General Funds from the Sidewalk project to the ADA Transition Plan Project; and 2) Authorize $3,036 in

additional expenditures from available Traffic Impact Fees for the Bike Lane Project. This will fully
exhaust the Amador Valley Blvd Bike Lane mitigation funds.
DESCRIPTION: On May 19, 2009, the City Council awarded Contract No. 09-06,
2008-2009 Annual Sidewalk Safety Repair Program and Curb Ramp Installation, to Maxicrete, Inc.
The Annual Sidewalk Safety Repair Program (Remove and Replace) repairs sidewalk offsets of 3/4-inch
or more that may pose a tripping hazard. The Remove and Replace process is used in locations where the
offset is more significant or where tree roots are causing the offset. This procedure requires removal of
the existing sidewalk, and in the case of root problems, removal of the tree roots, and then replacement of
the concrete sidewalk.
While the maintenance of sidewalks and other frontage improvements is legally the responsibility of the
private property owner, the City Council has adopted aCity-paid sidewalk repair program on a year-by-
year basis since 1983. At the budget hearing for Fiscal Year 2008-2009, the City Council extended the
funding of the repair program for an additional year.
This year's Sidewalk Safety Repair Program included the construction of twenty nine (29) pedestrian curb
ramps. Fourteen (14) of these ramps were funded as part of the Amador Valley Boulevard Bike Lane
Capital Improvement Project (CIP No. 960015). The remaining fifteen (15) ramps were funded through
the General Fund as identified in the ADA Transition Plan (CIP No. 939100). In addition, 3,518 square
feet of sidewalk was repaired. Staff has reviewed the work performed under this contract and has
determined that the work is satisfactory and complete.
As noted in the financial section of this report, the improvements were completed under budget for the
three projects combined. A Budget Change is required to recognize minor adjustments to the funding on
two of the projects. The first change represents an increase in funding for the ADA Transition project of
$1,500. The source of funds will be a reduction in the Sidewalk Repair Project, which has funds
available. The second change is intended to address the complete expenditure of Mitigation Funds held
for the Amador Valley Boulevard Bike Lane project. After the budget for the project was adopted,
additional interest earnings were available in the mitigation fund. This change will allow the City to
expend an additional $3,036 which will fully expend these special funds. The expenditure of the
Mitigation Funds will also reduce the amount of Measure B funds required for the project.
RECOMMENDATION: Staff recommends that the City Council 1) approve the Budget
Change for Fiscal Year 2008-2009; and 2) accept the improvements under Contract No. 09-06, 2008-
2009 Annual Sidewalk Safety Repair Program and Curb Ramp Installation, and authorize the release of
retention after 35 days if there are no subcontractor claims.

REASON FOR BUDGET CHANGE ENTRY: This budget change will: 1) Transfer $1,500 in unexpended
Sidewalk Repair Project funding to the Americans With Disabilities Act Transition Plan Project. This project
constructed curb ramps and adjacent sidewalks at several locations in the City. 2) Authorize an additional
expenditure of Traffic Mitigation funds in lieu of Measure B Funds, on the Amador Valley Boulevard Bike
Lane Project.
The Budget Change was presented to the City Council 9/1/2009 as part of the acceptance of project)
