HomeMy WebLinkAboutItem 3.1 Approve 01-24-1983 Minutes (2) t REGULAR MEETING - JANUARY 24, 1983 A regular meeting of the City Council of the City of Dublin was held on Monday, January 24 , 1983 in the meeting room, Dublin Library. The meeting was called to order at 7 : 35 p.m. by Mayor Peter Snyder. ROLL CALL PRESENT: Councilmembers Burton, Hegarty, Jeffery, Moffatt and Mayor Snyder. PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of allegiance to the flag. CONSENT CALENDAR On motion of Cm. Burton, seconded by Cm. Moffatt, and by unanimous vote, the following were approved: Minutes of regular meeting of December 27 , 1982 , and regular meeting of January 10 , 1983 ; Warrant Register in the amount of $155, 714 . 94 ; Financial Report for the period ending December 31, 1982 ; Denial of claim of Robert A. Smiarowski , and notify claimant; Authorized Mayor to execute insurance agreement between City and County of Alameda. PROCLAMATION SCOUTING ANNIVERSARY WEEK Mayor Snyder proclaimed the week of February 6 - 12 , 1983 as Scouting Anniversary Week . In recognition of this anniversary, Cm. Burton arranged with the local Scout Executive Committee, City and DSRSD Staffs, and the Chamber of Commerce for a Scouting-City Leadership Day on February 16th. The purpose of this event is to provide a selected group of Scouts from the community with the opportunity to learn more about the services which are provided to residents in the City of Dublin. The Scouts will have an opportunity to tour community facilities, talk with various City officials, and participate in the Chamber of Commerce luncheon. Cm. Burton urged Councilmembers to drop in and talk with the Scouts regarding their official duties . Cm. Burton introduced Mr. Bill Northend, District Scout Executive, who accepted the Proclamation. Mr. Northend introduced Jim Kohnen, who was recently bestowed with the Silver Beaver Award ( the highest award that can be given to any volunteer Scouter in the United States) . ITEM NO. CM-2-7 Regular Meeting January 24, 1983 ORAL COMMUNICATIONS Al Chavarria, Deputy Sheriff ' s Association Football Chairman The Deputy Sheriff ' s Association Football Committee has scheduled a football game between the Sheriff ' s Lawmen and the Oakland Police Department' s Thunderhogs . The game will be played at Dublin High School on Saturday, February 19th at 6 : 00 p .m. The game is co-sponsored by the Dublin Booster Club and the Dublin Youth Football League. 'Mr. Chavarria, requested City recognition of this event and further requested that a proclamation be prepared, declaring the day of Feb. 19th as "Ramon Irizarry Day" . Mr. Irizarry was the 25 year old Oakland police officer who died on January 18th from gunshot wounds received while participating in a narcotics raid on January 11th. The football game will be dedicated to his memory. Mr. Chavarria requested a letter from Mayor Snyder indicating the City is backing this event. Other guests that will be present at the game are Sheriff Glenn Dyer and Chief Tom Shores . Mayor Snyder and Councilmembers declined to accept complimentary tickets to the game, indicating they would rather pay for the tickets. ALAMEDA COUNTY FAIR ART EXHIBIT The City received a letter from Muriel F. Dean, inquiring whether or not the City desired to participate as an art patron in the Alameda County Fair' s Art Exhibition. The City must agree to spend a minimum of $100 , which would go toward the purchase of a work of art which, once selected, would be exhibited at the Fair and then kept by the City for its own facility. Cm. Jeffery felt this request was premature in that the City does not yet have permanent facilities in which to display a piece of artwork. Cm. Burton questioned who would make the selection. The City Manager advised that in Livermore, the selection is made by Lee Horner, City Manager. On motion of Cm. Moffatt, seconded by Cm. Hegarty, and by majority vote, the Council agreed that the City would participate in the Art Exhibition with a donation of $100 . If possible, the artist should be from Dublin. The selection will be made by Kay Keck, Deputy City Clerk. Against the motion was Cm. Jeffery. CHAMBER OF COMMERCE MEMBERSHIP The City has received a letter from the Dublin Chamber of Commerce inviting the City to participate as a member of the Chamber. The annual membership fee would be $200 per year. Cm. Burton indicated he was uncomfortable participating in this decision. Discussion was held as to whether anything could be gained by having the City become a member, in that 4 of the 5 Councilmembers are presently members, so lines . of communications are established and open. CM-2-8 After discussion, a motion was made by Cm. Moffatt and seconded by Cm. Burton to join the Chamber. The City Attorney felt that in order to avoid any suggestion of conflict, Cm. Burton should refrain from voting on this motion. Cm. Burton, therefore, withdrew his second to the motion. The motion was then seconded by Cm. Hegarty. The motion failed on a 2 - 2 vote with Mayor Snyder and Cm. Jeffery casting no votes . CITIZEN' S CABLE TELEVISION ADVISORY COMMITTEE As a result of a request initiated by the Dublin City Council last year, the Citizen' s Cable Television Advisory Committee has prepared a set of rules of procedure for it to follow. The Committee has requested that