DESCRIPTION: Tom Huening is applying for a Planned
Development (PD) Rezoning and Site Development Review to
construct a 4,485 sq. ft. building on the abandoned DSRSD well
site located on the north side of Dublin Boulevard south of
Sierra Court. An integral part of the application includes the

From a practical standpoint, the site is -so small (6,720 sq. ft.)
that future construction needed to be incorporated into an
adj acent development. In this case, the new construction is to
be incorporated into the existing commercial project to the east.
Both parcels will share a common driveway and parking area and
the design of the new structure is intended to match the existing
structure as much as possible.
The principal concern of staff relates to the design of the west
elevation. This elevation will be the most visible to the public
and yet is the back side of the building. The existing M-l,
Light Industrial District requires 10 foot sideyard setbacks and
a 20 foot rear yard setback. Staff has suggested to the
applicants that the building be setback 5' from the property line
and landscaping be installed to soften the appearance of the
wall.
The applicants maintain that the site is so small they need to
maximize their building coverage. Through the PO Rezoning
process, the applicants are proposing zero sideyard and rear yard
setbacks. This allows approximately 1,860 square feet of
building area that otherwise would not be permitted. The
applicants have agreed to provide architectural treatment along
the west elevation to create some visual interest.
Staff believes the proposed project will result in a substantial
improvement to the site and eliminate an eyesore on Dublin
Boulevard. Final design details for landscaping, trash
enclosures, architectural treatment and easements will be
resolved between Staff and the applicants after the PO Rezoning
and Site Development Review are approved.
The Planning Commission heard this application at a public
hearing on 4/15/85. At the meeting, Mr. Kent, an adjacent
property owner, submitted a letter expressing concerns with
respect to parking. (See Attachment 3). In response to this
letter, the Planning Commission required that, as part of the
Zoning Approval process, a parking and site plan analysis be
conducted prior to each tenant moving into the building to ensure
there was adequate parking.

WHEREAS, Tom Huening filed an application for a PO and
Site Development Review to construct a 4,485 sq. ft. building on
the abandoned DSRSD property on the north side of Dublin
Boulevard, south of Sierra Court; and
WHEREAS, the commercial site located immediately to the
east is to be rezoned from a PO with M-l and C-2 uses to a PO with
C-2 uses as part of this application; and
WHEREAS, an Initial Study was completed which indicated
that the proposed project will not have a significant effect on
the environment; and
WHEREAS, a Negative Declaration has been prepared for
this application in accordance with CEQA; and
WHEREAS, the Planning Commission held a public hearing
on this application on 4/15/85 and recommended a Negative
Declaration be adopted; and
WHEREAS, the City Council held a public hearing on this
application on 5/13/85; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, a Staff Report was submitted recommending the
Negative Declaration is in compliance with CEQA
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City
Council does hereby adopt a Negative Declaration for this /
application.

FINDINGS AND GENERAL PROVISIONS
REZONING CONCERNING PA 85-020,
COMMERCIAL DEVELOPMENT
FOR A
WHEREAS, Tom Huening filed an application for a PO
RRezoning on two parcels (APN 941-205-4-2, 6,720 sq. ft. and APN
941-205-1-21, 1.5 acres) located on the north side of Dublin
Boulevard south of Sierra Court; and
WHEREAS, the existing commercial site located
immediately to the east is to be rezoned from a PD with C-2 - M-l
uses to a PO with C-2 uses as part of this application; and
WHEREAS, a Negative Declaration has been prepared for
this application; and
WHEREAS, the Planning Commission did hold a public
hearing on said applications on April 15, 1985 and recommended
approval; and
WHEREAS, the City Council did hold a public hearing on
said applications on 5/13/85; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, a Staff Report was submitted recommending that
the applications be conditionally approved; and
WHEREAS, the City Council did hear and consider all
said reports, recommendations, and testimony as herein set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City
Council does hereby find that:
1) The PD is consistent with the policies of the Dublin General
Plan
2) The PD will not have a sign~ficant effect on the environment
3) The PD is appropriate for the subject property in terms of
being compatible to existing land uses in the area, will be
visually attractive, and will not overburden public services.
BE IT FURTHER RESOLVED that the Dublin City Council does
hereby approve the PD subject to the following conditions:
1) Development on the site shall be consistent with materials
labeled Exhibit "A" on file in the Dublin Planning
Department titled Dublin Business Center II, Huening
Investment Corporation by Burns/Nettle, sheets land 2, dated
4/1/85, and as amended by these provisions.
2) The conditions imposed on the SDR are incorporated by
reference into the PD.
3) Any changes or modifications of these plans shall be
processed according to Section 8-31.18 of the Zoning
Ordinance.
4) Approval of this Planned Development is subject to review at
the expiration of two (2) years from the effective date of
the PO as is specified in Section 8-31.2(by/of the Zoning
Ordinance.

7) The previous PD is hereby rescinded and replaced with this
PD.

The City Council of the City of Dublin does ordain as follows:
SECTION 1. Chapter 2 of Title 8 of the Dublin Ordinance Code is
hereby amended in the following manner:
Two parcels are affected by this rezoning: Parcel 1: APN 941-
205-4-2 to be rezoned from M-l to a PO with C-2 uses; Parcel 2:
APN 941-205-1-21 to be rezoned from a PO with M-l and C-2 uses to
a PO with C-2 uses. A map depicting the two parcels is listed
below. The findings, conditions, and General Provisions
contained in Exhibits A (Negative Declaration), Exhibit B (PO)
Exhibit C (SDR) and Exhibit D (Plans) for PA 85-020 are hereby
adopted as the regulations for the use, improvements, and
maintenance of property within this District.

