FINANCIAL STATEMENT: Depending upon option, zero to $14,045 additional
contribution to construction of Amador Lakes Mini-
Park.
DESCRIPTION:
Rafanelli and Nahas Real Estate Development are proposing to contribute
a total of $88,000 toward the construction of the Amador Lakes Mini-Park at
Stagecoach Road and the new Turquoise Street. The proposed sum was reached as
follows:
$75,000 Required as part of the Amador Lakes and Larry Lee subdivision
$13,000 In lieu of the modified overlook and tot lot required of Amador Lakes
$88,000 Total
The original approval for the Amador Lakes development included overlooks
overhanging the lake at three locations. The overlooks would enhance the use of
the lake by providing key focal points for sitting, standing, and viewing the
water element.
During construction, the developers changed the landscaping improvements
by providing some larger 24-inch box trees and several additional 15 gallon
trees and eliminated the three overlooks.
When Staff became aware of the changes, Staff and the developers discussed
the matter and agreed to one modified overlook and one tot lot in conjunction
with the upgraded trees in lieu of the three overlooks. The tot lot was to
provide a formal, on-site play area for the children who would live in the
project. The developers have since submitted information indicating that 51
children were residing in the development, with a substantial percentage being
preschool age.
The developers indicated that the overlook and tot lot would involve the
following construction costs:
Overlook: $ 5,140.00
Tot lot: 8,905.00
Total: 14,045.00 (not including design, supervision, or other soft
costs)
In December, 1985, the developers provided the City with a letter of
credit for $17,557 ($14,045 x 125%) to cover the cost of completing the
landscaping and overlook. With the additional security, the last buildings were
released for occupancy.

The City Council has several options available:
Option 1: Approve the request for a total cash contribution (including
the estimated $14,045 for the overlook and tot lot, instead of $13,000) toward
the construction of Amador Lakes Mini-Park.
Option 2: Amend the request to have a tot lot in Amador Lakes and a total
cash contribution of $80,140 (including the estimated $5,140 for the overlook
only) .
Option 3: Deny the request, keeping both the overlook and tot lot in
Amador Lakes and maintaining a total cash contribution of $75,000 toward Amador
Lakes Mini-Park.
Option 4: Approve request for a total cash contribution of $88,000 toward
the construction of Amador Lakes Mini-Park as requested by the developer.
Staff recommends that the City Council select Option 4.

Dear Mayor Snyder & Members of the Council:
Amador Lakes and Larry Lee, et al, are required under the approval of
Tracts 4719 and 5180, to contribute $75,000 to the construction of the
mini park on Stagecoach Road. In addition, Amador Lakes is obligated
to construct, within Tract 5180, a lake overlook and tot lot as part of
the settlement with the staff of issues raised about the deletion of
overlooks within the Amador Lakes project.
We appreciate the financial commitment which has been made by the City
to enhance the mini park. The facilities proposed for preschoolers at
the mini park are substantial and appear to be well designed. We feel
that the tot lot proposed for Amador Lakes would duplicate the amenity
in the mini park. As you know, we deleted the lake overlooks fran our
plans and, hence, the construction of one is not a high priority for
US.
We will, therefore, offer to share equally with the City the increased
contribution toward the mini park approved at your meeting of April
14th. This would increase the overall contribution from Larry Lee and
ourselves to $88,000. This additional contribution would be in lieu of
the requirement for the construction of an overlook and tot lot within
the project. Upon contributing these funds, the letter of credit being
held by the City would be returned to us.
Please let us know if this proposal meets with the approval of the
Council.

Dear Larry:
Enclosed is a construction cost estimate for the overlook and plav area
at Amador Lakes. These estimates have been nrenared off of the marked
up drawings which we reviewed on Friday. They include no allowance for
desicm- , supervision or other soft costs. I am hopeful that we will be
able to complete this work under these budgeted numbers. If this
estimate is acceptable, please let me know and we will prepare and
deliver a letter of credit in the amount of $14,045 in favor of the
City of Dublin in order to obtain the release of our final 48 units. As
I mentioned, we do have a waitina list currently for those units.

Re: Amador Lakes Overlooks
Dear Kevin:
This letter is a follow-up to the letter I delivered to Larry Tong
regarding the lake overlooks and landscaping completion at the Plarx ng
C=Tassion hearing on Monday night. In that -letter, I agreed to
complete one overlook as required by the Planning Department and
complete all landscaping by September 30th. In that letter, I noted
that the detail shown on the plans for the overlooks has both safety
and construction problems. We, therefore, intend to submit a revised
design showing the overlook constructed of mod with a railing.
As you know, we- currently have a set-aside letter posted with the City
to secure our completion of -landscaping on the project, as well as a
set-aside letter securing our completion of on-site improvements, which
are now 100% finished.
It was my understanding* from Larry on Monday night that he did not feel
our written assurances and the existing security was adequate to assure
him that landscaping with-in the project would be completed. He
requested on Monday night that 48 units be held and not released for
occupancy as additional insurance that the landscaping be completed.
He also suggested that a bond or letter of credit in the amount of 125%
of the remaining work would be an acceptable alternate. - I told Larry
that although he may not have intended it as an expression of his lack
of confidence in our integrity and ability, we certainly take it that
way.
Despite our objections, the imperative of continuing to release
buildings for occupancy cCnTPk--1s us to agree to Larry's terms. We,
therefore, agree as follows:
1. All landscaping in the project will be complete prior to
September 30, 1985.
2.., One overlook adjacent to the waterfall will be complete. We will
be submitting a revised design for your review shortly.
The following buildings will not be released for occupancy until
such time as the overlook and the landscaping are canplete:
