RECOMMENDATION: Adopt Resolution revising underground deadlines . FINANCIAL STATEMENT: None. DESCRIPTION: The project to underground the overhead utilities along San Ramon Road is behind schedule due to circuitry problems with Pacific Bell ' s facilities . On June 10 , 1985 , the City Council adopted Resolution No. 48-85 which modified the dates for the subject underground district . The project is behind schedule due to Pacific Bell ' s problems, and it is necessary to modify the previously approved dates as follows: 1 ) Property owners to be ready to receive underground service by March 1 , 1986 (previously July 12 , 1985 ) . 2 ) Removal of overhead utilities and underground installation of same by April 30 , 1986 (previously January 1 , 1986 ) . Property owners within the district are being noticed of this proposed change and will be notified by mail of this change if approved. ----------------------------------------------------------------- ITEM N0. *- COPIES TO: Property Owners RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- AMENDING RESOLUTION NO. 121-84 AND AMENDING MANDATORY DATES FOR UNDERGROUNDING OF UTILITIES IN THE SAN RAMON ROAD UNDERGROUND UTILITY DISTRICT NUMBER 1 WHEREAS, the City Council of the City of Dublin has established the San Ramon Road Underground Utility District Number One by Resolution No. 124-84 ; and WHEREAS, under Section 3 of that resolution, certain deadlines were established for undergrounding of utilities; and WHEREAS, these deadlines were extended by Resolution No. 20-85 ; and WHEREAS, these deadlines were extended by Resolution No. 48-85 ; and WHEREAS, the design and construction of this District will not meet these new dates ; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that Section 3 of Resolution No. 124-84 be amended to read as follows : Section 3 Orders that the removal and underground installation of the abovementioned utilities be accomplished by April 30 , 1986 , and that all property owners within said District shall be ready to receive undergrounding service from such underground systems as of March 1 , 1986 . AYES : NOES : ABSENT: Mayor ATTEST: City Clerk 1 RESOLUTION NO. 124-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------- DESIGNATING AN AREA FOR THE UNDERGROUND INSTALLATION OF UTILITIES AND ORDERING THE REMOVAL OF ABOVEGROUND UTILITIES IN AN AREA DESIGNATED AS THE SAN RAMON ROAD UNDERGROUND UTILITY DISTRICT NUMBER 1 . WHEREAS, the Citv Council of the City of Dublin has received the recommendation of the City Engineer that the area designated in Exhibit "A" , attached hereto and incorporated herein by reference, in Dublin, California, should be designated as an area in which poles , overhead wires and associated overhead structures should be removed and that underground wires and facilities for supplying electric, communication, or similar or associated service should be installed; and WHEREAS, pursuant to .Chapter 6 - Lndergrounding of ,Utilities of the Ordinance Code of the Countv of Alameda as adopted by the City of Dublin, the City Cleric notified all affected property owners as shown on the last equalized assessment roll,. and utilities concerned, by mail, of a public hearing on this matter to be November 13 , 1984 , at 7 :30 p.m. in the Dublin Library Meeting Room, located at 7606 Amador Valley Boulevard. WHEREAS, a public hearing was held on said date, at which time the City Council did receive and consider the recommendation of the City Engineer and did hear any and all objections or protests which were raised by the owners of property within the above described area pertaining to designating this , area an underground utility district. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council on behalf of all Dublin Citizens does hereby resolve: Section 1 . The public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and underground installation of wires and facilities for supplying electric, communication, or similar or associated services within the area as shown in Exhibit "A" attached hereto, with such area hereby being designated as the San Ramon Road Underground Utilitv / District. Section 2 . Determines that the undergrounding of utilities as provided in Section 1 . will avoid or eliminate an unusually heavy concentration of overhead distribution facilities . Section 3 . Orders that the removal and underground installation CZ the above mentioned utilities be accomplished by May 31, 1985 , and that all property owners within said District shall be ready to receive underground service from such underground systems as of April 15, 1985 . Section 4 . Directs the City Clerk to mail a copy of this Resolution together with a copy of Chapter 6 - Undergrounding of Utilities of the Ordinance Code of the County of Alameda as adopted by the City of Dublin, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities . AMENDING RESOLUTION NO. 124-84 AND MODIFYING MANDATORY DATES FOR UNDERGROUNDING OF UTILITIES IN THE SAN RAMON ROAD UNDERGROUND UTILITY DISTRICT NUMBER 1 WHEREAS, the City Council of the City of Dublin has established the San Ramon Road Underground Utility District Number 1 by Resolution Number 124-84 ; and WHEREAS, under Section 3 o� that resolution, certain deadlines were established for undergrounding of utilities ; and WHEREAS, the design and construction of this District is behind schedule . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that Section 3 of Resolution 124-84 be modified to read as follows : "Section 3" . Orders that the removal and underground installation of the above mentioned utilities be accomplished by June 30, 1985 , and that all property owners within said District shall be ready to receive underground service from such underground systems as of June 14 , 1985 . WHEREAS , the design and construction of this District will not meet these new dates . NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Dublin that Section 3 of Resolution 124-$4 be amended to read as follows : Section 3 Orders that the removal and underground installation of the above mentioned utilities , with the exception of Pacific Bell ' s trunk and toll cable , be accomplished by July 26, 1985 . Orders that the removal of the trunk and toll cable and poles be accomplished by January 1 , 19$6 and that all property owners within said District shall be ready to receive under- grounding service from such underground service as of July 12 , 1985 . On May 30, 1985 we requested and were granted an extension of the pole removal date to January 1, 1986. We were unable to meet that date. Therefore, we must request a final extension of the pole removal date to April 30, 1986. This request is necessary because of the following reasons : 1 . Our underground supporting structures was completed and turned over to us two months beyond the date necessary for us to complete our work; 2 . During our initial study of this project, we overlooked twelve special alarm circuits. These circuits require special treatment under our tariff guidelines. They are analog circuits, which will have to be converted to digital. This requires the purchase of new equipment by our customers. Under the guidelines of our tariff, we are required to give our customers six months notice of the new equipment required; and 3 . While designing our project for local exchange facilities, we discovered, the transfer of these facilities must be done in a sequential manner in order to maintain continuous service to our customers . We have discussed this with the City engineer and in his opinion the extended date should cause no delays to the City' s Street Improvement project.
