EXECUTIVE SUMMARY:
The City of Dublin has contracted with various consulting firms to provide on-call assistance to
the Public Works Department in the areas of Construction Inspection, Traffic Engineering,
Geotechnical (Soils) Engineering, and General Engineering. It is proposed to extend the term
of the Agreement for Construction Inspection by one additional year, and to extend the terms of
the Agreements for Traffic, Geotechnical and General Engineering by two additional years. No
rate adjustments are associated with these Amendments for Fiscal Year 2010-2011.
FINANCIAL IMPACT:
Under the existing Agreements, the consultants provide services to the City based on individual
adopted rate schedules. Services provided for private development are paid for by developers;
services provided for the City's Capital Improvement Program (CIP) projects are budgeted
within each CIP project.
Section 2.9 of each Consulting Services Agreement specifies that the Consumer Price Index
(CPI) for Urban Wage Earners for the San Francisco-Oakland Bay Area shall be used to govern
rate increases requested by the consultant. Although the December 2009 CPI registered at
3.0%, none of the consultants is requesting a rate increase for Fiscal Year 2010-2011.
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution approving the Amendment to the
Agreements with Associated Engineering Consultants, Inc., to extend the term for an additional
one year, and the Amendments to the Agreements with Fehr & Peers, Kleinfelder West, Inc.,
Permco Engineering & Management, and Zumwalt Engineering Group to extend the terms with
each of these firms for an additional two years. Funding based upon expected workloads has
been included in the Preliminary Fiscal Year 2010-2011 Budget.

Zumwalt Engineering Group has contracted with the City to provide general engineering
services since 1997. The bulk of the work performed is in the area of private development
review and plan checking. Most of this work is performed from the City offices and is charged
at the consultant's "Municipal Augmentation Rate," which is less than the standard rate for work
performed from the consultant's offices. Charges for these services are paid for by developers.
RATE SCHEDULE FOR FISCAL YEAR 2010-2011
The work perFormed to date by each of these consultants has been satisfactory, professional
and competitive. The consultants have indicated the desire to extend the Agreement for an
additional two-year period, or in the case of Associated Engineering Services, an additional one
year period.
The CPI for December 2009, which is the marker specified in Section 2.9 of the Agreement to
govern the amount a consultant can request for an adjustment of its rates, registered at 3.0%
(Attachment 1). However, each of the 5 consultants has confirmed in writing that no rate
increase is being requested for Fiscal Year 2010-2011. Therefore, the rates contained in
Exhibit "B" of each consultant's most recent Amendment will continue to prevail in the
Agreement.
The 9 consultants who are in the second year of their Agreements have also stated they are not
requesting a rate adjustment for Fiscal Year 2010-2011.
No rate increases were requested by any consultant for Fiscal Year 2009-2010.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Each of the 5 consultants has received a copy of this Staff Report.

DESCRIPTION:
The City of Dublin's Public Works Department currently contracts with 14 consulting firms, of
which 13 of the Agreements are for two-year terms, and 1 is for a one-year term. Five of the 14
Agreements expire on June 30, 2010. It is proposed to continue contracting for consultant
services as Staff is currently unable to perform these functions in-house due to time constraints;
therefore, it is necessary to amend 4 Agreements to extend the terms for another two years and
1 Agreement to extend the term for an additional year. The remaining 9 Agreements will not
expire until June 30, 2011, and Staff will return to the City Council at that time for approval to
extend those Agreements, if necessary.
Following are the major categories of the consulting services provided and a summary for each
consultant in that category.
CONSTRUCTION INSPECTION
Associated Enqineerina Services has provided construction inspection services to the City on
an as-needed basis since August 2005. The most recent Agreement with the City was entered
into in September 2009. The Public Works Department currently has two full-time Inspectors
on Staff performing inspections for private development and Capital Improvement Program
(CIP) projects, as well as for encroachment permits and other inspections, such as compliance
with requirements on building permits. At times when additional inspection coverage is needed
due to project and/or vacation scheduling, it is necessary to use the services of a contract
inspector. Charges for these services are billed directly to private developers or to CIP projects.
TRAFFIC ENGINEERING
Fehr & Peers has provided traffic engineering services to the City based on the adopted rate
schedule since November 2008. Types of services performed are typically peer review or
preparation of minor traffic studies associated with private development projects and capital
infrastructure projects. Charges for these services are paid for by developers. Under this
agreement, Fehr & Peers would provide traffic engineering services to the City based on the
adopted rate schedule.
GEOTECHNICAL ENGINEERING
Kleinfelder West, Inc., has contracted with the City since June 1996 to provide general
geotechnical services, primarily in the areas of peer review for private development projects and
soils engineering for CIP projects. The most current two-year Agreement was approved on
August 17, 2004, and was extended in finro-year increments to June 20, 2010. The consultant
provides specific not-to-exceed proposals for each project, the cost of which is either paid for by
developers or budgeted within a specific CIP project.
GENERAL ENGINEERING
PERMCO ENGINEERING & MANAGEMENT has performed general engineering services for
the City since November 2000. The bulk of the work performed has been in the area of project
management and design services, primarily for CIP Projects, such as the Annual Overlay and
Slurry Seal. The costs of these services are typically budgeted within each project.

