DESCRIPTION: On September 17 , 1984, the Planning
Commission approved a Conditional Use Permit for Valley Christian
Center to relocate a future administration building from an

approved location to a point approximately 100 feet south of the
existing classrooms . In approving the application, the Planning
Commission found in part, that :
1) The requested change would result in an insignificant visual
difference
2 ) A terraced building stepped with existing land contours,
with landscaping and screening, would not be detrimental
to the ridgeline, and
3 ) The requested change would not be inconsistent with the
preliminary policy decisions in the Draft General Plan
On September 27, 1984 , Councilmember Hegarty appealed the
Planning Commission action so that the City Council could review
the application and make a determination.
The application involves two basic issues :
1) the visual effects of the structure on the ridgeline,
and
2 ) interpretation of preliminary policy decisions in the
Draft General Plan
1 . Visual effects on the ridgeline:
The most critical view of the site would be from vehicles
travelling eastbound on I-580 down the Dublin Grade coming into
the City. CalTrans records show that -in 1983, approximately
40, 000 vehicles per day travelled eastbound. The potential
visual impacts would be greatest from this location.
The applicant' s statement received July 10, 19.84, and the
applicant ' s plans, labelled "Approved office location" and
"Proposed office location" indicate that the visual impact from
I-580 would be the same at either the approved or proposed
location.
After a detailed analysis, Staff finds that at the approved
location, a one story building would not be visible, and a two
story building would only be slightly visible. The top half of a
second floor would appear to be on the ridgeline as seen from
I-580 .
At the proposed location, Staff finds that for either a two or
one story structure, the full side of the building would be
visible from I-580 . The proposed building would appear to sit
right on the ridgeline .
2 . General Plan Policies
The revised Draft General Plan contains preliminary policy
decisions regarding the ridgeline . Guiding Policy 3 . 3 E reads :
"Restrict structures on the hillsides that appear to project
above the major ridgelines . "
Implementing Policy 3 . 3 F reads : "Use subdivision design and site
design review process to preserve or enhance the ridgelines that
form the skyline as viewed from freeways or major arterial
streets . "
The intent of the policies is to keep the natural ridgelines
surrounding the City undisturbed. This will help maintain the
appearance of a City with open hills buffering it from other
communities, as opposed to a City with development coming or
going over the hill tops .

Planning Commission Action
In approving the application, the Planning Commission found that
the visual impacts were not significant, that the building would
be appropriately terraced, landscaped and screened and that the
application would not be inconsistent with the General Plan
policies . The Planning Commission would, therefore, recommend
that the application be approved.
Staff Recommendation
Based on the Staff ' s analysis of the visual impacts of the
application and the Staff ' s reading of the General Plan policies,
Staff recommends that the City Council find that:
1) the requested change would result in a significant visual
difference
2 ) the requested change would result in a structure that
appeared to project over the ridgeline as seen from I-580,
west of San Ramon Road
3 ) in the approved location, a two story building would be only
slightly visible, whereas in the proposed location, a one or
two story building would be highly visible, and
4 ) the requested change would not be consistent with the Draft
General Plan policies which attempt to preserve and enhance
the ridgelines .
Considering the draft findings, Staff recommends that the City
Council adopt a resolution denying the application (Attachment
1) .
Should the City Council decide to approve the application, Staff
recommends that the City Council adopt a resolution making the
necessary findings and approving the application (Attachment 2 ) .

WHEREAS, Valley Christian Center filed an application
for a Conditional Use Permit to relocate the future Administration
building to a point approximately 100 feet south of the Phase II
classrooms; and
WHEREAS, the Planning Commission did hold public
hearings on said application on 9/4/84 and 9/17/84 and approved
the application; and
WHEREAS, Councilmember Peter J. Hegarty filed an appeal
of the Planning Commission ' s action approving the application; and
WHEREAS, the City Council did hold a public hearing on
said appeal on October 22 , 1984 ; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application is categorically exempt in
accordance with the provisions of the California Environmental
Quality Act; and
WHEREAS, a Staff Report was submitted recommending the
application be denied; and
WHEREAS, the City Council did hear and consider all
said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City
Council does hereby find that :
1 ) The requested change would result in a

between the approved location and the proposed
location.
2 ) The requested change would result in a structure
that projects over the ridgeline along I-580
west of San Ramon Road.
3 ) In the approved location, a one story building

building would be highly visible .

labeled Exhibit "B" on file in the Dublin Planning Department and
subject to the following conditions :

the visual impacts and to enhance the esthetics of the proposed
project . The measures to minimize the impacts and enhance the
esthetics shall include, but not be limited to, the following:
a) Limited grading and contour grading
b) Use of abundant landscaping, with a
mixture of 15 gallon and 24" box specimen
trees, to present a natural appearance
c ) Control of lighting visible from off site
d) Architectural treatment to reflect the site
and blend with it as much as possible
e) Screening and landscaping of parking areas
f) Consideration of building below grade
g) Consideration of patio landscaping on
roof tops
2 ) This approval shall expire if substantial construction
in compliance with an approved Site Development Review and
Building Permit has not begun before October 22, 1986 .

