SUBJECT: Public Hearing: Enforcement of Vehicle Code on Privately
Owned Streets Under CVC (California Vehicle Code) Section
21107.5: Central Parkway, Hibernia Drive, a Portion of
Summerglen Drive, and Streets Within California Creekside
Development

FINANCIAL STATEMENT: None. Regulatory devices on these streets have been installed by
the developers. These devices, including, but not limited to, stop
signs and no parking zones, will be added into the City's Traffic
Code at the time individual developments are accepted.
DESCRIPTION: Staff has received a number of comments from residents of the
California Creekside development that traffic regulations need to be enforced in and around their
development.
The streets within California Creekside, as well as Central Parkway and Hibernia Drive, have not been
accepted by the City. Enforcement of the vehicle code on streets that are privately held requires adoption
of a resolution under Section 21107.5 of the CVC (California Vehicle Code). This section states that the
roads must be open to public use and that they connect to public roads so as to be indistinguishable from a
public road. A portion of Summerglen Drive between Hacienda and Aspen Street, which is the route to
the model homes as well as a connector from Hibernia to Hacienda, is also being recommended for
enforcement as it is expected to incur significant traffic. These streets are all in a finished condition.
Staff is recommending that the City Council adopt the resolution (Attachment 1) approving enforcement
of the Vehicle Code on the following streets (see also Attachment 2, the Location Map):

A public hearing notice has been sent to all adjacent property owners per CVC Section 21107.5. Staff
recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution.
