This year's Americans with Disabilities Act (ADA) Transition Plan Project (CIP No.939101) will include the construction of approximately 18 pedestrian curb ramps. The ramps are funded through a Community Development Block Grant Recovery (CDBG-R) grant and the General Fund (1001) as identified in the ADA Transition Plan Project (CIP No. 939101). FINANCIAL IMPACT: The total appropriations for this project are $56,410, which includes design; inspection and improvements. Of this amount $54,610 is budgeted for improvements. The total amount of the base bid to be awarded is $47,000. The difference of $7,610 between the budget and the low bid will provide a contingency and, if feasible, Staff will increase the number of ramps to be installed, provided the budget will not be exceeded. Submitted By evie d B Public Works Director Assistant City Hager Page 1 of 2 ITEM NO. ~ I. 2- ~~ DESCRIPTION: In response to the enactment of the Americans with Disabilities Act (ADA), the City of Dublin adopted a Title I Compliance Plan, a Title II Transition Plan, and a complaint procedure in 1996. In 2006, the City used summer interns to update the ADA Transition Plan. As part of that update, a continuing CIP was also adopted to conduct regular curb ramp replacement projects. Since adopting the updated ADA Transition Plan, the City has installed 55 curb ramps, and is making every effort to bring the City into compliance as quickly as possible. This Project will implement recommended improvements listed in the City's ADA Transition Plan, which include the construction of approximately 18 new pedestrian curb ramps. The ramps are funded through a Community Development Block Grant Recovery (CDBG-R) grant and the General Fund (1001) as identified in the ADA Transition Plan Project (CIP No. 939101) Staff has reviewed the bid results, checked references, and found that the lowest bidder, AJW Construction, did not meet the required contractor license classification at the time of the bid opening. Therefore, Staff has disqualified the lowest bidder, and recommends that the City Council adopt the Resolution awarding Contract No. 09-11, Fiscal Year 2009-2010 ADA Curb Ramp Installation Program, to FBD Vanguard Construction, Inc., as the lowest responsive bidder. Staff has checked references and the necessary licenses for FBD Vanguard Construction, Inc., and found them to be in compliance with the requirements. WHEREAS, the City of Dublin did on November 2, 2009, publicly open, examine, and declare all sealed bids for doing the work described in the approved Plans, Specifications, and Modifications for Contract No. 09-11, Fiscal Year 2009-2010 ADA Curb Ramp Installation Program, authorized by the City Council on October 20, 2009, which Plans, Specifications, and Modifications are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and WHEREAS, said bids were submitted to the Public Works Director, who has reviewed the bids to determine the lowest bid which was responsive to the requirements of the bid documents; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby award Contract No. 09-11, Fiscal Year 2009-2010 ADA Curb Ramp Installation Program, to the lowest responsible bidder therefore, to wit, FBD Vanguard Construction, Inc., at a bid of Forty-Seven Thousand Dollars ($47,000.00), the particulars of which bid are on file in the office of the Public Works Director. BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Agreement.