APPROVING AMENDMENTS TO AGREEMENTS FOR ENGINEERING SERVICES WITH
ASSOCIATED ENGINEERING CONSULTANTS, INC., FEHR & PEERS, KLEINFELDER WEST,
INC., PERMCO ENGINEERING & MANAGEMENT, AND ZUMWALT ENGINEERING GROUP
WHEREAS, the City of Dublin ("the City") and the firm of ASSOCIATED ENGINEERING
CONSULTANTS, INC. (AEC), previously entered into an Agreement whereby this firm agreed to
provide construction inspection services on an as-needed basis; and
WHEREAS, the City and AEC now desire to extend the terms of the Agreement an additional
one year until June 30, 2011; and
WHEREAS, the rate schedule contained in AEC's current Agreement shall remain in effect
for Fiscal Year 2010-2011; and
WHEREAS, the City of Dublin ("the City") and FEHR ~ PEERS, KLEINFELDER WEST,
INC., PERMCO ENGINEERING & MANAGEMENT, AND ZUMWALT ENGINEERING GROUP ("the
Consultants"), have previously entered into finro-year Agreements ("the Agreements") whereby the
Consultants have agreed to provide certain engineering services on an as-needed basis; and
WHEREAS, the City and the Consultants now desire to extend the terms of the Agreements
an additional finro years until June 30, 2012; and
WHEREAS, the rate schedule contained in each Consultant's most current Amendment shall
remain in effect for Fiscal Year 2010-2011; and
WHEREAS, the attached Amendments to the Agreements have been reviewed and
approved as to form by the City Attorney's Office;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby approve the Amendments, attached hereto as Exhibits "A-1" through "A-5".
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the
Amendments on behalf of the C ity.

FOR GEOTECHNICAL ENGINEERING SERVICES
WHEREAS, the City of Dublin (hereinafter referred to as "CITY") and Kleinfelder
West, Inc. (formerly known as Kleinfelder, Inc., and hereinafter referred to as "CONSULTANT"),
entered into a two-year agreement on August 17, 2004, to provide geotechnical engineering
services to CITY; and
WHEREAS, on June 6, 2006, said agreement was subsequently extended for an
additional two-year term to June 30, 2008; and

BETWEEN CITY OF DUBLIN AND ZUMWALT ENGINEERING GROUP
FOR ENGINEERING SERVICES
WHEREAS, the City of Dublin (hereinafter referred to as "CITY") and Zumwalt
Engineering Group (hereinafter referred to as "CONSULTANT") entered into a two-year
agreement on July 20, 2004, to provide engineering services to CITY; and
WHEREAS, the term of the agreement was exter~ded an additional finro years,
terminating June 30, 2008; and
WHEREAS, the term of the agreement was subsequently extended an additional
two years, terminating June 30, 2010; and
WHEREAS, CONSULTANT will maintain the rate schedule previously adopted
June 3, 2008;
NOW, THEREFORE, the parties hereto agree as follows:
Section 1. Extension of Term
The term of the agreement shall be extended from July 1, 2010, to June 30, 2012.
Should a new agreement or amendment to agreement to extend the contract not be entered
into by June 30, 2012, then this agreement will automatically extend until a new agreement or
amendment to agreement is entered into or CITY gives written notice of termination.
Section 2. Adiustment of Rates
The rate schedule .attached hereto as Exhibit 1 shall be in effect for Fiscal Year
2010-2011.

ZUMWALT ENGINEERING GROUP
2010-2011 CHARGE RATE FEE SCHEDULE
The compensation of Zumwalt Engineering Group for work done will be on the basis of an hourly charge rate,
plus incurred expenses and will be the sum of all the items set forth below:
A. PERSONNEL SERVICES
PRINCIPAL $ 168 HR
SUPERVISING ENGINEER 162 HR
SENIOR ENGINEER 146 HR
ASSOCIATE ENGINEER 130 HR
ASSISTANT ENGINEER 110 HR
FIELD REPRESENTATIVE 102 HR
TECHNICIAN/CAD OPERATOR 97 HR
CLERICAL / OFFICE SUPPORT 60 HR
TWO-MAN SURVEY CREW 221 HR
Rates for individuals may vary depending on the service performed.
EFFECTIVE THROUGH JUNE 30, 2011 AND SUBJECT TO REVISION ANNUALLY
6. TRANSPORTATION EXPENSES
1. Fifty cents (0.50) per mile for use of vehicles. A minimum of eight dollars ($8.00) per hour will be
charged for use of vehicles used for field inspection and supervision.
C. OUTSIDE SERVICES
1. Invoice cost of services and expenses charged to Zumwalt Engineering Group by outside consultants,
professional, or technical firms engaged in connection with the order, plus 15% handling charge.
D. MISCELLANEOUS EXPENSES
1. The invoice cost of materials, supplies, reproduction work, and other services procured by Zumwalt
Engineer Group from outside sources, plus a handling charge of 15%. All out-of-pocket expenses not
included in Items A, B and C will be included in this category.