each partic- ipating agency review the rules and adopt them unless any modifications were recommended. Rich Metzner and Beth Grant DeRoos addressed the Council with further requests that Dublin withdraw from participation on this Committee . Cm. Burton stated he is grateful for the amount of work being done by this Committee in accumulating information; their specialists, their technologists, etc . , who have done a lot of research and felt it would be impossible for Dublin to duplicate these efforts . On motion of Cm. Jeffery, seconded by Cm. Burton, and by unanimous vote, the Council accepted in concept and adopted the rules of procedure, and directed Staff to publicize the 3 openings on the Committee. COMPREHENSIVE TRAFFIC & IMPROVEMENT STUDY San Ramon Road In accordance with City Council direction at its meeting of January 10 , 1983 the City Engineer and Traffic Engineer have identified the scope of services required to determine the ultimate configuration of San Ramon Road. The tasks proposed provide sufficient detail to enable the City' s engineering staff to begin the actual design work on San Ramon Road once the Council approves the conceptual design. The City Traffic Engineer has also included the development of short-term improvement priorities which would be in accordance with the overall plan and could be constructed as funds become available . The estimated time of completion of the study is 8 weeks . The total cost of the study is not to exceed $11, 000 . Should the Council desire to develop a base map for Dublin Boulevard at the same time Dublin / Silver- gate and San Ramon Road were photographed, an additional $3 , 200 appropriation would be necessary. This would save the City approximately $300 in making an additional flight. After discussion, on motion of Cm. Jeffery, seconded by Cm. Moffatt, and by unanimous vote, the Council authorized study under the City ' s existing services contract with Santina '& Thompson and authorized budget transfer from contingent reserve of $14 , 200 . CM-2-9 Regular Meeting January 24 . 1983 CITY SEAL A copy of the revised drawing was presented for Council consideration. After a short discussion, it was determined that the plow depicted was not quite what the Council had envisioned. Further, the word "THE" should be removed preceeding CITY OF DUBLIN. The shamrock design also was not quite right. Mayor Snyder felt there was a mixture of a modern versus traditional concept and this problem is due to the fact that the Council has never communicated to the artist appropriately to say within the 4 quadrants a traditional rather than modern concept was desired. Staff was directed to relay this information to the graphic artist designing the seal . CITY INSURANCE ANNUAL RENEWAL On February 1, 1983, the City' s Errors and Omissions Policy and Commercial Umbrella Liability Policy will expire. The City ' s Insurance Broker, Ben Fernandez , has indicated that the City may renew both these policies for 1983 at the same premium that was paid during 1982 . With respect to the Comprehensive Basic Liability Policy, the original policy was written for a three year term. However, due to changes in exposure, it is anticipated that the premium for this policy will increase by approximately $500 over 1982 . These additional exposures are primarily the addition of equipment in the City Offices . The total estimated insurance costs for 1983 are $8, 566 , as compared to $8 , 066 for 1982 . The limits of liability for the City are $5, 500 , 000 . If the City Council is desirous of increasing that coverage to $10 , 000, 000 , the City' s Insurance Broker has indicated that he could get the estimated cost of providing that coverage . Ben Fernandez addressed the Council and presented 4 other quotations which he recently received. He indicated that under Alternate II, the City could obtain $10, 000 , 000 in coverage at a cost of $8 , 115 . On motion of Cm. Hegarty, seconded by Cm. Moffatt and by unanimous vote, the Council authorized the purchase of Public Entity Errors and Omissions and Commercial Umbrella Liability Policies, and authorized the renewal of the Basic Liability Policy with $10 , 000, 000 coverage as indicated in Alternate II . RECESS A short recess was called. The meeting reconvened at 9 : 30 p.m. with all Councilmembers present. CM-2-10 Regular Meeting January 24, 1983 AGREEMENT - TRAFFIC SIGNAL & STREET LIGHTING The County of Alameda is presently operating under a contract with the California Department of Transportation which provides for sharing the operating and maintenance costs for traffic signals and street lights which are in intersections partially owned by the State and partially owned by the City of Dublin. Since this contract was entered into prior to incorporation, it is necessary for the City to enter into a separate agreement with the State for those intersections which were previously covered by the County agreement. Facilities covered under this agreement include traffic signals and 17 street lights at the intersection of San Ramon Road/Dublin Boulevard, and 6 street lights at the intersection of Dublin Boulevard and Dougherty Road. The City' s share of the cost varies from 50% to 750 , depending on the number of legs of the intersection owned by each jurisdiction. The estimated cost - ' . of the City ' s share of operating and maintaining these facilities is approximately $8, 100 per year. Following discussion, on motion of Cm. Burton, seconded by Cm. Jeffery, and by unanimous vote, the Council adopted a resolution authorizing the Mayor to execute the agreement. RESOLUTION NO. 2 - 83 APPROVING AGREEMENT FOR MAINTENANCE OF STATE HIGHWAY IN THE CITY OF DUBLIN ' TRAFFIC REGULATIONS - ORDINANCE ESTABLISHING The City has been notified by the County Public Works Department that the County had neglected to include certain portions of the Traffic Regulations at the time that the City adopted the County' s Traffic Regulations by reference . The locations impacted by these traffic regulations were identified on the ordinance provided to the City Council . Since these traffic regulations are not presently in force, it is important for purposes of public safety to adopt the ordinance on an urgency basis . Council consensus was that paragraph #6-168 . 36 should be removed. On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote, the Council agreed to waive reading of ordinance, introduce and adopt ordinance (with deletion) , on an urgency basis . ORDINANCE NO. 1 - 83 ESTABLISHING TRAFFIC REGULATIONS MID-YEAR FINANCIAL REVIEW 1982-83 A mid-year financial review was presented for Council review. The report was presented in order that the Council will be in a better position to CM-2-11 grapple with such issues as the street lighting assessment district, the funding of capital improvements and other funding problems which may surface between now and the end of the fiscal year. The report consisted of a review of both revenues and expenditures, estimated fund balance and its impact on reserves . The City Manager reported that the financial condition of the City at this point in time is better than anticipated during the preparation of the 1982-83 preliminary budget. He advised that the Staff will continue to keep . the Council informed with respect to the City ' s financial. condition and update the City Council on State and Federal legislation which may impact the City in the future. Mayor Snyder and Cm. Burton complimented Staff on the very comprehensive and thorough report. OTHER BUSINESS Storm Damage The City Manager reported that there was considerable damage, particularly to the western half of the City as a result of the storm yesterday and today. The County Road Department has responded and is working as fast as possible. Cm. Moffatt indicated he had had several favorable comments from the public related to the speed with which the County had responded. Joint Meeting with School Board . The City Manager reported that he had been contacted .by Dick Cochran, Murray School District Superintendent, requesting a joint meeting, possibly sometime in early March. He will come back with some suggested dates for this meeting. . Beautification/Trees Cm. Jeffery reported some statistics of which she had recently become aware concerning the value of trees . Trees act as enormous air filters . One acre of trees removes 13 tons of dust and 3 . 7 tons of carbon monoxide from the air. She felt this important, in that the City will soon begin the monumental task of beautification CM-2-12 Meetings & Conferences Cm. Burton questioned Council ' s policy related to attendance at various meetings and conferences ; specifically, the ABAG 2/24 meeting ( $45) , and the Bay Area Council 2/9 meeting ( $60 ) . Council consensus was that if Council- member felt they could get something out of the conferences to report back to the Council, then they should attend. Hazardous Spills Chief Shores indicated he had attended a meeting put on 'by the Office of Emergency Services with regard to hazardous spills . There is legislation on this now. Up until the first of the year, . the police department jurisdiction had to be the on-scene manager. This is no longer true. Through contract services, the City can contract with the Fire Department. Cm. Jeffery asked for clarification. Do we have the option of choosing who would provide this service? Yes , the City could select either the Fire Department or the Police Department. The OES has literature in the works and he will check to see if a copy can be made available to the Council. The City Manager indicated that this topic is one the City/County Manager' s Conference will be addressing this spring; hazardous spill plans and the need to develop a local plan, and possibly a County advisory task force. EXECUTIVE SESSION At 10 :20 p.m. , the City Council adjourned to executive session to discuss potential litigation. RECONVENE TO PUBLIC MEETING At 11: 20 p.m. , the executive session ended and the public meeting continued, with all Councilmembers present. City ' s Anniversary of Incorporation The City Council agreed to have a reception in celebration of the City' s first birthday. The reception will be held from 6 : 30 to 7 :30 p.m. , on February 14th, in the Dublin Library meeting room. The reception will be held just prior to the next regular meeting. CM-2-13 ADJOURNMENT There being no further business to come before the Council, at 11: 30 p.m. , the meeting adjourned to an adjourned regular meeting for a joint study session with DSRSD at 7 : 30 p.m. , on February 8 , 1983 at the Dublin San Ramon Services District Board Meeting Room, 7051 Dublin Boulevard.
