DESCRIPTION : The City Council has formed Landscaping & Lighting
Assessment Distric% 83-2 for the maintenance of landscaping within Tract
4719 (Stagecoach Road and the Amador Lakes Mini-Park).
Since that time, Lot #151 within this tract has been subdivided into three
lots under Tract 5180. This refers to the subdivision of the Amador Lakes
Condominium project. As a result of this change, it will be necessary to
amend the original assessment diagram. The assessments will be spread
proportionately over these three lots based on the number of units in each
lot. Also, the owners of the properties within the District, Beck
Properties and Amador Lakes Associates, have requested that the maintenance
of Lot #153 be included in the District. This lot represents the 90 acre
open space which has been offered to the City of Dublin pursuant to a
separate agreement. Beck Properties has also requested that the District
include the rear yard slopes fronting Agate Way and Coral Way. These slopes/
are found in Trac~ ~719 adjacent to Lots #80 through #86 and #37 through
#48. These changes in the Assessment Diagram have been reviewed by the City
Engineer and found to be appropriate. In the case of the new areas which
are added, the developers must dedicate to the public through easement or
fee title, in order for them to be maintained with the Assessment District
83-2 funds. The developers have indicated their agreement with this
requirement.
In order ~o reflect some of the changes which have occurred, the method of
spreading the assessments across the properties has been revised to include
the new areas and is proposed as follows:
1) The cost of maintaining the landscaping along Stagecoach Road and the
mini-park will be spread 60% to Tract 5180 (Amador Lakes). The assessment
will be spread across each of the 3 lots based on the number of units
proposed for each lot. The remaining ~0% of the cost will be spread on an
equal basis to Lots #1 through #150 of Tract 4719.

2) The cost of maintaining the fencing and the area within Lot #153 of Tract
~719 will be spread as follows: ~0~ to Tract 5180 on a proportionate
spread based on the number of units proposed for each of the 3 lots and
60~ spread on an equal basis to Lots #1 through #150 of Tract ~719. The
assessments related to these activities shall be subject to the agreement
entered into by the City and the developers upon acceptance of Lot #153 by
the City.
3) The cost of maintaining the excavated slopes, landscaping, concrete
ditches and drainage facilities within the slopes at the perimeter of
Lots #1 through #150 shall be spread evenly over Lots #1 through #150 of
Tract ~719. Also, the maintenance of the slopes behind Lots #80 through
#86 and #37 through #~8 of Tract ~719 shall be handled in the same manner.
Staff recommends that the City Council conduct a public hearing and adopt
the resolutions as appropriate.

ASSESSMENT
WHEREAS, On May 28, 1985, the City Council of the City of
Dublin, California, pursuant to the provisions of the Landscaping
and Lighting Act of 1972, adopted its Resolution Directing
Preparation of Annual Report for Maintenance Assessment District
for the maintenance of improvements more particularly therein
described;
WHEREAS, said resolution directed the undersigned to prepare
and file a report pursuant to Section 22565 et seq. of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power
vested in me under said Act and the order of the Council of said
City, hereby make the following assessment to cover the portion
of the estimated cost of the maintenance of said improvements and
the cost and expenses incidental thereto to be paid by said
district.
The amount to be paid for the maintenance of said
improvements, and the expenses incidental thereto, are as
follows:

As required by said Act, a diagram is hereto attached showing
the exterior boundaries of said landscaping maintenance assessment
district and also the lines and dimensions of each lot or parcel of
land within said landscaping maintenance assessment district as the
same existed at the time of the passage of said resolution, each of
which lots or parcels having been given a separate number upon said
diagram.
I do hereby assess the net amount to be assessed upon all
assessable lots or parcels of land within said landscaping
maintenance assessment district by apportioning that amount among
the several lots or parcels in proportion to the estimated benefits
to be received by each such lot or parcel from the maintenance of
said improvements, and more particularly set forth in the list
hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of
land within said landscaping maintenance assessment district in
proportion to the estimated benefits to be received by said lots or
parcels, respectively, from the maintenance of said improvements.
The diagram and assessment numbers appearing herein are the diagram
numbers appearing on said diagram, to which reference is hereby
made for a more particular description of said property.
Each lot or parcel of land assessed is described in the
assessment list by reference to its parcel number as shown on the
Assessor's Maps of the County of Alameda for th% fiscal year 1985-
1986 and includes all of such parcel excepting those portions
thereof within existing public roads or right of way to be acquired
in these proceedings for public road purposes. For a more
particular descripion of said property, reference is hereby made to
the deeds and maps on file and of record in the office of the
County Recorder of the said County. Because the names of the
several owners are unknown to me, I hereby place the word "Unknown"
opposite the number of each lot or parcel of land assessed, the
amount assessed thereon and the number of the assessment.

