Dear Mr. Amb e:
On February 22, 1983, the Board of Supervisors of the County of
Alameda adopted Resolution No. 195662. This Resolution urged the Federal
Highway Administration to add the Nimitz Freeway to the Federal-Aid Inter-
state System as a portion of non-chargeable mileage. We have been advised
that the Federal Highway Administration has Freeway)
to the Federal Aid Interstate Sy stem
280 in San Jose.
Under current law "non-chargeable mileage" cannot receive any funds
out of the Interstate Rehabilitation monies allocated to each state. It is
recommended that this Law be changed so that states can use Interstate Rehab-
ilitation Funds as they see fit including on the non-chargeable mileage within
that state.
To that end, the City of Fremont has already adopted a resolution,
which is enclosed for your information and files. A draft Board of Supervisors
resolution is also enclosed. This resolution will be presented to the Board of
resolution encourages the
meeting for adoption.
The resolu 9
Supervisors ors at its next g
P the
California Congressional Representatives to support legislation allowing th
use of Interstate Rehabilitation Funds on non-chargeable mileage and further
recommends that Congress adopt such legislation to allow this throughout the
nation.
I would appreciate it if you would consider presenting a resolution
of this type to your City Council for adoption. It is imperative that the
support of all jurisdictions in the counties of Alameda and Santa Clara
support this legislation.
If you have any questions concerning the procedure, please contact
Ray Burnham in my office at 881-6476 at your convenience.
Very truly yours,
H. A. FLER EIM, JR.

Enclosed is a copy of the Alameda County Board of Supervisors Resolution
No. R-83-407 which urges the United States Congress to enact a bill which
would make nonchargeable interstate highways eligible for 4R repair and
rehabilitation funds.
As you know, Route 17 was recently redesignated as Federal Route 880 in
the interstate system as "nonchargeable interstate." We 'are working back
in Washington to get the bill going, but the timing is such that we need
to make progress slowly right now. Until such time as our Washington
representatives can pave the way for speedy passage of the bill , we want
to keep a low profile in order not to encourage other states to generate
an additional amount of nonchargeable interstate mileage which might also
be covered by the bill .
It would be helpful if your city would generate a similar resolution of
support to forward to your appropriate Congressional representatives.
However, we would encourage behind the scenes actions only, until the
stage is set for quick passage.
If you have any questions in this regard, please do not hesitate to call
me at 881-6416.
Sincerely,
H. A. Flertz im, Jr.
