HomeMy WebLinkAboutItem 4.1 Approve 06-09-1986 Minutes (2) REGULAR MEETING - June 9, 1986 A regular meeting of the City Council of the City of Dublin was held on Monday, June 9 , 1986 in the meeting room of the Dublin Library. The meeting was called to order at 7 : 37 p .m. by Mayor Peter Snyder . ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Moffatt, Vonheeder and Mayor Snyder. PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of alleg- iance to the flag. PROCLAMATION Mayor Snyder read a proclamation honoring Eric Ovlen for his service on the Park & Recreation Commission. Recreation Director Lowart indicated she would make sure Mr . Ovlen receives the proclamation . Low Cost Animal Vaccinations Dr . William R. Evans , Parkway Veterinarian Hospital, addressed the Council and indicated that he and Dr. Peggy Roberts will be soon starting low cost animal vaccination clinic services several times per year . They will be working in conjunction with the newly formed Valley Humane Society. Any funds derived from these clinics will be given to the Valley Humane Society. Dr . Evans introduced Vicky Prosetti, President of the Valley Humane Society, who indicated that it was formed about a year ago. Dr. Peggy Roberts stated she endorsed the Valley Humane Society also. Cm. Hegarty asked if Staff could give an update on the status of the animal shelter situation in the valley at a future meeting. Assistant to the City Manager Rankin responded that he would prepare such an update. CONSENT CALENDAR On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council took the following actions : Approved City Treasurer ' s Investment Report for Period Ending May 31, 1936 ; Denied claim submitted on behalf of Mr. & Mrs . Mark Torgerson and directed Staff to notify claimant and the City' s insurance carrier; CM-5-114 Regular Meeting June 9, 1986 Authorized Staff to request approval of the plans by Dublin San Ramon Services District, re maintenance of Sierra Court Landscaping, subject to the City' s providing maintenance of this strip of land; Authorized Staff to advertise Contract 86-7 (Sierra Court southerly extension) for bids ; Approved the City Manager' s Employment Agreement and authorized Mayor to execute agreement; Approved Warrant Register in the amount of $586, 289 .49 Staff advised that the item related to FAU funds needed to be removed from the consent calendar . A resolution should be adopted approving the program supplement. Mayor Snyder also asked that the minutes of the meeting of May 27, 1986 be removed. On Page 111, the second sentence of paragraph 2 should be clarified that the problems discussed related to the subdivision rather than the road. On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote, the Council Adopted RESOLUTION NO. 50 - 86 APPROVING PROGRAM SUPPLEMENT NO. 2 TO THE LOCAL AGENCY-STATE AGREEMENT FOR FEDERAL AID PROJECTS NO. 04-5432 and authorized. the Mayor to sign the agreement; Approved the Minutes of Regular Meeting of May 27, 1986 as corrected. DUBLIN COMMUNITY DAY AT THE ALAMEDA COUNTY FAIR The Chamber has requested the City' s participation in Dublin ' s Community Day at the Alameda County Fair by having the Mayor in the Winner' s Circle for Dublin ' s designated race . The Chamber has requested that the City consider sharing the expenses involved of approximately $65. 00 On motion of Cm. Hegarty, seconded by Cm. Moffatt, and by unanimous vote, the Council authorized financial participation of $32 .50 in the Dublin Community Day at the Fair. %%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%% CM-5-115 Regular Meeting June 9, 1986 PUBLIC HEARING ORDINANCE PROHIBITING TRUCK PARKING ON STARWARD DRIVE Mayor Snyder opened the public hearing. At its regular meeting of May 27, 1986, the City Council requested th3'C Staff review the legality and appropriateness of trucks being parked along Starward Drive north of Amador Valley Boulevard. TJKM has reviewed the street and recommends that because of roadway width, parking of large vehicles be prohibited on . Starward Drive between Amador Valley Boulevard and Gunshot Court/Oxbow Lane . The . recommended ordinance would prohibit vehicles greater than 20 ' in length. • Mr . Tony Verduzco indicated he was happy with this recommendation. Mayor Snyder closed the public hearing. On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by. .unanimous vote, the Council waived