs is due to the need for additional hazardous materials studies, a biological survey and increased permit fees for sewer and water. In response to increased costs associated with parks and other public facilities, the City Council at their April 6, 1999 meeting approved an increase to the Public Facility Fee to take effect on June 6, 1999. It shou]d be noted, however, that not aIJ of the construction cost of the park wiIJ be paid out of the Public Facility Impact Fee Fund. Street frontage improvements wiJl be paid by Traffic Impact Fees and a Measure D grant is being used to purchase park equipment made of recycled materials. However, there are sufficient funds available in the Fiscal Year 1998-99 Budget to begin construction of the park. Staff wou]d recommend that the necessary budget adjustments be done as part of the Fiscal Year 1999-2000 Budget. VALLEY CREST April 22, 1999 City of Dublin Public Works Department 100 Civic Plaza Dublin, CA. 94568 Attention: City Clerk Regarding: Emerald Glen Park, Phase I Contract No. 99-04 Gentlemen: In accordance with Chapter 5 Relief of Bidders of the public construction code section 51 OO(a) and (b) and section 51 03 Valley Crest is hereby notifying the City of Dublin Califomia that multiple mistakes were made in the preparation and submission of our bid for the above subject project that was publicly opened on April 21, 1999. The following are the specific details of each mistake and how it was made: The first mistake occurred in the incorrect listing and analysis of our electrical subcontractor. Union Electric was listed when in fact we should have listed Parshall Construction for the electrical work on the job. As you can see from our submitted bid a reduction in the amount of $54,000.00 was made at the last minute based on our mistake in analyzing Union Electric's bid. The second mistake is that in the compilation of the all the various elements that went into finalizing our bid price for the Restrooms and Concessions Building which was bid item # 52.. In putting together this line item we left out the labor that would be needed by Valley Crest to complete this bid item. Finally, within in the body of the bid we mistakenly set up and extended bid item # 39 by a total of amount of 394 trees (Please note that this is the correct quantity for bid item #40 and was the cause for the mistake in our extension) instead of the 174 as listed on the bid fonn. Based on the above described mistakes, our bid is different in the fact that it should have actually Been $ 112,240 greater then it stands now. In accordance with section 510 1.(b), based on the above described mistakes, which were made in the course of filling out the bid and not due to error in judgement or to carelessness in inspecting the site of work or in reading the plans or specifications. Donnelly - VC Corp RESOLUTION NO. - 99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********** APPROVING THE REQUEST BY VALLEY CREST TO WITHDRAW THEIR BID FOR CONSTRUCTION OF EMERALD GLEN PARK PHASE I, CONTRACT NO. 99-04 WHEREAS, on February 3, 1999, the City Council approved the construction documents and authorized Emerald Glen Park Phase I to be advertised for bids; \VHEREAS, the project was advertised as required by State law for bids; and WHEREAS, the City received tive bids prior to the close of bids on April 21, 1999; and WHEREAS, the lowest bid received was $3,663,563.60 from Valley Crest; and WHEREAS, the bid was evaluated by staff and determined to meet all requirements; and WHEREAS, on April 22, 1999, the City received a request from Valley Crest to release them from the bid and return their bid bond pursuant to Section 5300 of the Public Contract Code; and WHEREAS, relief under Section 5300 of the Public Contract Code can be granted if the bidder provides evidence that their mistakes were not due to errors in judgment, carelessness in inspecting the site or in reading the plans and specifications; and WHEREAS, the evidence supplied by Valley Crest indicates that clerical errors were made in computer entries and then transferred to the bid form, that the wrong subcontractor was listed on the bid form, that the amount for labor was mistakenly left out of their restroom calculations on the bid form; and WHEREAS, City staff recommended to the City Council that the City Council release Valley Crest from their bid and return their bid bond based on the information supplied. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that: 1. Valley Crest made mistakes within the meaning of Public Contract Code Section 5300; 2. As a result of the mistakes the bid was materially different than Valley Crest intended it to be; and 3. The mistakes made by Valley Crest were not due to an error in judgment or due to carelessness in inspecting the site or in reading the plans and specifications. . BE IT FURTHER RESOLVED THAT the City Council of the City of Dublin relieves Valley Crest from its bid dated April 21, 1999, for Construction of Emerald Glen Park, Phase I and that the City Council hereby releases the bid bond to Valley Crest. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby award Contract No. 99-04 to the lowest responsible bidder therefor, to wit, Goodland Landscape Construction, Inc., at a base bid of Three Million Nine Hundred Eighty Eight Thousand Dollars and No Cents ($3,988,000.00) and one alternate totaling Twenty Three Thousand Eight Hundred Dollars and no Cents ($23,800.00) the particulars of which bid are on file in the office of the City Engineer.
