EXECUTIVE SUMMARY:
This is the second reading of an ordinance introduced at the regularly scheduled City Council
meeting of July 20, 2010. The ordinance will amend the Dublin Traffic Code repealing and
establishing bus stops at various locations Citywide.
FINANCIAL IMPACT:
There is no financial impact to the City of Dublin associated with this item.
RECOMMENDATION:
Staff recommends that the City Council waive the reading and ADOPT the ordinance amending
the Dublin Traffic Code repealing and establishing bus stops at various locations Citywide.

DESCRIPTfON:
There are currently over 100 locations throughout the City that are used as active bus stops,
which are indicated by either signs or curb markings and may include a bus pullout and
amenities such as benches and shelters. According to Dublin Municipal Code Section
6.04.360, the City Council may establish bus stops by ordinance. Once established and
marked accordingly, vehicles cannot stop, stand or park within the designated area. Many bus
stops that became active over the last several years, particularly in eastern Dublin within new
neighborhoods and on new roadways, were not formally adopted by ordinance prior to
becoming active. Most of these locations were retroactively designated by Council in June
2008 based on a database of stop locations provided by LAVTA. It has been determined that a
few additional locations were inadvertently left out of the database and are included in an
Ordinance for City Council consideration (Attachment 1).
In addition, LAVTA's Bus Rapid Transit (BRT) Project includes the relocation of several bus
stops; therefore, the Ordinance includes the designation of these stops, as well as a repeal of
the old stops that will no longer be in use.
Proposed Action
This ordinance will amend the City of Dublin Traffic Code repealing and establishing bus stops
at various locations Citywide.
The City Council considered this matter on July 20, 2010 and waived the reading and
introduced the ordinance repealing and establishing bus stops at various locations Citywide.
(Attachment 2). The new designations will go into effect 30 days following adoption of the
ordinance and after appropriate bus stop signage or markings have been placed providing
notice thereof.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Noticing for the Bus Rapid Transit (BRT) Project has been extensive, including individual
notification to businesses and residences that will be adjacent to new or relocated stops. All
other bus stops are existing; therefore, there has been no additional notice for this item.

AMENDING THE DUBLIN TRAFFIC CODE REPEALING AND
ESTABLISHING BUS STOPS AT VARIOUS LOCATIONS CITYWIDE
The City Council of the City of Dublin does ordain as follows:
Section L The following locations shall be deleted from Section 6.44.010 of the City of
Dublin Traffic Code:
Amador Valley Boulevard
South Side at Wildwood/Cross Creek Road
Central Parkway
South Side West of Grafton
Dougherty Road
East Side opposite Monterey Drive (at Camp Parks gate)

Section 3. Severability. The provisions of this Ordinance are severable and if any provision,
clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any
person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect
or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the
ordinance or their applicability to other persons or circumstances.
Section 4. Effective Date. This Ordinance shall take effect and be enforced thirty (30) days
following its adoption, and after appropriate bus stop signage or markings have been placed providing
notice thereof.
Section 5. Posting. The City Clerk of the City of Dublin shall cause this Ordinance to be
posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the
Government Code of the State of California.

EXECUTiVE SUMMARY:
The City Council will consider introducing an ordinance amending the Dublin Traffic Code
repealing and establishing bus stops at various locations Citywide. The City of Dublin and
Livermore Amador Valley Transit Authority (LAVTq) entered into an agreement in November
2009 that defined the encroachment and maintenance responsibilities for both parties in
operating and maintaining bus stops and bus shelters within the City of Dublin. The City
Council will also consider approving an amendment to the agreement to clarify responsibilities.
FINANCIAL IMPACT:
There is no financial impact to the City of Dublin associated with this item.
RECOMMENDATION:
Conduct a public hearing; deliberate; waive the reading, and introduce the Ordinance repealing
and establishing bus stops at various locations Citywide; and adopt the Resolution approving
First Amendment to the Bus Shelter Encroachment and Maintenance Agreement between the
Livermore Amador Valley Transit Authority and the City of Dublin.

DESCRtPTION:
The Livermore Amador Valley Transit Authority (LAVTA) was created in 1985 under a Joint
Exercise of Powers Agreement between the Cities of Dublin, Livermore and Pleasanton.
LAVTA has since been providing transit service across the Tri-Valley. LAVTA and City staff
routinely work cooperatively on upcoming projects, day-to-day operations and proposed new
bus stop locations. This report includes an Ordinance to designate additional locations as bus
stops and to repeal bus stops that will no longer be utilized and a First Amendment to Bus
Shelter Encroachment and Maintenance Agreement for City Council consideration.

Encroachment and Maintenance Aqreement
Since its inception, LAVTq routinely provided maintenance services at the various bus stops
throughout the City of Dublin, although no formal maintenance agreement was previously
established. In anticipation of the construction of LAVTA's BRT Project, which was to include
the installation of various improvements and amenities, it became apparent that an
encroachment and maintenance agreement should be established.
At its November 17, 2009, City Council meeting, the City Counci! approved the Bus Shelter
Encroachment and Maintenance Agreement ("Agreement") with LAVTA (Attachments 2 and 3).
The Agreement provides that LAVTA will operate and maintain all existing bus stops and
shelters, and contains provisions for adding new bus stops and shelters to the list of areas to be
operated and maintained. Maintenance shall be pertormed as frequently as reasonably
necessary to maintain the facilities in a neat and attractive condition. The Agreement also
provides remedies where the City may perform such maintenance at LAVTA's expense if the
City's concerns regarding specific locations have not been addressed within thirty (30) days.
Attached to the Agreement as `Exhibit A', is a list of existing bus stop locations.
LAVTA staff has since requested that a few specific items be clarified through an amendment to
the agreement. The first amendment to the encroachment and maintenance agreement
includes the following revisions:

• Amendment of Section 1(a) ENCROACHMENT to clarify that LAVTA is permitted to
place facilities within the City Right of Way.
• Amendment of Section 2(b) LAVTA'S RESPONSIBILITIES to modify the definition of
maintenance in the original Agreement to provide for separate categories called:
"routine upkeep" and "maintenance." Routine upkeep includes inspection, cleaning, and
trash removal, and maintenance includes repair and replacement. LAVTA would be
responsible for routine upkeep at all bus stop locations listed in Exhibit A and
maintenance of only those amenities that are specifically identified in Exhibit A, which
might include shelters, benches, trash cans, or decorative sidewalk. In general, LAVTA
is responsible for maintenance at all bus stops, except for the existing Art Shelters and
the new shelters being installed as part of the Corridor Enhancement Project (CIP
960012).
• Exhibit A has been revised to include a listing of amenities at each bus stop for which
LAVTA would be responsible for maintaining (pursuant to the amended Section 2(b)).
Maintenance of amenities that are not listed in Exhibit B(whether they currently exist or
are installed by the City in the future) would not be the responsibility of LAVTA.

• The list of amenities included in Exhibit A may be revised administratively. This does not
change the Dublin Municipal Code requirement that all new bus stops be designated by
ordinance by the City Council; rather, this would allow for administrative changes to the
listing of amenities at~ already-designated bus stops that are subject to LAVTq's
maintenance responsibilities.

notification to businesses and residences that will be adjacent to new or relocated stops. All
other bus stops are existing, and the Agreement and Amendment serve to memorialize
continued maintenance and operation for these locations.