the reading and adopted on an urgency basis ORDINANCE NO. 10 - 86 ESTABLISHING TRAFFIC REGULATIONS (No Parking Zones - Starward Drive) f PET PREVENT-A-CARE CONDITIONAL USE PERMIT On May 5, 1986 , the Planning Commission approved PA86-027 Pet Prevent-A-Care Conditional Use Permit for mobile pet clinics at the Pak ' n Save parking lot . Cm. Mofatt appealed the Planning Commission decision on May 15, 1986 . On May 20, 1986, the Applicant withdrew the application. Since the appeal was noticed for public hearing, the City Council noted that the application has been withdrawn. No further action was needed. PUBLIC HEARING TRAFFIC STUDY - INTERSECTION OF PEPPERTREE ROAD & SHANNON AVENUE Mayor Snyder opened the public hearing. At its meeting of May 12 , 1986 , the City Council requested that TJKM review the installation of stop signs on Peppertree Road at the intersection of Shannon Avenue . A review of accident history, 24-hour machine counts , peak hour turning movement counts, radar speed study and field investigation studies were conducted in response to this request . %%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%% CM-5-116 Regular Meeting June 9, 1986 Based on these studies, TJKM has indicated that the installation of stop signs on Peppertree Road at the intersection of Shannon Avenue would not solve the problem of speeding on Peppertree Road and that there are no accident or other intersection motorist problems that would be resolved by the installation of stop signs . Dublin Police Services records indicate that 45 citations, representing 22 . 5 hours of traffic enforcement were issued on Peppertree . Road during the last two months . Chris Kinzel, TJKM, addressed the Council and stated that his firm had extended their study of this area through the weekend. He stated that they recommended the placement of several additional 25 mph signs and pavement markings, that the location of the stop bar be moved forward on Shannon Avenue @ Peppertree Road and that parking be prohibited in front of the house on the southeast corner of this intersection. The house at 7999 Peppertree Road would have room for 1 car to park in front, but it would not affect side parking on Shannon Avenue. The purpose of the parking restriction was to provide increased visibility for motorists entering Peppertree Road from Shannon Avenue . Mr. Kinzel explained that if the Council wished to proceed with the red curb, it would be necessary to hold another noticed public hearing. The resident reported to Mr . Kinzel that he was not in favor of this parking restriction. Cm. Moffatt felt that when traffic signals are erected at Vomac Road and at Silvergate Drive, this will alleviate the problem somewhat . Cm. Hegarty questioned if the survey took into consideration the fact that the hillside area is not yet completely developed. More traffic will be generated in the future . Mr . Kinzel responded .t hat the survey was based on existing traffic, and as a short term solution. Mr . Ed Meyer, representing his mother who resides at 7999 Peppertree Road addressed the Council . This location is where the proposed red curb is to be painted. Mr . Meyer stated that there is very seldom ever a car parked in front. He did not object because of the loss of parking, but felt that this idea was the most "hair brained" idea he had ever heard. There is a definite problem on the corner, and he felt that painting the curb red would simply give speeders clearer vision which would enable them to turn that corner even faster. Arnold Durrer reported a visibility problem at the southeast corner of Dublin Green Drive and Peppertree Road. Staff indicated it would check out this location. Joanne Smith, a Peppertree Road resident indicated she had noticed the police there this week stopping lots of people. She referred to the stops signs that were placed on Davona Drive and felt that they would at least slow the traffic down. Ms . Smith felt the Police Department had been doing a good job at enforcement along the street. CM-5-117 Regular Meeting June 9, 1986 Mr . Kinzel, during his report, made reference to the Davona. Drive stop signs and reiterated .that statistics showed that -when stop signs are placed at non-intersection locations' where' theyl are not warranted, people tend to only slow down in many cases rather than coming to a complete stop. Motorists then try to make up for the time