FINANCIAL STATEMENT: Budget and estimated election cost - $10 , 000
DESCRIPTION The City ' s first municipal election is scheduled for
April 10 , 1984 . This date is set by State Law for all general law cities .
There will. be five ( 5) City Council positions up for election.
The first day for taking out and filing nomination papers will be
January 12 , 1984 . The last day to file nomination papers will be
February 2 , 1984 if all incumbents file. If an incumbent does not file, the
nomination period will be extended to February 7 , 1984 .
The hours of polls are subject to decisions of the City. By State Law, the
City is required to have polls open for a minimum of eight consecutive
hours . For County, State and Federal elections, the hours of the polls are
from 7 : 00 a.m. to 8 : 00 p.m. Staff recommends that the City Council
establish poll hours which follow the above hours . This will allow
residents who commute to their place of employment adequate time to return
home and vote .
The type of ballot is also at the discretion of the City. The two choices
available to the City are paper ballots or computer cards . The cost of each
system is approximately the same to the City. The paper ballots require
counting by precinct workers after the closing of the polls, whereas the
computer cards are preferred by precinct workers because they may complete
their work at a much earlier hour. There should a savings in time that it
takes to determine the outcome of the election by using a computer. The
computer and operator would be provided by the City' s election supplier.
Staff recommends the computer card ballot be used because of the savings in
time which would be realized.
The City Council also may determine whether the statement of qualifications
which each candidate is allowed to place in the sample ballot at his own
expense should be a maximum of 200 words or a maximum of 400 words . Staff
recommends the maximum of 200 words . In the event the City Council should
decide to increase that maximum to 400 words, the cost to each candidate
would probably double . The curent estimate for the cost to a candidate for
publishing his statement of qualifications is approximately $100 for a 200
word statement or approximately $200 for a maximum 400 word statement.
The City may determine whether or not the City or candidate should pay for
the costs associated with printing, translating and handling the Candidate ' s
Statement .
RECOMMENDATION
It is Staff ' s recommendation that the City Council address the following
issues and adopt the appropriate resolutions :

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

CALLING AND GIVING NOTICE OF THE HOLDING OF A
GENERAL MUNICIPAL ELECTION
TO BE HELD IN THE CITY OF DUBLIN ON
TUESDAY, APRIL 10, 1984
FOR THE ELECTION OF CERTAIN OF OFFICERS OF SAID CITY
WHEREAS, under the provisions of the laws relating to General
Law Cities a regular general municipal election shall be held on
April 10 , 1984 for the election of five ( 5) members of the City Council ;
and
WHEREAS, under the provisions of Government Code Section 35443
the terms of the two ( 2 ) candidates receiving the highest number of
votes shall be four ( 4 ) years and the term of the three ( 3 ) candidates
receiving the lowest number of votes shall hold office for two ( 2 ) year
terms .
NOW, THEREFORE, the City Council of the City of Dublin does
hereby resolve, declare, determine and order as follows :
Section l .. That pursuant to the requirements of the
laws of the State of California relating to General Law Cities, there
shall be and there is hereby called and ordered, held in the City of
Dublin on Tuesday, April 10 , 1984 , a regular municipal election of the
qualified electors of said City for the purpose of electing five ( 5 ) '
members of the City Council of said City.
Section 2 . That the ballots to be used at said
election shall be, both as to form and matter contained therein, such as
maybe required by law to be used thereat.
Section 3 . That the City Clerk of said City is hereby
authorized, instructed and directed to procure and furnish any and all
official ballots , notices , printed matter and all supplies, equipment
and paraphernalia- that may be necessary in order to properly and
lawfully conduct said election.
Section 4 . That the polls for said election shall be
open at 7 : 00 a.m. of the day of said election and shall remain open
continuously from said time until 8 : 00 p .m. of the same day when said
polls shall be closed except as provided in Section 14301 of the
Elections Code of the State of California.
Section 5 . That in all particulars not recited in
this Resolution, said election shall be held and conducted as provided
by law for holding municipal election in said City.
Section 6 . That notice of the time and place of
holding said election is hereby given and the City Clerk is hereby
authorized and directed to give additional notice of said election, in
time, form and manner as required by law.

