DISCUSSION: On November 19, 1985, the Murray School District formally
advised the City of Dublin of its intent to dispose as excess property a
9.6+ acre portion of the 14+ acre Fallon School Site (see Exhibit A).
Under provisions of EducatiOn Code Section 39394, the City has 60 days from
receipt of its notice to advise the District if it is interested in
purchasing part or all of the referenced acreage. Failure to express an
interest in the property in the stated time frame would result in the
property being placed on the open market for sale. The property is being
offered to the City under legal priority for playground, playing field, or
other outdoor recreational and open space purposes.
The City has previously expressed its interest in purchasing a park
site and the multi-purpose building on the Fallon School Site (see
Attachment 2 and Attachment 3). The District's transmittal regarding this
matter included a Development Sketch outlining a possible land development
scheme for the school site. This sketch, prepared by the engineering firm
of Wallace B. Duncan and Associates, outlined the following four proposed
land-use areas:

The City's General Plan calls for the acquisition of a five-acre
neighborhood park site out of the~Fallon School site holding (Implementing
Policy for Section 3.3 - Open Space for Outdoor Recreation). Based on this
existing City policy, it would be appropriate for the City to notify the
District of the City's interest in purchasing land for a park site.
The Land Use Element of the General Plan establishes the following
developmental policy for the future residential use of the remaining
portion of the site.

The District is proposing approximately 4.3~ acres for residential
development. The Develepment Sketch shows 17 lots. The indicated density
of 4.0 DU/acre would be consistent with the Single Family Residential
density range (0.9 to 6.0 DU/acre) designated by the General Plan.
In response to the Development Sketch submitted by the District, the
Staff has prepared a list of initial comments and items to be considered,
subject to further review and refinement as additional details are
provided:
Proposed Park Site
A. Size - A full five-acre park site is desired; obtaining a site in
excess of five acres can possibly be considered as long as it does
not compromise the design or function of the other existing or
proposed land uses.
B. Configuration - A rectangular park shape is desired to facilitate
efficient park design layout.
C. Access - Design the park for good street, access. Consider
potential access from existing 20-foot-wide pedestrian way from
Bristol Road.
Visibility - Design for good visibility and visual surveillance
from the street and adjacent houses to enhance security and deter
vandalism.
Tennis Courts - Design park so that existing tennis courts are
saved if economically feasible.
Adjacent Uses - In finalizing the park design, consider potential
park uses in relationship to adjacent single-family and proposed
School District uses.
Proposed City Recreation Building
Parking- Enter into a cross parking easement agreement or some
other means of providing adequate off-street parking for potential
uses in the proposed City recreation building.

'Proposed Single Family Residential Area
A. Access - Design street access to work safely and efficiently with
the existing street network.
B. Lot Dimensional Criteria - Design adequate individual lot depth,
-~width, size and street trontage-to facilitate residential
development that is consistent and compatible with existing single
family development.
C. Adjacent Uses - Design new lots to be compatible with existing
single family lots, proposed park site, and proposed school
district corporation yard and day care uses. Avoid rear yards of
new lots abutting proposed park site. Design to minimize impacts
and land use conflicts with proposed corporation yard.

Proposed School District Corporation Yard
A. Adjacent Uses - Design proposed corporation yard to minimize or
avoid land use conflicts with adjacent existing and proposed
single family lots. Consider potential noise, dust, lighting and
similar impacts. Consider a barrier and/or buffer area adjacent
to residential areas.
APPROVAL PROCESS
The School District will need to apply for a Subdivision Map to create
the proposed single family lots and a Conditional Use Permit to allow the
proposed School District Offices and Corporation Yard. These planning
applications can be processed separately (Subdivision Map first, followed
by the Conditional Use Permit) or concurrently. The City Staff has
discussed the planning application requirements with Wallace Duncan,
Engineer representing the School District.
ALTERNATIVE LAYOUT
In performing a preliminary review of the Development Sketch submitted
by the District, the City secured input from the City Engineer, the
D.S.R.S.D. Fire Department, the Dublin Police Department and the park
designing firm of Singer and Hodges, the firm contracted to perform
preliminary site planning for the City's existing and planned park sites.
A variety of alternate layouts for both the park and the potential
residential lots were considered. The result of this discussion was the
establishment of the following list of criteria for the layout of the
proposed uses at the Fallon School Site (see Exhibit B, Staff Alternative
Layout):
1. Incorporate the 0.4+ acres at the southwest corner of Brighton Drive
and BristOl Road (a--portion of Proposed Area C) into the park site
(Proposed Area A). The two lots in this area can potentially be
shifted into the larger area proposed for residential development by
redesigning for a more efficient layout.
2. Within the park area, retain the existing tennis courts. Research by
Phil Singer indicates that upgrading the current courts would cost
approximately $17,000-20,000, while rebuilding the tennis courts at an
alternate location would cost $70,000-80,000.
3. Modify the layout of the southern end of the proposed park site to
provide a wider, more rectangular configuration. This will provide a
more useable park area.
4. Provide a cross parking easement agreement to assure adequate off-
street parking for the proposed City Recreation Building (Proposed
Area B).
This Alternative Layout is a preliminary design intended to suggest
potential revisions and facilitate discussion. The review and approval
process for the Subdivision Map will require a formal application with more
detailed and accurate pla~s and design analysis.

