RECOMMENDATION:
Confirm Mayor's appointment of Paul C. Moffatt to W AAC and
direct Staff to notify LA VT A.
FINANCIAL STATEMENT:
None
DESCRIPTION: In February of 1996, Dublin resident Mary Gibbert was appointed as
a member to LA VTA's Wheels Accessible Advisory Committee. In December oflast year, Ms. Gibbert
passed away.
In accordance with the Bylaws of the W AAC, LA VT A solicited applications and Dublin resident Paul C.
Moffatt applied.
Staff recommends that the City Council confirm the Mayor's appointment of Paul C. Moffatt to LA VT A's
Wheels Accessible Advisory Committee and direct Staff to notify LA VTA of this appointment.

The City Council appointed Mary Gibbert as a member of the LA VTA's WHEELS
Accessible Advisory Committee (W AAe).
.
Late last year Mary Gibbert passed away. LA VTA solicited applications for membership
of this committee to represent the City of Dublin as per Section 3.3 (d) (IV) of the
Committee Bylaws, and Mr. Paul Moffatt has applied.
In accordance with Section 3.3 (d) (i) of the Bylaws, it is requested that the Dublin City
Council consider appointing Mr. Paul Moffatt to the Committee.

ARTICLE 1
NAME
The name of this committee shall be the "WHEELS ACCESSIBLE ADVISORY
COMMITI'EE" .
ARTICLE 2
DEFINITIONS
The terms defined in this Article shaD have the following meaning:

SECTION 2.1. "LAVTA" refers to the Livermore/Amador Valley Transit
Authority, created pursuant to Government Code 6500 et. seq., which provides public
transportation services within the cities of Dublin, Livermore and Pleasanton, and portions
of unincorporated areas in Eastern Alameda County.
SECTION 2.2. "BOARD OF DIRECTORS" or Board, means the governing board
of LA VTA.
SECTION 2.3. "PARA TRANSIT" refers to any fonn of transportation for persons
unable to use rlXed route public transit.
SECTION 2.4. "PERSON WITH DISABILITIE5" refers to any person whose
disability prevents him/her from accessing to public transportation pursuant to 49 CFR 37.
SECTION 2.5. "ELDERLY" is defined as any person who is sixty (60) years of age
or older.
SECTION 2.6. "COMPLEMENTARY PARA TRANSIT SERVICE" refers to
comparable paratransit service to fixed route transit service as mandated by the Americ.ans
with Disabilities Act (49 CFR 37.125).

SECTION 2.7. "LOCAL PARA TRANSIT SERVICE" refers to paratransit services
that are not mandated by the Americans with Disabilities Act, and that are defined by
individual transit operators.

SECTION 2.8. "TRANSPORT A nON DEVEWPMENT ACT - ARTICLE 4.5
refers to State funding for paratransit service generated from the 1/4 cent sales tax.
SECTION 2.9. "ALAMEDA COUNTY l\fEASURE B" refers to local funding for
paratransit service generated by the oDe-half percent (0.5%) transportation sales tax in
Alameda County.
SECTION 2.10. "AMERICANS WI1H DISABILITIES ACT" (ADA) refers to the
Federal law which provides equal access to buildings, services and public transportation to
persons with disabilities (Public Law 101-336). Among its provisions, the ADA mandates
that public transit operators provide complementary paratransit service to persons whose
impairment(s) prevents them from using regular nxed route transit service.
SECTION 2.11.
Committee" .
"COMMlTI'EE" refers to "WHEELS Accessible Adv60ry
SECTION 2.12. "MEMBER n is defined as a Member of the Committee, who
resides in the LA VT A member jurisdictions and represents the interests, concerns and
suggestions of the elderly and disabled persons. This person mayor may not have .
disabilities, or who mayor may not be sixty years of age or more.
SECTION 2.13 "FISCAL YEAR" means the period from July 1 to and including
the fonowing June 30.
SECTION 2.14. "FIXED ROUTE SERVICE" refers to service that operates along
prescribed routes according to fIXed schedules.
ARTICLE 3
GENERAL PROVISIONS
SECTION 3.1. MISSION. The Mission of the Committee is to:
(a) Provide a forum to discuss matters relating to system accessibility as they
pertain to the elderly and persons with disabilities; and
(b) Advise the Board of Directors on matters relating to system accessibility as
they pertain to the elderly and persons with disabilities.

SECTION 3.2. RESPONSIBILITIES OF THE COJ\.fMITI t:E. lbe Committee
shall have the following responsibilities:
(a) Advise the Board of Directors on matters relating to system aCCC5ibility on
LA VT A's fIxed route and paratransit services as they pertain to the elderly
and persons with disabilities.
(b) To solicit infonnation from paratransit users, and also rfiCCPlftinAte
infonnation to the paratransit and nxed route users.
(c) To make recommendations to the LA VTA Board of Directors.
(d) To represent the interests of elderly and persons with disabilities who depend
upon accessible public transit service(s).
SECTION 3.3 COMMIJT~E
(a)
ComDosition. The Committee shall be composed of seven (7) members. Each
city in the LA VTA jurisdiction shall have two members, and the County of
Alameda one member, who is a resident in the LA VT A service area.

(b) Alternate. Each City and the County shall have one (1) alternate member.
(c) Oualifications of Members and Alternates. The members and alternates must
be able to demonstrate:
(i) That they reside in the City they represent and in the case of the
County, they reside in the LA VT A service area.
(ii) They can solicit and disseminate infonnation to their constitutents.
(Hi) Meet .regularly during nonnal business hours.
(iv) Analyze complex issues, reports, etc., and make objective conclusions
relating to the issues and reports.
(d) ApDointment Process
.
(i) The City Councils of the Cities of Dublin. Livennore and Pleasanton
shall each select and appoint two (2) members and one (1) alternate
member to the Committee.

The Alameda County Board of Supervisors shall select and appoint
one (1) member and one (1) alternate member to the Committee.
The Board of Directors of LA VTA shall ratify as Committee
members, the appointments made by the City Councils of the Cities
of Dublin, Pleasant on and Livermore and by the Alameda County
Board of Supervisors.
(iv)
LA VT A shall advertise for any vacancy or vacancies on the Committee
in local newspapers and shall submit the name(s) of the applicants to
the appropriate City Council or Alameda County Board of
Supervisors. The Cities and the Board of Supervisors may solicit
applications if they so desire.
(v)
Every interested person shall complete a LA VT A application form.
LA VTA shall send an acknowledgement letter to the applicant(s).
The process of making appointments of alternate members sball be the.
same as for regular members.
A member unable to attend a Committee meeting shall notify tbe
member's alternate to attend the meeting.
(e) Vacancies on the Committee. When there is a vacancy on the Committee, tbe
alternate member shall fill in as an interim member, and sball Dot
automatically become a full voting permanent member. The alternate
member may apply for the vacancy. If the alternate member is appointed to
nn the vacancy, the alternate position shall be nlled accordingly.
SECTION 3.4. TERM OF APPOINTMENT OF COMMITfEE MEMBERS.
(a) The term of. appointment of each committee member and alternate shall be
for a period of two (2) nscal years.
(b) Each member shall serve for a maximum of two consecutive terms (Le., four
(4) consecutive fIscal years). Any member may serve more than two
consecutive terms if no applications for the position are received, subject to
the approval of the Board of Directors.
(c)
The tenns of members from each city shall be offset; i.e., staggered by one .
fIScal year.

SECTION 3.5. REMOVAL AND RESIGNA TJON OF MEMBERS.
(a) Appointed members may be removed automatically from the Committee by
the Board of Directors if:
(i) The member is absent for three (3) consecutive regular meetings
without excuse;
(li)The member has missed sixty percent of the meetings during a rlSall
year.
(ill) A member may resign from the Committee by 8 letter of resignation
to the LA VTA General Manager, who shall notify the Board of
Directors of the resignation.
SECTION 3.6. COMMnT~E OFFlCERS AND THEIR DUTIES
(8) The Committee shall elect a Chair and Vice Chair from among its members.
(b)
The Chair and Vice Chair shall be elected at the last meeting of each rJSC:al
year and assume office at the rll'St meeting of the new fISCal year.
(c) The Chair shall preside at all meetings of the Committee, call special
meetings, and act as spokesperson of the Committee with the authorization
of the Committee pursuant to Section 4.1 of these Bylaws.
(d) The Vice Chair shall assume all duties of the Chair in the absence of, or
upon request of, the Chair.
(e) The Chair or his/her designee shall make an oral report at the meeting of the
Board of Directors following the Committee's meeting. The designee shall be
the Vice Chair of the Committee or a Committee member.
(0 In the absence of the Chair and Vice Chair, the Committee shall appoint a
Chair Pro- Tern to fill the duties of the Chair.
SECTION 3.7. COMMITTEE SECRETARY. A LA VTA staff person shall serve
as Secretary and shall have no vote on matters before the Committee. The Secretary shall
keep minutes of all regular and special meetings, and submit them to the Committee for
approval; maintain a record of attendance, record all roll call votes; and assist with clerical
and administrative tasks pertaining to the Committee.