METHOD OF APPORTIONING
1) The cost of maintaining the original area of landscaping along
Stagecoach Road and the Mini park be spread 60% to lot 151 Tract
4719 (now lots 1,2, & 3 Tract 5180) on a proportionate spread based
on the number of units proposed for each of the 3 new lots and 40%
to lots 1 through 150 of Tract 4719 spread on an equal basis.
2) The cost of maintaining the fencing and the area within lot
153, Tract 4719 (except as modified herein below) be spread 40% to
lots 1,2, & 3 Tract 5180 on a proportionate spread based on the
number of units proposed for each of the 3 lots and 60% to lots 1
through 150 of Tract 4719 spread on an equal basis.
3) The cost of maintaining the excavated slopes, landscaping and
concrete ditches and drainage facilities within the slopes aroung
the perimeter of lots 1 through 150 within lot 153, and the slopes
behind lots 80 through 86 and 37 through 48, Tract 4719 be spread
evenly over lots 1 through 150 of Tract 4719 only.
4) The incidental expenses are to spread 50% equally to lots 1
through 150 of Tract 4719 and 50% in proportion to the number of
units in each lot for lots 1,2, & 3 of Tract 5180.
5) Lots 152 (mini park) and 153 (open space/recreation) of Tract
4719 shall have a zero assessment.

Scope of Work
The scope of the work shall be the maintenance of landscaping and
irrigation within the road right of way of Stagecoach Road between
the limits of Amador Valley Boulevard and Alcosta Boulevard and
maintenance of all facilities within the mini park on lot 152 of
Tract 4719
Further the scope of work shall include maintaining the fencing and
open space all within lot 153 of lot 153 of Tract 4719.
Further the scope of work shall include the maintenance of the
excavated slopes and drainage facilities related to these slope for
the area adjacent to lots 1 through 150 all within lot 153 of Tract
4719.
Further that the scope of work shall include the maintenance of the
slopes and landscaping and irrigation of the slopes within a public
easement for those slope areas to the rear of lots 80 through 86
and 37 through 48 all within Tract 4719.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
A RESOLUTION APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND
ASSESSMENT AND ORDERING LEVY OF ASSESSMENT
CITY OF DUBLIN LANDSCAPING AND
LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2
RESOLVED, by the City Council of the City of Dublin,
California that
WHEREAS, by its Resolution No. 40-85, a resolution
Directing Preparation of Annual Report for Maintenance Assessment
District, City of Dublin Landscaping and Lighting Maintenance
Assessment District, 83-2 (the "district") this Council designated
the City Engineer, as Engineer and ordered that engineer to make
and file a report in writing in accordance with and pursuant to
the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with
the City Clerk a preliminary report in writing as called for in
said Resolution No. 40-85, and under and pursuant to said Act,
which report was presented to and approved by this Council on July
8, 1985; and
WHEREAS, said Engineer of work has filed with the City
Clerk a revised Engineer Report for final consideration, said
revisions as requested by the two land owners; and
WHEREAS, said Council has duly considered said revised
report and each and every part thereof, and finds that each and
every part of said report is sufficient; and that said report, nor
any part thereof requires or should be modified in any respect;
NOW, THEREFORE, IT IS ORDERED, as follows:
a) that the Engineer's estimate of the itemized and
total costs and expenses of maintaining said improvements and of
the incidental expenses of maintaining said improvements and of
the incidental expenses in connection therewith; as contained in
said report be, and each of them are hereby, finally approved.
b) that the diagram showing the assessment district,
description of the improvements to be maintained and the
boundaries and dimensions of the respective lots and parcels of
land within said district; as contained in said report, be and it
is hereby finally approved.
c) the assessment of the total amount of the cost and
expenses of the proposed maintenance of said improvements upon the
several lots and parcels of land in said District in proportion to
the estimated benefits to be received by such lots and parcels,
respectively, from said maintenance and of the expenses incidental
thereto, as contained in said report be and they are hereby
finally approved and those assessments are hereby ordered levied
as contained in said report.
I hereby certify that the foregoing resolution was duly and
regularly adopted and passed by the ~ity Council of the City of
Dublin, California, at a regular meeting thereof held on the 12th
day of August, 1985, by the following vote of the members thereof:

RESOLUTION NO. -85
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
A RESOLUTION AMMENDING THE SCOPE OF WORK FOR LANDSCAPING AND
LIGHTING DISTRICT NO. 1983-2 (TRACT 4719)
RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBLIN,
COUNTY OF ALAMEDA, CALIFORNIA THAT
WHEREAS, the two owners of the lands within the
boundary of Landscaping and Lighting Maintenance District No.
1983-2 (all within Tract 4719) have requested that the City accept
lot 153 of Tract 4719 for public recreation and/or open space
purposes and wish to have this lot maintained through the said
Landscaping and Lighting Maintenance District; and
WHEREAS, the owners further request that the City of
Dublin accept an easement for maintaining rear yard slope
landscaping fronting Agate Way and Coral Way (lots 80 throught 86
and 37 throught 48, Tract 4719) and that said District also
maintain these slopes;
NOW, THEREFORE, BE IT RESOLVED that the scope of the
work for Lighting and Landscaping Maintenance District No. 1983-2
be amended to read as follows:
Scope of Work
