The maximum cost of acquisition based on land cost at 25% of the fair market value is $31 , 350. The difference of $23 ,697 would be made by a local match of Park Dedication In Lieu Fees . DESCRIPTION The June 1984 State Election included a ballot measure which approved the issuance of Park Development Bonds . The program included funding for the Roberti-Z ' berg Urban Open Space and Recreation Program. This program is designed to provide funding for park improvements in urban areas . The local agency is required to contribute a matching contribution of at least 25%. The block grants are disbursed based on population. The City of Dublin 1984-85 allocation is $7 ,653 . Staff has reviewed the grant process and attempted to identify potential projects . The funds cannot be utilized for improvements to property which the agency does not hold fee title , or a long term lease . Funds can be utilized for acquisition projects . The grant application requires that the City be fairly explicit as to the site to be purchased . The program requires that the funds awarded be expended within three years. Given these criteria, Staff has determined that the most appropriate project would be the acquisition of the Kolb Park Tennis Courts . At the regular Council meeting on August 27 , 1984, Staff presented an item outlining the proposed purchase of the tennis courts at Kolb Park. The intent was to proceed with this acquisition to allow the developer of ,Amador Lakes to make the required improvements at Kolb Park. Some of the preliminary information such as the acquisition map will be useful for this application. The State requires that the application be filed by May 1 , 1985 . The Dublin General Plan designates a three to five acre neighborhood park at the Fallon School site . The submittal of the application would not restrict the City from acquiring a site larger than the one designated on the acquisition site map. However, until the Murray School District advises the City as to the precise area for sale , an acquisition site plan for the entire parcel cannot be developed . It is anticipated that the final configuration will preserve the existing tennis courts and therefore it is appropriate to consider their acquisition as a foreseeable project . When the City Council discussed the Kolb Park acquisition, Staff was directed to inform the Murray School Board of the City' s interest in purchasing five acres of the Fallon School site . The School Board responded that they were evaluating their options to utilize their property throughout the District and that a property sale at that time would v be offered . The Park & Recreation Commission considered the lease option at their regular meeting on November 13 , 1984. The Commission advised that the City decline the lease offer and await a response to the proposal to purchase the entire five acres . The application for the grant would be consistent with previous actions taken by the City Council and the Park & Recreation Commission. Also, it will protect the City from losing its 1984-$5 allocation. An equal allocation is anticipated for 1985-$6 and will require a separate application. It is recommended that the City Council adopt the resolution approving the application for grant funds and direct Staff to file the appropriate materials . A tentative joint meeting has been scheduled for May 30, 19$5 with the City Council and the Murray School Board. At this meeting, a more precise timeline for the acquisition may be developed. RESOLUTION NO . - $5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE ROBERTI-Z' BERG URBAN OPEN SPACE AND RECREATION PROGRAM FOR KOLB PARK TENNIS COURTS ACQUISITION WHEREAS , the legislature of the State of California has enacted the Roberti-Z ' berg Urban Open Space and Recreation Program, which provides funds to certain political subdivisions of the State of California for acquiring lands and for developing facilities to meet urban recreation needs ; and WHEREAS , the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program, setting up necessary procedures governing application by local agencies under the program; and WHEREAS , said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications prior to submission of said applications to the state ; and WHEREAS , said applications contain a certification that the applicant will comply with all federal , state and local environmental , public health, relocation, affirmative action, and clearinghouse requirements and all other appropriate codes, laws and regulations prior to the expenditure of the grant funds ; and WHEREAS , the project applied for under this program must be of a high priority and satisfy the most urgent park and recreation needs with emphasis on unmet needs in the most heavily populated areas . NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council hereby ; 1 . Approves the filing of an application for funding under the Roberti- Z ' berg Urban Open Space and Recreation Program; and 2 . Certifies that said agency understands the general provisions of the agreement ; and 3 . Certifies that said agency has or will have sufficient funds to operate and maintain the project funded under this program; and 4. Certifies that said agency has or will have available prior to commencement of any work on the project included in this application matching money from a nonstate source ; and 5 . certifies that the project included in this application conform to the recreation element of any applicable city general plan; and 6 . Appoints the City Manager as agent of the City to conduct all negotiations , execute and .Lubmit all documents including but not limited to applications , agreements , amendments, payment requests , and so on which may be necessary for the completion of the aforementioned project ; and 7. The City of Dublin in accordance with Education Code Section 39397 . 5 (Naylor Bill ) has prepared a plan for the purchase of a portion of the designated surplus property. The adopted City of Dublin General Plan identifies a three to five acre neighborhood park at the Fallon site . The City of Dublin recognizes the value of the improvements on the Kolb Park site which consists of two tennis courts . Therefore , it is proposed that the City shall acquire a parcel which is approximately + 3$ ,000 square feet . This shall consist of the tennis courts and an area immediately north of the location as shown on the sketch of the proposed acquisition. The site is located in an urbanized residential subdivision. The project faces Brighton Drive , which is a recognized collector street and provides public access . The School District has declared the property as surplus and the City desires to preserve the recreational opportunities offered by the subject site . Exemption Findings : The above described project has been reviewed to determine the necessity of an Environmental Impact Report or Negative Declaration, as required by CEQA. Sections 15301 and 15312 allow for categorical exemptions from CEQA and both are relevant to the proposed project . Support of Declaration of Exemption: Section 15301 provides for an exemption when the operation of public facilities involving negligible or no further expansion of use beyond what is existing, is the primary focus . The recreational facilities are currently owned by the School District and the City would not implement changes in the type of use of the property. Section 15312 declares that the sale of surplus government property is categorically exempt . This project involves the sale of School District (i.. e . government ) property. ACQUISITION SCHEDULE KOLB PARK TENNIS COURTS Location: Kolb Park Tennis Courts A portion of the northeast quadrant of the Fallon School property owned by the Murray School District . Parcel Number : A portion of Assessors Parcel Number 941-181-27-1 as identified in the acquisition map. Parcel Size : Approximately 38 , 000 square feet . Approximate Date of Acquisition: October 1, 1985 Approximate Cost of Acquisition: The estimated market value of the property is $57 , 000 - $87,400. However, the City of Dublin is qualified under Education Code Section 39397. 5 to purchase the property at 25% of fair market value . Therefore , the anticipated cost would be $14, 250 - $21 , 850 . This cost only includes the purchase price of the property.