The Staff recommends that the City Council take the following actions:
1. Express interest in Area A, the Proposed Park Site as modified in
the Staff Alternative Layout (Exhibit B).
2. Express interest in Area B, the Proposed City Recreation Center
subject to a cross parking easement agreement for adequate off-street
parking.
3. Direct Staff to work with the School District Staff and
Engineering Consultant to revise the configuration of the proposed uses to
generally meet the criteria identified and used in the Staff Alternative
Layout.
4. Adopt the Resolution notifying the School District of the City's
interest in purchasing the proposed Park Site (Area A) and Proposed City
Recreation Center (Area B) as conditioned above.
5. Direct Staff to negotiate for purchase of the two sites and bring
the item back to the City Council for review and approval.

that the Murray School District intends to dispose of the real property
described in Exhibit I, and shown as Areas, A, B and C, attached hereto
by sale for fair market value without making any admission under Education
Code Section 39391 (c).
The subject property is located in the Murray School District of Dublin,
Alameda County, State of California, and the property is offered to you
under legal priority for playground, playing field, or other outdoor
recreational and open space purposes.
You are required to notify the selling agency (the District) of your intention
to purchase within sixty (60) days from receipt of this notice. Please
give such notice below and return in the enclosed self addressed, stamped
envelope within sixty (60) days from receipt of this notice.

NOTICE OF INTENT TO SELL PORTIONS OF FALLON SCHOOL AS SURPLUS REAL PROPERTY

WHEREAS, the Murray School District owns a parcel of land located
in the City of Dublin, Alameda County, State of California, containing
15.66 acres, more or less, (hereinafter called the Fallon Elementary
School). The Fallon Elementary School is more particularly described
in a document entitled "Fallon Elementary School Site Property Description"
which is on file and available for inspection at the District Administrative
Offices located at 7416 Brighton Drive, Dublin, California.
WHEREAS, this Board hereby announces its intention to dispose
of the following portions of Fallon Elementary School. The sale shall
be at fair market value except to those public agencies entitled to p~rchase
surplus school property land under the provisions of the Naylor Bill.
The portions of Fallon School to be disposed of are'
A. A 5 acre +- portion shown as "Area A" on the attached map.
B. A half acre +- portion shown as "Area B" on the attached map.
C. A four ± acre portion shown as "Area C" on the attached map.
The Secretary of this Board is hereby authorized and directed
to cause the following to be done'
I. To notify those public agencies described in Educaticn Code
Section 39394 that a portion of the Fallon Elementary School Site is offered
for sale to them for the purposes specified in Education Code Section
39390, et. seq.
2. To notify those entities described in Government Code Section
54222 that a portion of the Fallon elementary School site is offered for'
sale to them for the purposes specified in Government Code Section 5~220,
et. seq.
3. To notify those entities specified in Education Code Section
39363.5 that a portion of the Fallon Elementary School site is offered
for sale to them and publish a copy of this resolution in a newspaper
regularly published within the District in accordance with that statute.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
DECLARING ITS INTEREST IN PURCHASING PORTIONS OF THE FALLON
ELEMENTARY SCHOOL SITE PROPERTY FROM THE MURRAY SCHOOL DISRICT
WHEREAS, the Board of Trustees for the Murray School District at
its meeting of November 18, 1985, authorized and directed the
Secretary of the Board to notify appropriate public agencies that
a portion of the Fallon Elementary School site was being offered
for sale to them for the purposes specified in Education Code
Section 3930, et. seq.; and
WHEREAS, said Board of Trustees announced its intent to
dispose of identified portions of the School site with the sale of
such land to be at fair market value except to those public
agencies entitled to purchase School property under the provisions
of the Naylor Bill; and
WHEREAS, said Notice of Intent to Sell Portions of
Fallon Elementary School Site was received by the City in the form
of a letter dated November 19, 1985, and accompanying transmittal
from Stanley L. Maleski, Business Manager, Murray School District;
and
WHEREAS, said Notice of Intent stated the City was required
to notify the selling agency (Murray School District) of its
intention to purchase within sixty days from the receipt of the
notice; and
WHEREAS, the Dublin General Plan calls for the acquisition of
a five-acre portion of the Fallon Elementary School Site for
development and use as a City-owned neighborhood park site
(implementing Policy for Section 3.3 - Open Space for Outdoor
Recreation); and
WHEREAS, the City previously stated on July 25, 1985, and
September 9, 1985, its interest in purchasing five (5) acres of
the Fallon School Site for a public park and also stated its
interest in owning and maintaining the multi-purpose room as a
Senior Citizen Center; and
WHEREAS, the 5.0+ acre portion of the site identified as
"Area A" on the District's Development Sketch prepared for the
School site is indicated for use as a possible park site; and
WHEREAS, said "Area A" is of a site, location and general
configuration that would well lend itself towards development as a
neighborhood park; and
WHEREAS, the 0.3+ acre portion of the site identified as
"Area B" on the District's Development Sketch prepared for the
School site and the existing structure located on said parcel are
indicated for use as a possible City Recreation Building; and

