HomeMy WebLinkAboutItem 6.1 Hansen Drive Extension (2) (�� d `4T) CITY OF DUBLIN AGENDA STATEMENT MEETING DATE : June 13 , 1983 SUBJECT Street Vacation - Extension of Hansen Drive EXHIBITS ATTACHED Letter from Alameda County dated March 17 , 1983; Revised Resolution; Site Sketch RECOMME AT ON Approve resolution to summarily vacate "60 ft wide roadway easement" (extension of Hansen Drive ) on Parcel Map 1168, Parcel B; Record Resolution FINANCIAL STATEMENT: None DESCRIPTION A 60 ft roadway easement at the end of Hansen Drive was offered for dedication as a part of a Parcel .Map filed in 1973 . An eight lot subdivision is now proposed over one of the two lots (Parcel B) in the original Final Parcel Map and the alignment and width of the street has been changed. The City ' s vacation of the original right-of-way will allow the new street alignment to be platted as the ultimate layout . This vacation shall be effective concurrent with the filing of the Final Map, thus maintaining access to the adjacent property. The Tentative Map for this subdivision was approved by the County prior to Dublin becoming a City with a condition that Hansen Drivp be so designed as to allow a cul-de-sac on the adjacent parcel . All the property to the west of these two parcels , as well as at the end of Betlen Drive , belong to Valley Christian Center and was developed for the church use using Dublin Boulevard. The County felt that access to the church property was no longer necessary from Hansen Drive or Betlen Drive . As the condition was made at the Tentative Map approval , the Final Map could not be denied because of the developer conforming to that condition. However, alignment of the new street would not preclude it from extending, except at a 34 ft curb to curb width, rather than at a 40 ft width. The adjacent property owner was contacted regarding this abandonment , and he would not commit himself to a stand on the issue . He indicated that if the street was to cul-de-sac he would prefer to move the beginning of the bulb eastward to begin on the next property to save him some area for development . It was indicated to him that even if the abandonment proceeded, it would not be decided whether the street would cul-de-sac or continue through. Pastor Tanneberg of the Valley Christian Center and his traffic engineer (TJKM) were contacted on the proposed abandonment . It is their position that it would be better to leave the street connections open at this time , until more was known regarding the Hansen property and any possible connection to that property for a second church access . The attached street vacation does , therefore , only abandon the portion of the old 60 ft right-of-way through the subject proposed subdivision so that the finalizing of that map can proceed. It does not impact the right-of-way outside of this development . The decision to extend Hansen Drive can thus be deferred until the property west of Tract 4988 is developed. Box 2340 Dublin, CA 94568 Dear Mr. Thompson: Enclosed are four copies of a proposed resolution to be enacted by the City Council of the City of Dublin vacating a 60 foot right of way, dedicated on Parcel Map 1168, which is no longer needed for road purposes. By Resolution No. 81-48 dated December 1 , 1981 , the Alameda County Planning Commission approved Tentative Tract 4988. Tract 4988 occupies a portion of the land included on Parcel Map 1168. The roadway alignment and width approved by Tentative Tract 4988 differs from that dedicated on Parcel Map 1168. A copy of sheet 2 of the Preliminary Final Map for Tract 4988 is attached and shows the existing 60 foot easement and the proposed right of way to be dedicated on the final map. Your cooperation in processing this Resolution through the City Council will be appreciated. The Resolution should be recorded as soon as possible so that reference to the 60 foot easement can be eliminated from the final map. If you have any question, please call Bill Hanke at 8&1-6447. Williams, RCE RESOLUTION NO. - 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- SUMMARILY VACATING "60' WIDE ROADWAY EASEMENT" (EXTENSION OF HANSEN DRIVE) ON PARCEL MAP 1168, PARCEL B; RECORD RESOLUTION WHEREAS , the extension of Hansen Drive westerly from its present terminus at the westerly line of Tract 2534 is shown as "60 ' Wide Roadway Easement" on that certain map entitled "Parcel Map 1168" etc . , filed September 18 , 1973 , in Book 80 of Maps at page 21 thereof , Records of Alameda County, California , and said roadway easement over Parcel B of that map is particularly designated and described as : Assessor ' s 941-117- 15 (Pors . ) All that real property situate in the City of Dublin, County of Alameda , State of California , being the portion of the 60 foot-wide roadway easement contained within "Parcel B" as per that certain map entitled "Parcel Map 1168" , recorded September 13, 1973 in Book 80, Page 21 of Parcel Maps in the Office of The Recorder of said County, and described as follows : A strip of land 60 feet in width, and more particularly described as follows : Commencing at the most easterly corner of said 60 foot-wide Roadway Easement ; thence from said point of commencement westerly 157 . 61 feet , through an angle of 16 degrees 07 ' 30" , along a curve concave to the northwest , having a radius of 560 feet ; thence .tangent to said curve N 89 degrees 20 ' 00" W 185. 94 feet to an angle point in the westerly boundary of said Parcel B as per said map; thence along the westerly boundary of said "Parcel B" N 0 degrees 40 ' 00" E 60.00 feet ; thence , leaving the said westerly boundary, S 89 degrees 20 ' 00" E 185. 94 feet ; thence easterly 140. 71 feet , through an angle of 16 degrees 07 ' 30" , along a tangent curve concave to the northwest , having a radius of 500 feet ; thence along a line radial to said curve S 15 degrees 27 ' 30" E 60.00 feet to the point of commencement . Containing 0.462 acres , more or less . AND WHEREAS , by Dedication dated August 17 , 1973 , the owners of the hereinabove described real property did offer to dedicate and convey a perpetual right of way and easement to the County of Alameda for public highway purposes and appurtenances thereto , in, over and upon the hereinabove described real property; and Page 1 WHEREAS , by Resolution No. 150200, adopted September 4, 1973 , the Board of Supervisors of the County of Alameda, State of California , did not accept said offer of dedication, but did retain the right for said County of Alameda , its successors or assigns , to accept said offer at a future date , pursuant to the provisions then prevailing of Section 11616 of the Business and Professions Code of the State of California; and WHEREAS , a certified copy of said Resolution No. 150200 was recorded on September 5 , 1973, on Reel 3505 of Official Records at image 311 thereof ( 73-121635 ) , Records of Alameda County, California ; and WHEREAS, this City Council does and it hereby finds and determines that no public highway has been constructed within the hereinabove described easement area , and the same is not required for public highway or street purposes once the Final Map for Tract 4988 has been filed, and is not useful for bikeway purposes , and the vacation thereof will not terminate any public service easement ; NOW, THERFORE, BE IT RESOLVED, under the authority of Division 9 , Part 3 , Chapter 4, beginning with Section 8330 , of the Streets and Highways Code of the State of California , that the right of way and easement for roadway purposes over , upon and across the hereinabove described real property is hereby summarily vacated and abandoned concurrent with the filing of the Final Map for subdivision 4988; and BE IT FURTHER RESOLVED, that the Clerk shall cause a certified copy of this resolution of vacation, attested by the Clerk, to be recorded at the office of the Recorder of the County of Alameda, said vacation and abandonment to be complete upon concurrent recordation. of Final Map 4988 or subsequent Final Map approved by the City Council of the City of Dublin, and from and after the date the Final Map is recorded, the hereinabove described right-of-way and easement no longer constitutes a street or highway.
