P Engineering Contractors, Inc. This year's Annual Sidewalk Safety Repair Program (CIP No. 949101) removed and replaced 4,902 SF (Square Feet) of sidewalk with offsets of 3/4-inch or more that posed a tripping hazard (approximately 225 sidewalk locations). FINANCIAL IMPACT: The adopted Fiscal Year 2009-2010 total appropriations for this project were $80,894, including design and inspection. Of this amount, $15,894 has been allocated for design and inspection and $65,000 for improvements. City Council authorization is required for the costs incurred from addressing additional locations beyond the amount of the original contract award. * Note: Even with the additional costs the total construction cost did not exceed the $65,000 budgeted for improvements. RECOMMENDATION: Authorize the City Manager to execute the Contract Change Order and Accept the improvements under Contract No. 10-01, Fiscal Year 2009-2010 Annual Sidewalk Safety Repair Program, and authorize the release of retention after 35 days if there are no subcontractor claims. . Q . d ~~ Reviewed By Revi we By Administrative Services Director Assistant City Manager Page 1 of 2 ITEM NO. ~-~'• ~ DESCRIPTION: The Annual Sidewalk Safety Repair Program (Remove and Replace) repairs sidewalk offsets of 3/4-inch or more that may pose a tripping hazard. The Remove and Replace process is used in locations where the offset is more significant or where tree roots are causing the offset. This procedure requires the removal of the existing sidewalk and, in the case of root problems, removal of the tree roots, and then replacement of the concrete sidewalk. While maintenance of sidewalks and other frontage improvements is legally the responsibility of the private property owner, the City Council has adopted a City-funded sidewalk repair program on a year-by-year basis since 1983. The City Council extended funding for the City-paid repair program for an additional year in the Fiscal Year 2009-10 budget. This year's Sidewalk Safety Repair Program removed and replaced approximately 4,902 SF (Square Feet) of sidewalk with offsets of 3/4-inch or more that were unsafe or posed a tripping hazard. Staff has reviewed the work performed under this contract and has determined that the work is satisfactory and complete. As noted in the financial section the final cost exceeded the amount awarded by the City Council on March 16, 2010. The additional costs were a result of additional sidewalk repair locations (Attachment 1) added subsequent to the original contract award. However, inclusive of these additional costs the construction cost did not exceed the amount budgeted. Staff have prepared a Contract Change Order that will account for the additional costs.
