HomeMy WebLinkAboutItem 4.01 Approve 12-10-1984 Minutes (2) REGULAR MEETING - DECEMBER 10, 1984 A regular meeting of the City Council of the City of Dublin was held on Monday , December 10 , 1984 in the meeting room of the Dublin Library. The meeting was called to order at 7: 35 p.m. by Mayor Peter Snyder. ROLL CALL r PRESENT: Councilmembers Hegarty, Jeffery , Moffatt , Vonheeder and Mayor Snyder. PLEDGE OF ALLEGIANCE The Mayor led the Council , Staff and those present in the pledge of alleg- iance to the flag. STOLEN FLAGS Mayor Snyder reported that the United States Flag and the California Flag, donated to the City at the time of its incorporation, had been stolen from the Library the previous week. CONSENT CALENDAR On motion of Cm. Hegarty , seconded by Cm. Vonheeder, and by unanimous vote , the following were approved : Minutes of Regular Meeting of November 26, 1984; Award of Bid for Acoustical Screens to Inner Living Business Furniture & Design; Authorized the scope of work for a school safety/crossing guard study , authorized the Traffic Engineer to proceed with the study , and authorized a $4, 000 budget transfer from the Contingent Reserve ; Adopted RESOLUTION NO. 126 - 84 ACCEPTANCE OF PARCEL MAP NO . 4008 AND EASEMENT DEED Authorized Staff to advertise Contract 84-9 (Village Parkway Sidewalk & Landscaping - West Side of Street ) for bid ; Directed Staff to continue working with Zone 7 in preparing the Arroyo Management Plan; Authorized Staff to advertise Contract 84-11 (Traffic Signals (3 ) , Downtown Street Light Additions and Street Tree Program) for bid ; Approved Financial Report for Period Ending September 30 , 1984 ; and Approved Financial Report for Fiscal Year Ending June 30, 1984. On motion of Cm. Hegarty , seconded by Cm. Jeffery , and by unanimous vote . the Council approved a revised 6varr•ant Register in the amount of $202 ,948 . 74. y CM-3-258 �` �` December 10, 1984 WRITTEN CONIMUNICATIOIN FROM DUBLIN CHAMBER OF COI'-1MERCE REGARDING CITY PARTICIPATION IN CHAMBER MAP Cm. Vonheeder removed herself from discussion and/or vote on this issue as she is a member of the Board of Directors of the Chamber of Commerce . The City has received an invitation from the Dublin Chamber of Commerce to purchase space on the new 1985-86 Chamber of Commerce Map. Specifically, the Chamber has inquired as to whether the City would be interested in purchasing the back panel of their map. Staff met with the Chamber' s Executive Director to discuss various options of participation: 1) The City could purchase the entire back panel of the map and use it for any purpose it chose . The cost to the City would be $850. 2 ) Since the Chamber has historically included an "IMPORTANT PHONE NUMBERS" listing, the City might elect to include these numbers as part of a City Service Directory on the back panel . These numbers would take up approximately one-half the space . Therefore , the cost to the City would be $425 . Cm. Moffatt felt the City should support the Chamber and the amount being discussed was insignificant . Cm. Jeffery felt the Chamber' s main purpose is to promote Dublin. Cm. Jeffery stated she would rather see the money directed to a City newsletter or on beautifying the business community, rather than purchasing space on the map. Cm. Hegarty felt the City and Chamber should have close ties and depend upon each other , and felt the City should support the Chamber' s efforts with the map . On motion of Cm. Hegarty , seconded by Cm. Moffatt , and by majority vote , the Council agreed to the concept of a service directory format and for the City to utilize approximately one-half of the space on the back at a cost of $425 • Voting NO on this motion was Cm. Jeffery. Cm. Vonheeder abstained . REGIONAL FIRE PROTECTION STUDY At its meeting of October 22 , 1984 , the City Council agreed to the concept of equal financial participation in a Regional Fire Protection Study. At that time , it was anticipated that six (e ) agencies would participate in the study . Those agencies were : Dublin , Danville , San Ramon, Dublin San Ramon Services District , Tassajara Fire Protection District and the San Ramon Valley Fire Protection District . Since that meeting , the City of Danville has indicated it does not wish to participate in the study . The San Ramon Valley Fire Protection District has indicated it will only participate in a study for San Ramon and its sphere of influence . The Dublin San Ramon Services District agreed to pay for the participation of itself and tine Tassajara Fire Protection District . CN1-3-259 Regular Meeting December 10, 1984 At its i�ieeting of November 27 , 1984 , the San -anon City Council acted to proceed on its own with a fire study for only the San Ramon area , because an agreement had not been reached with the other governmental agencies . Cup . Jeffery felt this was an issue in which Dublin certainly should be involved , but that the issue was deeper than just fire protection . Can . Jeffery suggested that this might be a good time to suggest expanding this study to include all services being provided by DSRSD . r Qualifications of the consultant to perform the Fire Services Study for the City of San Ramon , Angus McDonald , were discussed . On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote , the Council directed Staff to notify San Ramon once again of Dublin ' s interest in financially participating in the fire study immediately, and further , that Dublin would like tc; proceed 4r-ith a study of all other services in the near future . PUBLIC HEARING DUBLIN BOULEVARD UNDERGROUND UTILITY DISTRICT NO. 1 Mayor Snyder opened the public hearing . At its meeting of Nove;nber 26 , 1984 , the City Council agreed in concept to contributing City funds to the Uublin Boulevard Underground Utility District No . 