WHEREAS, said "Area B" is of a size, location and
general configuration that would well lend itself towards use as a
City Recreation Building (Senior Citizen Center); and
WHEREAS, the Staff Report prepared for this item
recommended the City request the District to modify the
configuration of "Area A" to provide for the inclusion of a 0.38~
acre portion of the easterly section of "Area C" located at the
southwest corner of Brighton Drive and Bristol Drive in "Area A"
and a second adjustment involving the southern boundary of "Area
A" to provide for the creation of a wider, more rectangularly-
shaped configuration, which would better lend itself to future
park development; and
WHEREAS, the Staff Report also recommended the City
request the District to provide assurance that an acceptable cross
parking easement agreement can be secured to provide parking for
the structure located at "Area B"; and
WHEREAS, the Staff Report also recommended the City
request the District to consider modifying the proposed
development scheme for the westerly section of "Area C" to provide
for a more efficient, standardized single family residential
lotting pattern as generally depicted in the Staff Alternative
Layout dated January 7, 1986;
NOW, THEREFORE, BE IT RESOLVED that this Resolution
shall serve as that constructive notice of interest in purchasing
"Area A" and "Area B" as denoted by the District's Development
Scheme as modified to reflect the aforementioned recommendations
from Staff regarding the configuration of "Area A" and the
provision of rights to utilize parking to service "Area B."
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to transmit this Resolution and pertinent attachments to
the Board of Trustees of the Murray School District prior to the
termination of the sixty-day period specified in the District's
November 19, 1985, Notice of Intent.

SUBJECT: Fallon School Site
Honorable Presiden~ and Boardmembers:
As you are aware, the City of Dublin has been interested in
acquiring five (5) acres of the Fallon School Site for a park
since December 20, 1983. The City would like to reaffirm its
interest in purchasing five (5) acres of the Fallon School Sice
including the existing Kolb Park Tennis Courts for a public park.
In addition, at a recent joint meeting between the Board of
Trustees and City Council there was a question raised as to
whether the City would be interested in owning and maintaining
the Fallon School Multi-Purpose Room as a Senior Citizen's
Center. The City is interested in ~his facility for its
pocential as a Senior Citizen's Center depending upon the terms
and conditions of the title transfer required by the School
District.
lc is also our understanding that the School District may be
interested in subdividing a porCion of the Fallon School Site for
residential use. If this is the case, be assured that ohe City's
Staff will work wich the School District through the City's
planning process.
I hope this letter clarifies %he City's in~entions with respect
to %he Failon School Site.

DESCRIPTION: As you may recall the City Council
authorized a letter to be prepared and sent to the school
district which outlined the City's intent with respect to
purchasing the Fallon School site and multipurpose room.
The Board of Trustees of the Murray School District has sent
a similar letter to the City indicating its intent to sell
to the City approximately 5 acres of the site including the
tennis courts and multi-use building. The school district
indicated the price of the 5 acres would be based on the
Naylor Bill formula-and the price of the multi-use building
would be the legal minimum price possible.
As the Council may recall, the City has planned to use two
funding sources in addition to Park Dedication Fees for the
purchase and renovation of this site. As part of the City's
agreement with the Amador Lakes Developer, the developer had
agreed to refurbish the tennis courts at the Fallon School
site. If the City did not acquire this site by January 1,
1986, the developer would provide a cash payment to the City
in the amount of $50,000.00 towards that improvement. In
addition under the State Park Bond Act, the City has funds
available for the renovation of the park at the Fallon
School site. ~ince there are timeframes attached to these
funding commit/ments, it is Staff's recommendation that the
City Council ~uthorize Staff to prepare a letter to the
School District requesting an estimated timeframe for the
authorizations that would be required for the sale of
property to the City.

To the Honorable Mayor and Members of City Council:
The Murray School District recognizes that the City and the District
share an interest in seeing that the Fallon School Site is used in a
way that will enhance the quality of life of the residents of Dublin.
Sharing this common goal, and in the interest of furthering coopera-
tion between the City and the District, the Board of Trustees directed
that this letter be written to you.
We believe that the City's General Plan as it relates to the Fallon
School Site and the District's plans for the Site are compatible.
Our plans at this time for the Site are:
To sell to the City approximately five acres of the
Fallon site including the tennis courts and the
multi-use building. The price of the five acres is
to be based upon the Naylor Bill formulas. The price
of the multi-use building to be the legal minimum
price possible.
To relocate the District's District Office and Main-
tenance activities to the remaining buildings at
Fallon School.
To sell the land not needed for the District Office/
Maintenance activities or for park purposes to a
developer for single-family residences.
The realization of this plan will be contingent upon receiving neces-
sary approvals from the State Office of Local Assistance and the City
of Dublin, including but not limited to:
1. Authorization to dispose of surplus property as
outlined above.

It is the Board's hope that this letter of intent will clarify the
direction that the Board of Trustees is moving, assist the City in