lost within the next block. Mayor Snyder closed the public hearing. Mayor Snyder indicated he would be willing to go along with Staff ' s recommendations with the exception of the red curb.. . Cm. Jeffery moved and Cm. Moffatt seconded .a motion authorizing the placement of several additional 25 mph signs and pavement markings, that the location . of the stop bar be moved forward on Shannon Avenue @ Peppertree Road, and that the Dublin Police Services continue the enforcement of the speed limit. Cm. Hegarty indicated he has noticed that large groups of residents never condemn the use of stop signs and. he felt he would like to see stop signs placed at this location . Cm. Vonheeder agreed with the placement of stop signs and felt this would give the police more tools with which to enforce the speed limit . Cm. Hegarty offered an amendment to the motion. On motion of Cm. Hegarty, seconded by Cm. Vonheeder and by majority vote, the Council added the placement of a 3-way stop sign at the intersection of Shannon Avenue & Peppertree Road to the above motion. Cm. Jeffery voted against this motion . The Council directed Staff to prepare the necessary ordinance for the placement of stop signs and .notice a public hearing for the next regular Council meeting on June 23 , 1986 . PUBLIC HEARING REQUEST FOR CROSSWALK AT BRIGHTON DRIVE & MANSFIELD AVENUE Mayor Snyder opened the public hearing. In a 'letter dated September 12, 1985, residents of Mansfield Avenue and Langmuir Lane requested consideration of four items as safety measures for children walking to Frederiksen School : 1 ) Installation of a crosswalk at Brighton Drive & Mansfield Avenue on the south side of Brighton Drive ; 2 ) signage to slow traffic ; 3 ) painting of "school zone - slow" in the street ; and 4 ) utilization of high school driver education students as crossing guards during the noon break. During the staff presentation, TJKM recommended the installation of standard .25 mph speed limit signs at 2 locations on Brighton Drive . Chris Kinzel reported that due to further study at this school loca-ion and the fact that a back entrance is used by many students , they have revised their recommendation and are now recommending that the crosswalk be installed along with additional pavement legends . %%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%% CM-5-118 Regular Meeting June 9; 1986 Cm. Moffatt questioned if Frederiksen School was scheduled to be closed. Council responded that it was merely changed from a junior high to an elementary school last year. .Kathleen Mayhood, Langmuir Lane indicated she was present to support her petition for a crosswalk. Mayor Snyder closed the public hearing. The crossing guard situation was discussed with regard to leaving this open for further discussions with the School District. Staff responded that the City had budgeted an amount for the purchase of supplies and equipment in the 1985-86 Budget, however the Murray School District indicated they were not interested in participating in a school safety patrol program with the City and the Police Department. On motion of Cm. Hegarty, seconded by Cm. Jeffery, and by unanimous vote, the Council approved the signage recommendations of TJKM and directed Staff to proceed with the installation of the crosswalk along with additional pavement legends . OTHER BUSINESS -" New Bus System Cm. Jeffery reminded the Council that "Wheels" will begin running on June 29th and there will be introduction ceremonies . Housing Issues Cm. Hegarty indicated that he would distribute some information obtained on his recent trip to Washington, D.C. with regard to housing issues . He attended the National Association of Housing and Redevelopment Officials conference, representing the Alameda County housing Authority. Dougherty Road Right-of-Way Staff distributed a letter to the Council indicating that the Dublin San Ramon Services District is willing to deed property to the City for the purpose of widening Dougherty Road in the vicinity of the Southern Pacific railroad tracks . Staff will prepare a resolution for adoption at the next Council meeting accepting this deed2c property. %%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%%% CM-5-119 Regular Meeting June 9; 1986 CLOSED SESSION At 8 : 44 p .m. the Council recessed to a closed executive session to discuss property negotiations related to the Fallon School site .
