G~~~ O~DUB~~ 19' ~ - _~ `82 ~~~~// `~~~~~/ STAFF REPORT CITY C L E R K DUBLIN CITY COUNCIL File # ^®D^®-®© DATE: March 16, 2010 TO: Honorable Mayor and City Councilmembers FROM: Joni Pattillo, City Manager SUBJE Report on Development Agreement Process EXECUTIVE SUMMARY: At the February 2, 2010 meeting, Mayor Sbranti requested that staff bring back an item for the City Council to consider the City's development agreement process. FINANCIAL IMPACT: Approximately 25 hours of City Attorney's Office time would be required to complete the necessary research and report (including the suggested meetings with stakeholders). RECOMMENDATION: Staff recommends that the City Council approve a new high priority Goal and Objective, under General Government, Administration, to "Conduct a Study of the City's development agreement process." Submitted By City Attorney Page 1 of 2 Reviewed y Assistant City Manager ITEM NO. g• ~' n DESCRIPTION: At the February 2, 2010 meeting, Mayor Sbranti requested that staff bring back an item for the City Council to consider and discuss the City's development agreement process. If the City Council so directs, staff would return with such a report prior to the end of the fiscal year. As envisioned by staff, the report would include the following information: 1. Legal background on the purpose of development agreements (including a discussion of vested rights and vesting tentative maps). 2. Background on the history of development agreements in Dublin (including a discussion of the policy in the Eastern Dublin Specific Plan ("EDSP") that requires every development to have a development agreement). 3. A discussion of the following key issues: a. Whether the EDSP development-agreement requirement should be retained. b. The value of development agreements to developers. c. The appropriate compensation to the City for granting a development agreement. d. The process the City uses and would propose to use for the negotiation of development agreements. In the course of preparing the report, staff would consult with a select group of landowners and developers for their perspectives. Staff is requesting that the City Council provide staff direction on whether this project ("Conduct a Study of the City's development agreement process") is a high priority project and should be included in the Fiscal Year 2009/10 Goals and Objectives for completion this fiscal year.
