FINANCIAL STATEMENT: See description DESCRIPTION: At their meeting of January 27, 1986, the City Council approved a conceptual agreement with the U.S. Army (Parks RFTA). The attached letter incorporates the provisions of this agreement with the following revisions. 1. It requires the City to put in about 2,000 lineal feet of chain link fence with barbed wire north of Amador Valley Boulevard within the next four months at a cost of about $20,000. 2. The City would have the Alamo Creek developer put in a berm adjacent to Camp Parks and hydroseed it with a wildflower seed mix. 3. The City would not be required to move a transformer (saving the City $10,000.00). 4. The City would maintain the berm from the street to the top of the berm (about two acres initially). This would consist of mowing the wildflowers when they die back each year (estimated $600 to $1,000 per year). 5. The City or a future developer would move the fence along Dougherty Road from Amador Valley Boulevard south when that portion of the road is widened (estimate $15,000). ITEM NO. Box DD Dublin CA 94568 Dear Colonel Pellegrino: This letter will serve as the official request from the City of Dublin for an easement for roadway purposes and landscaping along the east side of the existing Dougherty Road from the south boundary of Parks RFTA, north to the County line. This easement is depicted on the enclosed plans. The width of the easement for 'roadway varies, with an average of 40 feet. The easement needed for landscaping to the top of an earthen berm is 20- foot -wide from the south at the railroad right -of -way, north to the point where Amador Valley Boulevard meets Dougherty Road, then 40 feet from that point, north for approximately 1,850 feet, tying into an existing hill. The purpose of these easements is to accommodate the street lights, curb, gutter, bicycle pathway, and landscaped berm on the east side of`the road. It is anticipated that the easterly right -of -way line (limits of the landscape easement requested) will be at the top of the landscaped berm on the east side of the road. Therefore, in addition to the easement, a right -of -entry will be required allowing the overall berm construction, a portion of which will fall outside the easement. It is intended that construction of the improvements within the easement would proceed according to the following schedule: Phase I, Commencing Spring, 1986: 1. The Army would provide the necessary right -of -entry by way of a letter agreement to allow commencement of construction. The anticipated date for commencement of construction is April 15, 1986. The letter agreement would be followed by a perpetual easement for roadway, pathway, and landscape installation and maintenance. 2. The City agrees to construct or cause the developers of the Alamo Creek subdivision to construct a berm varying in height and extending from the U.S. Army Reserve Center northerly approximately 1,850 feet. Following completion of construction of this berm, the City will construct a new chain link fence with barbed wire on top, similar to the boundary fence located south of the Reserve Center. This fence will be located 10 feet from the toe of the berm on the easterly side of the berm. The berm will be hydromulched with a seed mix of annual grasses and wildflowers which will provide a low- maintenance erosion - resistant ground cover. The City will maintain this area between the top of the berm and the street improvements by mowing the grasses and flowers once a year as they begin to go dormant and die back. -1- 3. The City would construct or cause the developers of the Alamo Creek project to construct a new three- or four -lane road from Amador Valley Boulevard north to the County line. This new road would occupy the westerly three lanes of the ultimate six -lane road, with a temporary fourth lane or landscaped median in the location of the ultimate median. 4. Parks RFTA would make a temporary connection from its new main access road through to the existing lanes of Dougherty Road. The location of this new entrance shall be shown on exhibits to the easement agreement. Phase II, Estimated Commencement Spring, 1988: 1. The City would construct or cause the developers of the Alamo Creek project to construct two new lanes in the southbound direction extending from Amador Valley Boulevard across the Southern Pacific right -of -way. 2. The City would construct or cause the developers of the Alamo Creek project to construct a left -hand turn holding lane and pocket in the location of the ultimate median at the new entrance location for Parks RFTA. 3. The City would construct or cause the developer to construct a low berm approximately two feet to three feet high from the Reserve Center southward to the extent that soils were available from the construction of the two new southbound lanes. The City will maintain this area between the top of the berm and the street improvements by mowing the grasses and flowers once a year as they begin to go dormant and die back. Phase III, Estimated 5 Years: 1. The City would construct, or require outside developers to construct, the final right -of -way improvements commencing at the county line and running the full length of the Parks RFTA frontage. These improvements would include three new southbound lanes, including curb, gutter, landscaped median, and bicycle path on the east side of Dougherty Road. 2. The City would construct a new entrance, including curb, gutter, and curb returns, to the Parks RFTA property, which would blend with the final street alicnment as well as the grade at the Parks RFTA entrance road. 3. The City would construct or cause to be constructed a new fence on the new right -of -way line from the County line to the north end of the berm to be constructed under Phase I. It would relocate the existing fence south of the Reserve Center to a location behind the small berm constructed as part of Phase II. All fencing to match the existing fences south of the Reserve Center. -2- One of the principal benefits accruing to the Army from this agreement is the construction of the berm northward from the Army Reserve Center. In order to complete this berm, a right -of -entry must be issued to the City, which we can then assign to the developer of the Alamo Creek project by the end of April. The material the developer will be using to construct the berm is the very first material to be removed from the Alamo Creek site. It is, therefore, important that access be available by the end of April. The attached drawings show the location of the required easement. We recognize that any new utilities to be located within the proposed roadway easement must be located in a new easement to be issued by the Army to the individual utility company.