1 and authorized Staff to contact PG&E regarding the City ' s position . The Staff has been in contact with PG&E officials who confirmed that PG&E_ has approved this project . PG&E would advance the City $395 ,000 in Rule 20A funds for this underground utility project on Dublin Boulevard from San Ramon Road to I-620 . These Rule 20A funds would represent an advance of funds using the City ' s allocation 'through 1994 . The cost to the City has been estimated at $300 , 000 but could vary with the cost of the project ( $ 195 , 000-$405 , 000 ) . PG&E representatives have indicated that the construction of this project could begin as early as June 1985 . Mayor Snyder closed the public hearing . John Alexander , 7318 Kolb Place , stated he felt underground projects help to beautify a community and was very pleased that Dublin was proceeding with this undergrounding project . Ci;i. Hegarty had questions related to the 4 private parcels . City Engineer Lee Thompson explained the process and timing in which the private parcal owners had to prepare and the legal rar,iifications for non-coinpllance . On Motion of C.-;i . Jeffery, seconded by Crt . Vonheeder , and by unanimous voce , the Council adopted Cd-3-260 Regular Meeting December 10 , 1984 RESOLUTION NO. 127 - 84 DESIGNATING AN AREA FOR THE UNDERGROUND INSTALLATION OF UTILITIES AND ORDERING THE REfiOVAL OF ABOVEGROUND UTILITIES IN AN AREA DESIGNATED AS THE DUBLIN BOULEVARD UNDERGROUND UTILITY DISTRICT NUiIBER 1 and authorized an additional appropriation of $405 ,000 from the Street Improvement Reserve . BARRATT ( HIGGINS ) SITE DEVELOPPIENT REVIEW At the time the City Council approved the Planned Development Rezoning covering this site , the Council directed Staff to bring the Site Development Review material before the Council for review and approval . On March 12 , 1984 , the City Council adopted a resolution approving the Planned Development Rezoning and specific concerns were expressed regarding 1 ) the architectural treatiiient and site plan details to meet the conditions iraposed by the Planned Development Rezoning ; 2 ) the sound wall along San Ramon Road ; and 3 ) the fence along Silvergate Drive . Architectural Treatment and Site Plan Details : With the following minor revisions , the architectural treatment and site plan details of the project are in co�impliance with the Planned Development Rezoning conditions : - open fence along Martin Canyon Creek ; the applicant has proposed an open wire mesh and wooden fence ; the fence should be vinyl clad chain link to provide a durable , attractive fence that allow for view of the creek . Staff indicated that the applicant has concurred with Staff ' s recommendation . - siding material ; the applicant has proposed raasonite siding ; the siding material should be T- 1 - 11 type plywood or equivalent to be more attractive and more durable than masonite or composition board . - par course stations ; the applicant has proposed two par course stations ; three par course stations should be provided along the project ' s San Ramon Road frontage adjacent to the bike path . The City could then consider adding supplemental par course stations to the north along San Ramon Road . Staff indicated that the applicant has concurred with Staff ' s recommendations and will provide three par courses . The remainder of the architectural treatment and site plan details , such as the wood shake roofing , wood trim, swimming pool , and substantial landscaping , are in compliance with the Planned Developi,�ent Rezoning . Soundwall : The applicant has proposed a textured masonry wall with support columns with caps . The "architecturally designed masonry sound gall " required along San Rai= koad can range from a precast concrete wall with a CPS-3-205 1 Regular Meeting December 10 , 1934 stucco finish to a "flagstone" type masonry wall with individual pieces of rock embedded in the concrete . The flagstone wall is considered to be more attractive , but it is also more expensive than the stucco finished wall . Since the site is located at the entrances to the Downtown/San Ramon Road Specific Plan area , and the Silver-gate neighborhood , Staff felt it reasonable to require the flagstone wall . Fence along Silvergate Drive : The applicant has proposed a wooden fence primarily composed of 1" x S" fence /boards . Light weight fences built along major street fronts have quickly deteriorated and become eyesores. A fence constructed of "2x" or heavier lumber would be sturdy, durable and attractive. Such a fence should be required along the Silvergate Drive frontage of the project . Joe Higgins addressed the Council , and stated that with regard to the fence along the creek, they were suggesting this be a buyer option. He felt that a majority of people will want the privacy that a wood fence provides , rather than to have a view of Martin Canyon Creek. lair. Higgins stated he felt a chain link fence along the creek would make the units very difficult to sell . Mr. Higgins stated he is suggesting using a new siding material that actually costs 50% more than the T-1-11 type plywood or equivalent that Staff was suggesting. The material they wished to use is not only more expensive , but retains paint better and is more durable