The second phase consists of an assessment and report compilation on the condition of the storm drain
system to assess the need, if any, to perform local repairs to the storm drain system. Any recommended
repairs will be included in a new Capital Improvement Program (CIP) project for consideration in a future
CIP update. The second phase of the project is projected to take place in Fa112009.
City practice is to hold back ten percent of project invoices as retention throughout the length of the
project to ensure completion of the project and retain funds against potential subcontractor claims, should
they arise. Upon the City Council's acceptance of project improvements, the retained amount is paid to
the contractor after 35 days if there are no subcontractor claims.
RECOMMENDATION: Accept as complete the work under Contract No. 09-04, Citywide
Street Storm Drain Condition Assessment, and authorize the release of retention after 35 days if there are
no subcontractor claims.
