Gentlemen:
This will acknowledge receipt of five copies of the agreement
for state administration of the local sales and use tax
ordinance together with certified copies of Ordinance No. 8
imposing the sales and use tax at the rate of one percent.
• Also attached to the agreement were certified copies of the
order authorizing the mayor to execute the agreement.
The agreement and the ordinance appear to be in proper form,
except the operative date of the ordinance is stated to be
March 22, 1982, under our agreement form the effective date
will be April 1, 1982.
Under the terms of the Alameda County ordinance No. 196 N.S.,
the Alameda County ordinance will terminate on the first day
of the first calendar quarter commencing more than 60 days
after the date any city within the county increases that rate
of its sales and use tax above the rate in effect on July 1,
1956. All of the cities in Alameda County impose a tax at
the rate of .95 percent. The City of Dublin's rate is in
excess of that amount. Therefore, it is our opinion the
imposition of the City of Dublin tax at a rate of one percent
will cause the Alameda County ordinance to terminate as of
July 1, 1982, unless some action is taken. On that date,

Alameda County will cease to be a conforming county and we
will not administer the ordinance of the county and cities
within the county.
I have executed the agreement on behalf of the Board and we
are now transmitting the documents to the Department of
Finance and Department of General Services for final execution
on behalf of the State. When this is done, we shall return
to you one fully executed copy of the agreement and ordinance.