FINANCIAL STATEMENT: None
DESCRIPTION: On September 4, 1984 the Planning _..
Commission made a motion to approve the Planning Application .;.;,
after Staff brought back a Resolution with necessary findings.
The Planning Commission continued the item until the September
17 , 1984 meeting, so that Staff could draft findings to support
the approval of the application. The attached Resolution,::".. :
contains a series of draft findings and conditions of approval.
Should the Planning Commission still desire to approve the
application, Staff would recommend adopting the attached
Resolution approving the application.

Section 8-94 .0 states that conditional uses must be analyzed
to determine : .1) whether or not the use is required by the public
need; 2 ) whether or not the use will be properly related to other
land uses, transportation and service facilities in the vicinity;
3 ) whether or not the use will materially affect the health or
safety of persons residing or working in the vicinity; and 4 )
whether or not the use will be contrary to the specific intent
clauses or peformance standards established for the district in
which it is located.
Section 8-94 .4 states the approval of a Conditional Use
Permit may be valid only for a specified term, and may be made •.
contingent upon the acceptance and observance of specified
conditions .

ANALYSIS: _
The principal issue associated with this application relates
to the visual impact from I-580 . The Draft General Plan ;.
with preliminary policy decisions by the City Council ;,; ::> .:
contains a Guiding Policy which states:
"Restrict structures on the hillsides that appear .. .. ..
to project above major ridgelines. "
The Implementing Policy is : "Use the Site
Development Review process to preserve or enhance the
ridgelines that form the skyline as viewed from
freeways or major arterial streets" . i
Although the applicant ' s exhibits appear to indicate that
there will be no measurable difference from a visual
standpoint between the approved and proposed locations,_
staff has found that the change would be significant. After
conducting a detailed analysis, including site visits, . ,_
photographs, and sight profiles of the existing and proposed
locations, it is Staff ' s conclusion that a one story -
building in the approved location would not be visible at
all and a two story building would only be slightly visible,
whereas a one or two story building in the proposed location
would be highly visible . The critical views of the site -.. .
would be from cars travelling eastbound on I-580 from Castro
Valley to Dublin. From this area along I-580, the proposed
building would be highly visible and appear to project above
the ridgeline .
Staff could support an application if the "visual difference
between the approved location and the proposed location was
relatively minor . However, in this case the requested
change would result in a significant increase in visibility
from I-580 and would appear to project above the ridgeline .
Since this proposal would not be consistent with the
proposed General Plan, Staff cannot recommend approval .
Staff will bring exhibits to the meeting for Planning
Commission review.

RECOMMENDATION

ACTION: Staff recommends that the Planning Commission adopt the
attached Resolution (Exhibit "A" ) which denies Valley
Christian Center ' s request for a Conditional Use Permit
to relocate the future Administration building.

Mr. Tannenberg stated that the terms "major ridgeline" and
"preserve or enhance" were subjective terms, and that the
existing buildings already project above the skyline.
Gilbert Zaballos , with the Valley Christian Center Building
Committee, also stated that at the approved location, the Church
must have a two story building. At the proposed location, a
terraced building with sloping roofs would conform to the natural
terrain and would be more attractive than a two story building in
the approved location. -

he did not think it would adversely impact the view or the .

In response to, a question from Commissioner Petty, Mr. Tannenberg
stated that if the application were denied, the Church would
place the building in the approved location and parking in the
proposed location.
Commissioner Raley made a motion to deny the request, however the
motion died for lack of a second.
Commissioner Mack made a motion to approve PA 84-041 Valley
Christian Center ' s Conditional Use Permit to relocate the
future Administration building to a point approximately 100 feet
south of the Phase II classrooms, after Staff has brought back a
Resolution with the necessary findings . Commissioner Barnes
seconded the motion.

Voice vote found all in favor with the exception of Commissioner
Raley .
The Planning Commission provided Staff with certain specific
language suggestions for the findings, including an insignificant
visual difference, eliminating the draft finding that the
structure projects over the ridgeline, that a split level
building stepped with the existing land contours will not be
detrimental, and that the project would not be inconsistent with
the General Plan.
The Commission ,directed Staff to,-bring .back a Resolution ;.
approving the request,`"with 'the appropriate findings,' at the

SUBJECT: PA 84-047 Crown Books Conditional Use Permit
at :7900 Dublin Boulevard
Mr. DeLuca presented the Staff Report .which was a request by
Crown Books fora Conditional Use Permit .to operate a bookstore
at 7900 Dublin -Boulevard.
Mr. DeLuca noted that the intent of the Conditional Use Permit
requirement was to regulate and control 'the .establishment of
adult book stores . Staff did not have any problems with Crown
Books since it cannot be classified as an adult book store .
Chairman Alexander opened the public hearing.
Mark Blancarte, 'property owner, addressed the Planning Commission
and stated that he agreed with the Staff recommendation.
Commissioner Petty, with a second by Commissioner Barnes, moved
to close the public hearing . -

Both Commissioners Mack and Raley *indicated their possible
concern in case Crown Books decided to carry sexually explicit
material . Staff noted that if this was the case, there would be
a good possibility that the Use Permit could be revoked.
It was moved by Commissioner Raley and seconded by Commissioner
Barnes to approve Crown Books Conditional Use Permit at 7900
Dublin Boulevard.