A RESOLUTION OF THE CITY COUNCIL

ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE
PERTAINING TO THE CANDIDATE'S STATEMENT
AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION
TO BE HELD IN THE CITY OF DUBLIN ON
TUESDAY, APRIL 10, 1984
WHEREAS , Section 10012 of the Elections Code of the
State of California specifies that before the nomination period
opens, the local agency for that election shall determine whether
a charge shall be levied against the candidate for the Candidate ' s
Statement and whether or not the limitation on words for such
statement shall be increased from 200 to 400 words .
WHEREAS, Section 10012 of the Elections Code of the
State of California further provides that a written statement of
the regulations with respect to charges for handling, packaging
and mailing shall be provided to each candidate or his/her
representative at the time the nomination papers are received.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin does hereby adopt the following regulations
pertaining to the General Municipal Election to be held on
April 10 , 1984 :
Section 1 . Pursuant to Section 10012 of the Elections
Code of the State of California, each candidate for elective
office to be voted for at the General Municipal Election to be
held in the City of Dublin on April 10 , 1984 , may prepare a
candidate ' s statement on an appropriate form provided by the City
Clerk . Such statement may include the name, age and occupation of
the candidate and a brief description no more than words
of the candidate ' s education and qualifications expressed by the
candidate himself or herself . Such statement shall not include
the party affiliation of the candidate nor membership or activity
in partisan political organizations . Such statement shall be
filed in the Office of the Clerk at the time the candidate ' s
nomination papers are filed. Such statement may be withdrawn, but
not changed, during the period for filing nomination papers and
until 5 : 00 p .m. of the next working day after the close of the
nomination period.
Section 2 . Spanish Language . That in compliance with
amendments to the Federal Voting Rights Act of 1965 (Public Law
54-73 , August 6 , 1975 ) , the City Clerk shall provide a Spanish
translation of the candidate ' s statement to be made available to
anyone requesting the translations.
RESOLUTION ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE
PERTAINING TO THE CANDIDATE' S STATEMENT
AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION
TO BE HELD IN THE CITY OF DUBLIN ON
TUESDAY, APRIL 10, 1984

Section 3 . Payment. The City Clerk shall estimate
the total cost of printing, handling, translating and mailing the
candidate ' s statement filed pursuant to the Elections Code, and
require each candidate filing a statement to pay in advance
his/her prorata share as a condition of having his/her statement
included in the voter ' s pamphlet. The City Clerk shall bill each
candidate for any cost in excess of the deposit and shall refund
any unused portion of any deposit.
OR
Section 3 . Payment. No charges shall be levied to
the candidate for the printing, handling, or distribution of the
Candidate ' s Statement.
Section 4 . That the City Clerk shall provide each
candidate or the candidate ' s representative a copy of this
Resolution at the time nominating petitions are issued.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION
TO BE HELD ON TUESDAY, APRIL 17, 1984
TO BE MADE BY THE CITY CLERK
WHEREAS, a regular general municipal election will be
held and conducted in the City of Dublin on Tuesday, April 10,
1984 as required by law; and
WHEREAS, the City Council of said City desires the
canvass of said .election to be made by the City Clerk of said
City.
NOW, THEREFORE, the City Council of the City of Dublin,
California, does hereby resolve, declare, determine and order as
follows :
Section 1 . That pursuant to Section 22932 . 5 of the
Elections Code of the State of California, the canvass of the
regular general municipal election to be held in said City is
hereby ordered to be made by the City Clerk.
Section 2 . That the City Clerk of said City shall,
prior to Tuesday following the election, complete the canvass of
said election and shall certify the results to this City Council
on April 17 , 1984 .
