SUBJECT Purchase of FAU Funds from City of Madera

RECOMMENDATION Adopt resolution approving Joint Powers Agreement with
the City of Madera.
FINANCIAL STATEMENT: The City of Dublin will pay a total of $460,497.75 to
the City of Madera in exchange for $613 ,997.00 in FAU
funds . This will represent a savings to the City of
Dublin of $153 , 499. 25 .
DESCRIPTION On April 22 , 1985 , the City Council authorized the City
Engineer to submit a bid for the purchase of FAU funds from the City of
Madera. Madera has accepted Dublin' s bid of $ . 75 for each dollar of FAU
funds . A formal agreement between the two cities is now necessary to
initiate the transaction.
Under this Agreement , Dublin will pay a total of $460, 497 .75 for $613 ,997 . 00
of FAU funds . This will provide - a savings of $153 ,499. 25 to Dublin' s
General Fund . FAU funds must be used on designated streets and they are
administered by the State Department of Transportation. Some cities have a
difficulty with the use of the funds due to requirements placed on the
projects . The City of Dublin has been successful in the use of FAU monies
and Staff members are familiar with the design and reporting requirements .
FAU funds can only be used for construction and require a local match, of
13 . 8 cents for each FAU dollar used on a project .
These funds are planned to be used for the San Ramon Road Phase 2 project .
This project provides for the widening of San Ramon Road between I-580 and
Silvergate Drive . Also , median street lighting, landscaping, extension of a
storm drain, signal modifications at Amador Valley Boulevard and a signal at
Silvergate Drive are elements included in this project . If the total amount
is not used on San Ramon Road , it can be carried over to the Amador Valley
Boulevard reconstruction project .
The City Engineer has worked with the City of Madera to establish a phased
exchange of funds . The San Ramon Road Phase 2 project has been designed and
the City is awaiting the required approval by CalTrans officials prior to
requesting City Council authorization to solicit bids . The schedule
contained in the Joint Powers Agreement spreads the City of Dublin ' s
payments over five months . It is anticipated that this will correspond with
the dates in which the City of Dublin will receive reimbursements from the
FAU program. However, the actual dates on which the City receives FAU
reimbursements will be dependent upon the time schedule once construction
begins .
Staff recommends that the City Council adopt the Resolution approving the
Joint Powers Agreement .

CITY OF MADERA FEDERAL AID URBAN FUNDS
FOR DUBLIN GENERAL FUNDS
WHEREAS , the City of Madera has ' accepted .a .bid submitted
by the City of Dublin to exchange Federal Aid Urban (FAU) funds
for General Funds ; and
WHEREAS , the bid offered an exchange rate of seventy-
five cents ($0. 75 ) of general funds for every one dollar ($1 .00)
of FAU funds ; and
WHEREAS , Dublin plans to use these FAU funds for the
Phase 2 project on San Ramon Road , an FAU route ; and
WHEREAS , this exchange of funds will provide a greater
amount of Federal Funds available for necessary roadway
improvements .
NOW, THEREFORE , BE IT RESOLVED that the City. Council of
the City of Dublin does hereby approve the Joint Powers Agreement
between the City of Madera and the City of Dublin for the exchange
of FAU funds .
BE IT FURTHER RESOLVED that the Mayor shall execute the
Agreement and the City Clerk shall .. forward copies to the
appropriate authorities .

SUBJECT: Federal Aid Urban Funds

The City has been notified that the City of Madera is willing to
sell its allocation of Federal Aid Urban funds which will be
available by October 1 , 1985 . It is standard practice to
purchase funds from other agencies at a price that is less than
dollar for dollar basis . Since the City has FAU projects which
are presently under-funded in the City' s Capital Improvement
Program, it is recommended that the City Engineer be authorized
to bid for these FAU funds which are being made available for
purchase by the City of Madera-. -'
City Manager Ambrose indicated it would be appropriate for the City' s Park &
Recreation Commission to have input when these projects get to the design
stage .
Cm. Vonheeder felt the City should have a lot of input with how the money
will be spent and further stated she felt the oldest money should be spent
first . Cm. Vonheeder also felt discussion should be held with regard to
spending all of the pa.rk dedication fees currently being held .
On motion of Cm. Hegarty , seconded by Cm. Moffatt , and by unanimous vote ,
(Cm. Jeffery absent ) , the Council authorized Staff to request that the Dublin
San Ramon Services District consider undertaking the renovation of the
Shannon Center kitchen, and development of a park play area with Park Dedi- .
cation Funds held by the District . The Council further agreed to authorize .
the committee to discuss other subjects related to park and recreation
issues .
FEDERAL AID URBAN FUNDS
The City has been notified that the City of Madera is willing to sell its