A regular meeting of the City of Dublin Planning Commission was
held on September 17 , 1984 , in the Meeting Room, Dublin Library.
The meeting was called to order at 7 : 30 p .m. by Cm. Alexander,
Chairman.

Mr. Tong briefly went over the State Office of Planning and
Research Letter which granted the City of Dublin an extension for
the adoption of the General Plan.
PUBLIC HEARING
SUBJECT: PA 84-041 Valley Christian Center, Conditional Use
Permit to relocate the future Administration Building
Mr. Tong presented the Staff Report which was a request by Valley
Christian Center for a Conditional Use Permit to relocate the
proposed Administration Building to a point approximately 100 '
south of the Phase II classrooms .

Mr. Tong noted that the Planning Commission had continued this
item from the September 4th meeting so that Staff could draft a
series of findings to support the approval of the application.
Mr. Tong stated that the resolution attached to the Staff Report
contained a series of draft findings and conditions of approval.
Mr. Tong further noted that should the Planning Commission
desire to approve the application, Staff would recommend the
resolution be adopted.
Commissioner Raley .stated his previous concern; that is, that the ;
request would be .in consistent with the preliminary policy'
decisions in the Draft General Plan, 'and would be detrimental'to
the future General Plan.
Chairman Alex ander `stated that the'.issuelof building on the
ridgelines needs to be handled on a case by case basis; however,
he did feel it would be appropriate if the Council gave the
Commission a definition with respect to what constitutes a major
ridgeline.
Commissioner Raley noted that he would like to see the Planning
Commission discuss implementing policies for the overall guiding ;__.
policy to preserve the ridgelines .
Commissioner Petty made a motion to approve PA 84-041, Valley
Christian Center's request for a Conditional Use Permit, which
was seconded by Comm issioner Mack.
At this time, Ward Tanneberg, Pastor of Valley Christian Center, .
stated that he had concerns with Condition #1 b, f, g and #2 _in
the draft resolution. These items related to landscaping, ^
consideration of building below grade, consideration of patio
landscaping on roof tops and the expiration date of the _
Conditional Use Permit.
At this time Commissioner Petty withdrew his motion, seconded by
Commissioner Mack.
Mr. Tanneberg also asked why this relocation was being handled by
a Conditional Use Permit, whereas a previous relocation has been
handled by Staff at a Site Development Review process.
Mr. Tong stated that the conditions in the resolution were in an
attempt to minimize the visual impact of the proposed office
building as seen from I-580 . Mr. Tong also noted that this
application is being processed as a Conditional Use Permit
because there were policy questions involved which the Commission
should vote on. The previous adjustments in the overall site
plan did not involve policy issues .

Commissioner Petty made another motion to approve PA 84-041, with
a change to Condition 2 of the resolution to read; "This approval
shall be contingent upon approval of a Site Development Review
and the issuance of a building permit by September 17 , 1986" and
the title changed to Approving. It was seconded by Commissioner
Mack.
Commissioner Petty said that the term "substantial construction"
was very ambiguous . Commissioner Alexander clarified the
conditions for the applicant.
Voice vote found Mack and Petty in favor, and Alexander and Raley
opposed. _
Commissioner Alexander stated that he would vote for .the motion K
if the original wording in Condition #2 was left the "same but'; .
simply changing 1985 to 1986 .
It was again moved by Commissioner Petty and seconded by
Commissioner Mack to approve PA 84-041 with the following two
changes : 1) Under item #2 , in the draft Resolution, change the
date from 1985 to 1986 2 ) Change the title of the Resolution 'from
recommending approval to Approving. _ .
Voice vote found all in favor except Commissioner Raley.
RESOLUTION 84-46 -
APPROVING OF PA 84-041, VALLEY CHRISTIAN CENTER'S REQUEST
FOR A CONDITIONAL USE PERMIT TO RELOCATE THE FUTURE
ADMINISTRATION BUILDING TO A POINT APPROXIMATELY
100 FEET SOUTH OF THE PHASE II CLASSROOMS
SUBJECT: PA 84-046 Payless, Conditional Use Permit and Site
Development Review, for an outdoor display area at..- ,
7201 Regional Street
Mr. DeLuca gave the Staff Report, noting that the application had
been continued from the 9/4/84 meeting so that more precise .
exhibits could be prepared, particularly relating to the canopy
improvements . The revised plans indicate that the existing
canopy in front of the main entrance extends far enough out to
cover the proposed new sidewalk, consequently no modificiations
to the canopy in front of the main entrance are proposed. The
canopy in front of the proposed garden display area will be
extended as originally shown to cover the new sidewalk.
Mr. DeLuca noted that the attached resolution had been changed to
reflect the modifications desired by the Planning Commission at
the previous meeting.
Chairman Alexander opened the public hearing.
Andrew Anderson, representing Payless , addressed the Commission
and stated that he had no objections to the conditions with the
exception of Condition #2 landscaping, and Condition #3 signage .
