Pattillo, City Manager SUBJE T: Authorization to File Annual Applications for the CalRecycle Used Oil Payment Program Prepared By: Jordan Figueiredo, Environmental Technician: _Y EXECUTIVE SUMMARY: The City Council will consider adopting a Resolution granting authority to the City Manger to apply for the Department of Resources Recycling and Recovery's (CalRecycle) Used Oil Payment Program. FINANCIAL IMPACT: The City is eligible to receive $5,000 or more each year from this program. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution authorizing the filing of Used Oil Payment Program application to CalRecycle. Cow -)/1 i .....-- Submitted By Reviewe• Senior Administr. . e Analyst Assistant City v anager Page 1 of 2 ITEM NO. 4-4 \7C DESCRIPTION: As a part of the California integrated Waste Management Board's (CIWMB) annual Used Oil Block Grant Program, the City received funds each year to promote used oil recycling and related activities. The CIWMB is now known as the Department of Resources Recycling and Recovery (CalRecycle} and the Used Oil Block Grant Program has been changed. In addition to being a more streamlined and simplified process, the program is now known as the Used Oil Payment Program. In order to authorize the City to appty for this program each year and continue to receive funding for the City's Used Oil Recycling Program, the City Council needs to adopt a resolution granting the City Manager the authority to sign all legal documents related to the program for the City, which includes the submittal of an annual application. Staff applied for the grant in June of 2010 and expects payment to be awarded by April of 2011. Types of activities that have been funded by this program in the past include: subsidizing curbside used oil collection, contributing to regional used oil collection media campaigns and investments in City storm water filters and maintenance. XX -10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN *********** AUTHORIZING THE FILING OF A USED OIL PAYMENT PROGRAM APPLICATION TO CALRECYCLE WHEREAS, Public Resources Code sections 48690 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California lntegrated Waste Management Board, to make payments to qualifying jurisdictions for implementation of their used oil programs as required by PRC § 48690 et seq.; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the Used Oil Payment Program; and WHEREAS, CalRecycle's procedures for administering the Used Oil Payment Program require, among other things, an applicanYs governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Dublin does hereby authorize the submittal of a Used Oil Payment Program application to CalRecycle; and BE IT FURTHER RESOLVED, that the City Manager, or his/her designee, is hereby authorized and empowered to execute in the name of the City of Dublin all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support our Used Oil Collection Program ; and BE IT FURTHER RESOLVED, that this authorization is effective until rescinded by the City Council.