Unless otherwlse speclfled, all conditions shall be complied with
prior to release of building permits and shall be subject to the
review and approval of the Planning Department.

The subject project is directly t~ the west of the Dublin
Business Center (6767 Dubl in Boulevard) and is owned by the same
party. The new structure will be a retail building with one or
two tenants. This appl ¡cation pertains only to the shell building;
the interior wi1 1 be left unFinished in order to provide design
options for future tenants. Gross area is 4150 square feet. Sa1es
area will be 3000-3500 square feet, with the remaining space used
for storage, circulation, toilets, etc.
As the site is smal1, no on-site parking is provided. Patrons
wi] I park directly east of the site. since 6767 Dubl in Blvd. has
a surplus of 32 stalls (see summary of existing uses). loading
and trash area also wil I be shared.
Since two adjacent properties are owned by the same party,
there is an opportunity to develop an esthetically integrated
complex, as well as to expand and enhance the tendency toward
attractive retail space on Dublin Blvd. As there is no parking
on site, there is no need to create new driveways into the site;
the front of the new building al igns with that of the existing,
leaving a generous landscaped area fronting Dubl in Blvd. New
concrete curb, gutter and sidewalk will be provided in accordance
with the Cityls street-widening plans. The City will benefit
from an upgrade of the presently vacant lot and wi 11 real ¡ze
greater sales tax revenues from the completed project.

In reviewing the proposed development plan submitted on behalf of
Mr. To~ Huening, I have serious concern regarding the adequacy
of the proposed parking area. I own property immediately
adjacent to the subject site and have on numerous occasions
witnessed people parking automobiles illegally on my property.
There should be some condition of approval which would provide
for this parking problem not to reoccur. As you recognize,
being a property owner it is literally impossible to enforce
illegal parking in commercial and/or industrial areas. I
strongly suggest that the commission require the applicant to
at least fence his property which would make it somewhat more
difficult to utilize parking spùces offsite.
In addition to the parking problem, there should be some
requirement to maintain the existing speciman trees located
on the site. This would provide an excellent buffer between
other buildings in the immediate proximity.

Tom Huening is requesting a PO rezoning and SDR to construct
a 4,150 sq. ft. building on the abandoned DSRSD well site on
the north side of Dublin Boulevard, south of Sierra Court.
Mr. Huening also owns the parcel i~~ediately to the east of
this site. The Planning Commission has previously approved
Conditional Use Permits for Waseca Tractors' and Bur~s
European Motors for this parcel. (These CUPs are discussed
in the CUP Status report).
Mr. Hue!1ing is proposing to construct a 4,150 sc. ft.
building on the aba:1donee: DSRSD pro~erty with acce;s and
parking fr"om his adjacent parcel to the east. The existing
commercial site has su=plus parking which will provide the
required parking for t~e ne'.'" structure. An access and
parking easement will neee: to be recorded to ensure that a
potential future o~ner of the new building will have

trees in front of the site will be integrated into the new

The new building will have a tinted glass storefront with a
blue, metal seamed rear along the east and south elevations.
The roof will projeçt over the walkway along the storefronts
to create a canopy. The west and north elevations will have
plaster siding (painted tan) with a verticle mechanical

Staff ca~ support the location of building on the property
line provided there is some architectural treatment made to
the west elevation. This treatment could possibly take the
form of exposed aggregate with a tile band, varying forms of
textured block, or providing some form of roof treat~ent or
a combination thereof.
The applicants are proposing to rezone the small parcel fro~
M-l to a PO/C-2. The C-2 District permits a wide range of
uses from offices to general commercial. In order to make
both parcels consistent from a Zoning standpoint, Staff has
suggested, and the ap?licants have agreed, to rezone the
easterly parcel from a PO which permits C-2 -and M-l uses to
a PO which only permits C-2 uses. M-l uses are no longer
appropriate for this area or the City.
In conclusion, Staff belie\tes the proposed project will
result in a substantial improvement to the site and
'eliminate an eyesore on Dublin Boulevard. Final design
details for landscaping, trash enclosures, architectural
treatment and easements will be resolved between Staff and
the applicants after the PD and SDR are approved.

RESOLUTION NO. 85-
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

RECOMMENDING THAT A NEGATIVE DECLARATION BE ADOPTED FOR PA 85-020,
A REQUEST BY TOM HUENING FOR A PD AND SITE DEVELOPMENT REVIEW ON
THE ABANDONED DSRSD PROPERTY ON THE NORTH SIDE
OF DUBLIN BOULEVARD SOUTH OF SIERRA COURT
WHEREAS, Tom Huening filed an application for a PO and
Site Development Review to construct a 4,485 sq. ft. building on
the abandoned DSRSD property on the north side of Dublin
Boulevard, south of Sierra Court; and
WHEREAS, the commercial site located immediately to the
east is to be rezoned from a PO with M-l and C-2 uses to a PD with
C-2 uses as part of this application; and
WHEREAS, an Initial Study was completed which indicated
that the proposed project will not have a significant effect on
the environment; and
WHEREAS, a Negative Declaration has been prepared for
this application in accordance with CEQA; and
WHEREAS, a public hearing was held on this application;
and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, a Staff Report was submitted recommending the
Negative Decla~ation is in compliance with CEQA
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby recommend that a Negative Declaration be
adopted for this application.
PASSED, APPROVED AND ADOPTED this 15th day of
April, 1985.
