HomeMy WebLinkAboutItem 3.6 SlvrgteVllgPkwy#83-1 (2) CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: October 10, 1983 SUBJECT Contract 83-1 Dublin Boulevard/Silvergate Drive Intersection and Village Parkway Median Improvements EXHIBITS ATTACHED : Resolution; Letter from County dated August 31, 1983; Agreement RECOMMENDATION~ .:J 1) Accept improvements under Contract 83-1 ~%/~ 2) Adopt Resolution approving agreement  3) Authorize additional appropriation and utiliza- tion of County Gas Tax funds for both projects FINANCIAL STATEMENT: Total Contract Cost - $61,404.53; Amount Budgeted - $55,533.00 DESCRIPTION : In June 1983, the City Council awarded Contract 83-1 to Ambo Concrete, Inc., for the improvement of the intersection at Dublin Boulevard and Silvergate Drive and the improvement of the drainage along the Village Parkway medians. The total contract amount was $53,775.94. During the construction phase, the City Engineer authorized three change orders totalling $6,213.62 in order to accommodate minor variances in field measurements to the plan dimensions, removing old asphalt from two existing catch basins, replacing some additional curb along Village Parkway, and installing additional pavement and curb delineation at the Dublin Boulevard/ Silvergate Drive intersection. An additional change order was authorized to do some minor concrete work on Amador Valley Boulevard including the installation of two handicap ramps and replacement of curb, gutter and asphalt overlay in the median. This additional maintenance work totalled $1,733.00 The total cost of the work completed by the contractor is broken down follows: CONTRACT BUDGET ACTUAL as Dublin Boulevard/Silvergate Drive Village Parkway Median Sub Total $ 33,500.00 20,300.00 $ 53,800.00 $ 34,043.66 25,627.87 $ 59,671.53 Extra Maintenance Work $ 1,733.00 $ (Sufficient funds in Street Maintenance Account) 1,733.00 TOTAL CONTRACT COST $ 55,533.00 $ 61,404.53 FUNDING The actual contract cost exceeded the 1983-84 approved budget for both projects by $6,213.62. Since the City received more County Gas Tax funds than anticipated during Fiscal Year 1982-83, it is recommended that the City Council modify the budget and authorize the utilization of these funds to fund both projects. Additional funding for the Dublin Boulevard/Silvergate Drive project will come from the County in the amount of $15,000 provided the City approves the attached agreement. The City Attorney has reviewed the agreement and has found it satisfactory. It is further recommended that the City Council adopt a resolution approving the agreement with the County. ACCEPT WORK The Contractor has completed the improvements in accordance with the approved plans and modifications. A retention of 10% of the contract amount is held for 60 days to insure landscaping establishment. During that time, the Contractor will water and replace any plants that do not become established. It is recommended that the City Council accept the improvements. COPIES TO: ITEM NO. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AN AGREEMENT WITH ALAMEDA COUNTY FOR THE COST SHARING OF THE DUBLIN BOULEVARD/SILVERGATE DRIVE INTERSECTION IMPROVEMENTS WHEREAS, the Alameda County Staff identified a traffic design situation at the intersection of Dublin Boulevard and Silvergate Drive, which required some redefining; and, WHEREAS, this condition existed and had been approved by the County prior to Dublin's incorporation; and, WHEREAS, The County Staff presented alternative solutions to the Dublin City Council; and, WHEREAS, the Dublin City Council approved one of these solutions and did undertake a contract to make those improvements. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby approve an agreement with Alameda County for the cost sharing of these improvements. Box 2340 Dublin, CA 94568 Dear Lee: SUBJECT: DUBLIN BOULEVARD/SILVERGATE DRIVE INTERSECTION RECONSTRUCTION We have prepared an Agreement covering the County's participation in the funding of the modification of the intersection of Silvergate Drive with Dublin Boulevard. The Agreement, in essence, provides for the City's indemnifi- cation of the County of Alameda of all responsibility arising from the modified intersection and for the County's participation to the extent of $15,000.00 in the reconstruction. I have enclosed the original and four copies for your review. The Agreement has been approved as to form by the County Counsel's Office. If after your review it it is acceptable to you, please present it to your City Council for adoption and return the original and three copies bearing original signatures along with certified copies of the Resolution authorizing its execution to this office. It will then be presented to the Board of Supervisors for execution. Burnham Public Works Agency 399 Elmhurst Street Hayward, CA 94544 QIC 50504 AGREEMENT BETWEEN COUNTY OF ALAMEDA AND CITY OF DUBLIN FOR FINANCING THE RECONSTRUCTION OF THE INTERSECTION OF DUBLIN BOULEVARD WITH SILVERGATE DRIVE IN THE CITY OF DUBLIN PLEASANTON TOWNSHIP, ALAMEDA COUNTY, CALIFORNIA THIS AGREEMENT, made and entered into by and between the COUNTY OF ALAMEDA, a political subdivision of the State of California, hereinafter called COUNTY, and the CITY OF DUBLIN, a municipal corporation, hereinafter called CITY, WITNESSETH: WHEREAS, both the COUNTY and the CITY agree that the reconstruction of the intersection of Dublin Boulevard with Silvergate Drive will be a benefit to the motorists in the County and the City; and WHEREAS, COUNTY has indicated its desire to enter into an agreement with CITY to provide for the distribution of the costs between CITY and COUNTY and the indemnification of COUNTY by CITY; and WHEREAS, such agreement is authorized and provided for by Section 6500 et seq. of the Government Code; NOW, THEREFORE, IT IS AGREED AS FOLLOWS: SECTION I FOR AND IN CONSIDERATION OF THE COVENANTS AND CONDITIONS TO BE KEPT AND PERFORMED BY CITY, AS PROVIDED HEREIN, COUNTY AGREES TO: 1. Pay CITY the amount of FIFTEEN THOUSAND AND NO/lO0 DOLLARS ($15,000.00) as COUNTY's share of the reconstruction costs within thirty (30) days after CITY's execution of contract with the Contractor. Fully defend, hold harmless and indemnify COUNTY, its officers, agents, and employees against any and all claims, demands, damages, costs, expenses or liability arising out of or in connection with the reconstruction of the intersection of Dublin Boulevard and Silvergate Drive and the maintenance thereof and any work performed under this Agreement.
