As part of the application process a resolution is required from the City Council approving the application submission. The project will be included in the proposed Five Year Capital Improvement Program for Fiscal Year 2010-11, but work on the project would be contingent on being awarded the grant and entering into an agreement with Zone 7 to provide their services. FINANCIAL IMPACT: State Grant Application Funding requested for the construction is $489,300. The application requires no financial match; however, to be competitive, the City of Dublin proposes to utilize City Staff to complete project engineering, project management and construction inspection. The estimated general fund cost for City Staff resources is $93,200. Additionally, Zone 7 will be providing Staff resources to complete the 5-year water quality monitoring and testing program. The grant application requires a resolution (Attachment 1) from the City Council approving the application submission. As part of the grant application the City proposes to remove 16,000 square feet of impervious asphalt paving in the parking spaces at the Shannon Community Center and Park as shown in Attachment 2. The asphalt will be replaced with pervious interlocking pavers. Additionally, twenty-five trees will be installed to shade the parking area and an existing planter will be converted to a bio-swale to treat the water. Subsurface soil from the parking spaces will be removed to install a sand/gravel mix that will allow for better filtration rates. Three to four wells will be installed as part of the project and the Alameda County Flood Control and Water Conservation District Zone 7(Zone 7) will monitor and test the water quality for a five-year period. The results of the water testing will be shared with professional groups in the San Francisco Bay Area. Zone 7 is a project partner for this project proposal. Staff submitted the funding request as a means to address the need to replace asphalt paving at the Shannon Community Center and Park. If the project is selected for funding the City would be notified in September/October 2010. The State grant portion of the Project will be included in the Proposed Five Year Capital Improvement Program. Staff will not proceed with the project until the City is awarded the project funding and has secured a written agreement to provide the testing services at no cost to the City. The budgeting of Staff time as a project cost for design, inspection, and contract management will not occur until the City has been awarded the grant. Site Plan of Proposed Improvements Page 2 of 2 ~ ~ ~ RESOLUTION NO. xx -10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) WHEREAS, the Legislature and Governor of the State of California have provided funds for the program referenced above; and WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the Applicants governing board with submission of said application(s) to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the Project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin: 1. Approves the filing of an application for the Shannon Community Center - Parking Area Renovation; 2. Certifies that applicant understands the assurances and certification in the application; 3. Certifies that applicant or title holder will have sufficient funds to operate and maintain the project consistent with the land tenure requirements; or will secure the resources to do so; 4. Certifies that it will comply with the provisions of Section 1771.8 of the State Labor Code regarding payment of prevailing wages on Projects awarded Proposition 50 Funds; 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, environmental laws and, that prior to commencement of construction, all applicable permits will have been obtained; 6. Certifies that applicant will work towards the Governor's State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1; 7. Appoints the City Manager, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project(s).