SECTION 3.8. COMM.J ITI:::E MEETINGS.
(a)

minimum oC one time per f....sc:al quarter. The Committee shall establish the
meeting schedule, meeting time, meeting sites Cor the regular meetings at the
rll'St regular meeting oC the I1scal year.
(b)
R~I"r MfIII'Ifi.... All regular meetings shall have a published agenda. OnJy
items on the agenda sball be ad~d at the meeting. Items Cor a regular
meeting agenda may be submitted by any member oC the Committee at least
two (2) weeks prior to the meeting. The Committee Secretary may submit
items Cor the agenda. Any supportive material Cor an agenda item shall be
submitted at the same time. The Chair and the Committee Secretary shall
agree on the I1nal agenda.
(c)
Al!ellrlste The agenda shall contain at least the Conowing: call to order;
approval oC minutes; Committee Secretary's Report; old business; new
business; public comment and adjournment. Copies oC the agenda, with
supporting material and past meeting minutes, shan be mailed or delivered
to the Committee members. .
Notice.. Notice oC regular and special meetings shan comply with the Ralph
M. Brown Act, Government Code Section 54950, et seq. Notices shan be
mailed or delivered to the appropriate locations in the LA VT A jurisdiction.
Notices may be mailed to the public upon request. All requests for additional
infonnation Cor regular and special meetings shan comply witb LA VT A's
Access to Public Infonnation Policy. All notices of regular and special
meetings shall be posted 72 hours prior to the meeting.
SoeciaI Meetin~. Special meetings may be called by the Chair, by the
Committee Secretary, or by the request of I1ve members of the Committee.
Special meetings may include regular business in nature and/or time-urgent
items. Special meetings shall comply with the same requirements of regular
meetings.
Accessibility. All meetings shall be conducted in the LA VTA jurisdiction,
and shall be in a location accessible by public transportation and accessible
to persons with disabilities.
Quorum. A quorum must be present to conduct a meeting and shall consist
of five (5) members.

(h) AlIinnAtive Vote. An afrumative vote by the majority of the nlled positions
of the Committee is required for an action to be approved, and a quonun
must be present in the room in order for a vote to be taken. If a quorum is
not present, the Chair would adjourn tbe meeting.
(i) ComnPft.Oli::lltiOD. Committee members sball not receive compt"lI$SItion for
attending regular and special meetings. Please refer to Section 4.2.

ARTICLE 4
MISCELLANEOUS

SECTION 4.1. PUBLIC STATEMENTS. The Chair of the Committee sball be the
spokesperson of the Committee. In the absence of the Chair, the Vice Chair shall act as
the spokesperson. In the absence of the Committee's Chair and Vice Chair, a spokesperson
shall be appointed by the Committee Chair.. Furthermore, no member of the Committee
shall speak as a spokesperson for LA VT A without authorization by majority vote of the
Board of Directors of LA VT A.
SECTION 4.2. EXPENSES. The Committee is strictly on a volunteer basis;
therefore, members shall not be reimbursed for any expenses relative to the Committee's
activities and functions. However, LA VT A will provide paratransit sen'ice to/from regular
and special meetings for Committee members upon request. Members of the public must
provide their own transportation.
SECTION 4.3. AMENDMENTS. Proposed amendments to these Bylaws shaD be
submitted to the LA VT A Board of Directors by the General Manager with an explanation
of the proposed changes. Amendments shall be incorporated into these Bylaws upon a
maj ority vote of the LA VT A Board of Directors.
