HomeMy WebLinkAboutItem 8.1 Directly Elected Mayor (2) CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: November 14, 1983 SUBJECT Directly Elected Mayor EXHIBITS ATTACHED Letter from Councilmember Moffatt dated October 25 , 1983 ; Memorandum from City Attorney dated July 5 , 1983 RECOMMENDATION Wconsider FINANCIAL STATEMENT: None DESCRIPTION Councilmember Moffatt has requested that the City Council consider whether the City should have a directly elected Mayor for a four-year term. As you may recall, the City Attorney on July 5 , 1983 , responded to a similar inquiry from former Councilmember Burton . As indicated in the City Attorney ' s memorandum, State law provides two methods for selecting a Mayor . APPOINTMENT OF MAYOR The Government Code provides that the City Council shall meet on the Tuesday after the general municipal election and choose one of its number as mayor and one of its number as mayor pro-tempore . The code does not specify the term of the appointment . Therefore, the City Council may develop its own procedure and the term for both the mayor and mayor pro-tempore . DIRECTLY ELECTED MAYOR The Government Code provides that the question of a directly elected mayor must be put to the voters along with the term of office that the Mayor will serve . The term of office may be either for two years or four years . This question could be put to the voters at the City' s next municipal election in . April 1984 . The actual election of mayor would take place in April 1986 _ If the City Council determined to place the issue before the voters, it must adopt a resolution to that effect. Public notice would be given at the same time of the public notice for the City Council election. This notice must be published or posted by the City no later than the 75th day preceeding the election, January 26 , 1983 . With respect to differences between the directly elected mayor and an appointed mayor, the Government Code provides that the mayor, with the approval of the City Council shall make all appointments to boards, commissions, and committees unless otherwise specified by statute . The Government Code provides that an elected mayor may be provided with compensation in addition to that which he receives as a councilmember. Such additional compensation may be provided by ordinance adopted by the City Council or by a majority vote of the electors voting on the proposition at a municipal election. Staff has also been requested to survey which cities have directly elected vs appointed mayors . According to the League of California Cities approximately 111 out of nearly 400 cities have directly elected mayors, or approximately 280 . Box 2340 Dublin, CA 94566 (415) 829-3543 MEMORANDUM July 5 , 1983 TO: CITY COUNCILPERSONS AND CITY MANAGER FROM: CITY ATTORNEY RE: DIRECTLY ELECTED MAYOR The question has been asked whether or not the office of Mayor may be made a directly-elected position. The answer is yes , the procedure is as follows : The City Council , by resolution, may submit to the electors at any general municipal election, or at a special election held for that purpose , the question of whether the electors shall thereafter elect a Mayor and four City Councilmen , and whether such Mayor shall serve a two year or four year term. Gov Code §34900 The questions shall be printed on the ballots used at the election in substantially the following form: "Shall the electors elect a Mayor and four City Councilmen?" "Shall the term of office of Mayor be two years?" "Shall the term of office be four years?" The words "yes" and "no" and "two years" and "four years" shall be so printed on the ballots that the voters may express their choice. the term of office of Mayor shall be that preferred by a majority of those voting on the proposition. Gov. Code §34901 At the next succeeding general municipal election, one of the offices of City Councilman, to be filled at said election, must be designated as the office of Mayor, to be filled at such election. Gov. Code §34902 RE: Directly Elected Mayor July 5 , Page Two The timeframes, if this be the choice of the Council , are as follows . Unless a special election were called for this question, the question would be on the ballot at the April 1984 general election. If a majority approves , the election of a Mayor would occur at the April 1986 general election.