and more attractive . It is not like the old composition board that was used several years ago . Mr. Higgins stated he wanted this to be a top quality project . Cm. Jeffery stated she was a little uncomfortable because this material has not been out longer and was concerned with what it would look like in 10 or 15 years . Discussion was held regarding utilization of a flagstone wall along Silvergate Drive rather than the wood fence . The flagstone would match that used on San Ramon Road . Stan Harrup stated he felt that the flagstone wall would look good , but urged the developer to take a very good look at putting this type of fence on an earthquake fault . On motion of Cm. Hegarty , seconded by Cm. Vonheeder, and by unanimous vote , the Council agreed that a flagstone wall should be used on Silvergate Drive as well as San Ramon Road ; that a high quality heavy timber wood fence should be used along the creek units ; that statements and specifications collab- orating the superiority of the siding product that Mr. Higgins wished to use be obtained from architects and the State Real Estate Board in Sacramento and submitted to the Planning Director for review and approval ; and adopted RESOLUTION NO. 128 - 84 APPROVING SITE DEVELOPMENT REVIEW PA 64-075 BARRATT (HIGGINS ) Ci�i-3-2b2 Regular [Meeting December 10, 1984 APPROVAL OF FINAL MAP - TRACT 5131 - BARRATT (JMH , INC . ) This subdivision is located on the southwest corner of San Ramon Road and Silvergate Drive , and has been previously referred to as the "Barratt Development" . It is now being purchased and to be developed by JMH , Inc . The Final Map for Tract 5131 has been reviewed and found to be in conformance with the Tentative Map and conditions approved by the City Council on February 6, 19$4 by Resolution No . 27-$4. The improvements and grading plans have been reviewed for conformance to the Final Map. A subdivision agreement and bonds have been submitted and/or placed in escrow guaranteeing the construction of improvements within the subject tract . Fees for inspection, a portion of the San Ramon Road traffic signal and in-lieu parkland are in escrow to be released simultaneously with Final Map recordation. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote , the Council adopted RESOLUTION N0. 129 - $4 ACCEPTANCE OF FINAL MAP TRACT NO. 5131 and RESOLUTION NO. 130 - $4 ACCEPT ESCROW ACCOUNT IN LIEU FEE TRACT 5131 OTHER BUSINESS The Saw Mill City Manager Ambrose and City Attorney Nave gave a status report on The Saw Mill . City Staff has had several conversations with the owner regarding the need for certain improvements in the building related to fire safety. The Saw Mill has made the improvements and they are now open for business . The Saw Mill has been told to remove the large sign but thus far, they have not complied. City Staff reviewed legal actions that could be taken. Dublin' s code provides several remedies : 1) site as misdemeanor, with a $500 fine and/or 6 months in jail . Each day is considered a separate offense . City Attorney Nave stated that this type of a case would not be a high priority for prosecution by the District Attorney. 2) Since this sign is considered to be a nuisance , Dublin could abate this nuisance by civil action. Dublin can seek preliminary and final injunctions . The Saw Mill feels that Dublin' s ordinances are unconstitutional . The City Attorney cited a Pleasant Hill case involving The Saw Mill . The Saw Mill had received a favorable ruling, but Dublin' s case is not involved with the aesthetics of their signs , but rather size . City Attorney Nave stated he is studying other cases in order to determine Dublin' s relative strength. CM-3-263 Regular Meeting December 10, 1984 Dublin Boulevard Traffic Study & Plan Line Mr . John Vitalle , owner of Revel le ldaterbeds , apologized for arriving at the meeting late , and asked to be heard on an item that the Council had heard earlier in the evening related to closing off left turns into his business in the Dublin Station Center . idr . Vitalle stated he was not notified until the previous Friday. Mayor Snyder explained that the Council had conducted numerous public hearings relating to the ultir►ate configuration of Dublin Boulevard and the subject had been before the Council several times . Earlier in this meeting , Council authorized Staff to proceed with advertising for bids . Mr . Vitalle was opposed to closing off the median break in front of his business and forcing potential custor►ers to enter thru the rear of the center from Dublin Court , or making a u-turn . Mr . Vitalle suggested leaving the opening after the signal at Dublin Court is put in , to see if it is workable . The District Manager from Standard Brands Paint Company also addressed the Council and stated that 2/3 of his business is from Livermore and Pleasanton and they need the left turn access into their business . Since their access is already limited , he suggested leaving the opening for 3 months after signalization to see if it is possible . City Engineer Lee Thompson suggested that changes could be accomplished by adding an addenduiii to the contract . City ;lianager A►►ibrose stated he would have the City ' s Traffic Engineer contact both of the gentlemen to discuss their request . ADJOURN,',IEigT There being no further business to come before the Council , the meeting was adjourned at 9 : 28 p . m . The regular meeting scheduled for December 24 , 1984 was cancelled , so therefore , the r,�eeting was adjourned to January 14 , 1935 .
