SUBJECT : Encroachment Request - Banner Over Dublin Boulevard

RECOMMENDATION: 1 ) Approve installation of permanent poles for banner
erection on the east side of San Ramon Road between
Dublin Boulevard and Amador Valley Boulevard
2 ) Authorize installation . of an advertising banner by
Children ' s Theatre Workshop subject to installation
of banner poles, waive encroachment permit fees ,
inspection fees and bonds, subject to a certificate
of insurance covering the City against damage caused
by reason of the sign being placed over the roadway
FINANCIAL STATEMENT : Banner pole installation will cost approximately $800
DECRIPTION: The Children ' s Theater Workshop, a non-profit
organization, will be holding plays within the City of Dublin four times
within this fiscal year . The Workshop has requested the City ' s authorization
to hang a banner advertising each performance for a two-week period preceeding
each performance .
Inasmuch as the banner would need to be attached to both a PG&E pole and a
Pacific Telephone pole, this request was referred to the Dublin Underground
Utility Committee .
At the Committee meeting , PG&E indicated that it would not permit banners to
be attached to its utility poles due to dangerous past experiences . Pacific
Telephone & Telegraph indicated it would permit a banner to be attached to its
poles . The Underground Utility Committee recommended that the best location
for the banner using existing poles would be on the south side of Dublin
Boulevard between San Ramon Road and Regional Street, to span from a PT&T pole
on the south curb line to a State-owned light pole in the median. Staff
contacted the State of California and the State indicated that it would not
permit any banners to be attached to its light poles .
Since neither PG&E nor the State of California will permit banners attached to
their facilities, the installation of advertising banners would be precluded
in the City. PG&E has offered to donate two metal poles to the City of Dublin
within the next few months to be used as permanent banner standards . The
installation of such poles would enable the City to accommodate groups
advertising events of interest to the entire community. The City would have
to pay for the installation of the metal poles . Staff has reviewed the
locations for the permanent banner poles and recommends that the poles be
placed on the east side of San Ramon Road between Dublin Boulevard and Amador
Valley Boulevard, one pole in the median and one pole in the east sidewalk
area .
With respect to the Children ' s Theatre Workshop encroachment request for the
installation of an advertising banner and waiver of permit fees , it is
recommended that the City Council authorize the installation of the
advertising banner pending the installation of the permanent banner poles, and
further that the Council waive the encroachment permit fees, inspection fees
and bonds, subject to the Children ' s Theatre Workshop providing the City with
a certificate of insurance covering the City against damage caused by reason
of the sign being placed over the roadway.

Dear Mr. Thompson:
Children's Theatre Workshop, a non-profit, award winning theatre
company produces high quality plays for the valley's children and
their families. We perform each of our productions in Dublin,
Pleasanton and Livermore.
At this time, we are requesting a permit for encroachment to hang
an advertising banner on Dublin Blvd between RB Furniture and
Grand/Auto. Our banner, made to the City of Livermore specifi-
cations , is constructed of _durable canvas with wind pressure relief
holes, 30' x 3' in size with sufficient nylon rope to hang from
two facing utility poles , designed to- withstand wind loads. It
hangs at least 16' from the centerline of the street at the lowest
point, and is printed on both sides. We request permission to hang
it two weeks before each of our performances at Dublin High School 's
Little Theatre. The dates are as follows:
1983 - Nov. 14 thru Nov. 28 A Christmas Carol
1984 - Jan. 2 thru Jan. 16 Androcles and the Lion
Feb. 20 thru Mar. 5 Rumpelstiltskin
Apr. 23 thru May 7 Dr. Doolittle .
Because of CTW's limited budget, we are requesting a waiver of fees.
In the past two years , we have found that a banner hung on a main
street in Livermore and Pleasanton is an invaluable advertising tool
for our theatre productions. We hope to attract a larger Dublin audience
in this way as we continue to serve the children of your city.

POLICY STATEMENT
STREET BANNER ERECTION AND REMOVAL
A street banner is occasionally approved for erection across Fourth
Street between "J" and "K" Streets for the advertisement of various civic
activities in the community.
The organizations installing the banner have had difficulty locating
aerial equipment to install and remove the banner. A policy has been estab-
lished which will allow the City Street Maintenance Division to install and
remove the banner for the applicants for a total compensation of $50.00.
Additionally, the applicant will be required to obtain an encroachment
permit at the City Engineer's office prior to the installation of the banner.
Standard Conditions, dated May 10, 1982, will govern the installation of the
banner as well as special conditions that may be deemed appropriate. The
standard detail for the banner installation dated May 1982 will also
apply.
The Police and Fire Department are to be notified by the Engineer's office
when any banner encroachment permit is needed.

BANNER INSTALLATION ACROSS FOURTH STREET BETWEEN "J" AND "K" STREET
1 . An encroachment permit is required. A fee of $50.00 will be charged
for installation.
2. The City will install the banner.
3. Special Conditions:
a) Banner must be 16 ft. from centerline of street at the lowest
point of the banner.
b) Maximum banner size shall be 30' x 3' .
c) The banner will be located on existing poles which are shown on the
attached sketch.
d) The banner and attachments installation must be designed to
withstand wind loads.
e) The banner, restraining ropes , and the wind pressure relief holes
must be inspected and approved by the City Maintenance Superin-
tendent (449-4019) prior to the required installation date.
f) Permittee shall be financially responsible for any required main-
tenance of the installation in addition to the installation fee,
during the time the banner is up.
g) In event the City makes the banner installation and removal , the
Permittee shall pick up the banner not more than two working days
after the designated expiration date of the permit. Otherwise, the
City will not be responsible for the banner.
h) The maximum time that the banner may be in place is two weeks.