1955 . It is standard practice to purchase funds from other agencies at a
price that is less than dollar for dollar basis . These funds could be
utilized in funding City FAU projects which are presently approved but
underfunded .
On motion of Cm. Moffatt , seconded by Cm. Vonheeder, and by unanimous vote ,
( Cm. Jeffery absent ) , the Council authorized the City Engineer to submit a
bid for the purchase of FAU funds .
ESTABLISH DATE FOR PUBLIC HEARING REVENUE SHARING & CITY BUDGET
1955-86- CAPITAL IMPROVEMENT PROGRAM,
In order to accomplish a more effective notification of the residents
regarding this years upcoming budget hearing, it is desirable to set a public
hearing date in order to advertise the date in the City Newsletter which will
be distributed in May.
By a consensus of the Council , the date of Tuesday, June 25 , 1985 , 6:00 p.m. ,
was set for the public hearing. Staff will determine the location.
OTHER BUSINESS
Kaufman & Broad Annexation
City Manager Ambrose reported that LAFCO had approved the Kaufman & Broad
Annexation request for 12 acres . There still remains a couple of steps
before it is certified .

tion No. 4278 which pertain to our FAU funds transfer. - Please have the
agreement signed by your Mayor and your City Clerk, and arrange for the
Federal Highway Administration representative to sign them also. When they
have been fully executed, please return them to Madera City Clerk Edith
Fischer.
I apologize for -any confusion which may have existed regarding this matter.
As Interim City Administrator, I had to pick up many projects which were
partially completed and some confusion did result. If I can be of .further
assistance to you in this or any other matter of mutual concern, please feel

JOINT POWERS AGREEMENT
THIS AGREEMENT made and entered into this day
of , 1985, by and between the CITY OF MADERA,
a Municipal Corporation of the State of California,
hereinafter referred to as "MADERA" , and the CITY OF
DUBLIN, a Municipal Corporation of the State of
California, hereinafter referred to as "DUBLIN" .
W I T N E S E T H:
WHEREAS, a procedure has been established,
acceptable to Federal and State Departments of .Trans-
portation, whereby local agencies may jointly agree to
exchange Federal Aid Urban (FAU) apportionments for
other funds as jointly agreed .upon; and
WHEREAS, it is mutually agreeable between MADERA
and DUBLIN to transfer general funds apportionments for
FAU apportionments to the mutual benefit of both parties
hereto;
NOW, THEREFORE, for and in consideration of the
mutual covenants herein contained, the parties agree as
follows:
1. MADERA agrees to transfer to DUBLIN, upon
execution of this agreement, or as promptly as possible
thereafter, the sum of $514,000.00 from MADERA' s FAU
apportionments, and on or before October 15, 1985, . the
sum of $99, 997.00 from said apportionments.
2. DUBLIN agrees to pay to MADERA the sum of
$460, 497. 75 as follows :
November 14 1985 $100, 000.00
December 1, 1985 100,000.00
January 1 , 1986 100, 000.00
February 1, 1986 100,000.00
March 1 , 1986 60,497.75
$460,497.75
3. It is understood and agreed that this agreement
is subject to the approval of the Secretary of the U.S.
Department of Transportation or his designee.
IN ' WITNESS WHEREOF, the parties hereto :}nave
executed this Joint Powers Agreement on the day and year
first above written.

RESOLUTION APPROVING JOINT POWERS
AGREEMENT WITH CITY OF DUBLIN FOR
RELINQUISHMENT OF CITY OF MADERA
FEDERAL AID URBAN FUNDS TO THE CITY
OF DUBLIN ' AND AUTHORIZING EXECUTION
THEREOF
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MADERA AS FOLLOWS:
That certain Joint Powers Agreement by and between
the City of Madera and the City of Dublin for
relinquishment of City of Madera Federal Aid Urban Funds `
to the City of Dublin, a copy of which agreement is on
file in the office of the City Clerk and to which
reference is hereby made for full particulars as to the
terms and conditions thereof, is hereby approved and the
Mayor and City Clerk are hereby authorized and directed
to execute the same for and on behalf of the City of
Madera.
