Revisions to Personnel System
EXHIBIT: ~ Amendment to Resolution Establishing Management
positions Exempt From Competitive Service and
~presCribing Leave Benefits for the positions
RECOMMENDATION: Adopt Resolution
FINANCIAL
STATEMENT:
This is a housekeeping item resulting in no financial
impact to the city of Dublin.
DESCRIPTION: The city's Personnel System is governed by several
documents. Each document addresses a specific topic. Under the
Personnel System, the City provides for a variety of leave benefits.
Leave benefits for employees subject to competitive service are
detailed in the Personnel System Rules: leave benefits for employees
exempt from competitive service, including Department Heads and other
designated management positions are detailed in a separate document.
On June 27, 1994, the city council approved the creation of a new
position classification for Economic Development Manager. This position
is a professional, management position reporting directly to the city
Manager. The Economic Development Manager position is comparable to
the Assistant to the city Manager and Finance Manager classifications:
both of which are identified as exempt from competitive service.
Staff is recommending that the Resolution Establishing Management
positions Exempt From competitive Service and Prescribing Leave Benefits
for the positions be amended to include the Economic Development Manager
classification.
Also, as indicated above, the city provides for a variety of leave
benefits including Administrative Time Off (ATO) for management
positions. ATO is available to employees exempt from overtime
provisions under the Fair Labor Standards Act. ATO is designed to
provide additional leave time for employees who consistently work in
excess of normal working hours. Currently, ATO is provided for in the
Personnel System Rules. However, the Resolution Establishing Management
positions Exempt From Competitive Service and Prescribing Leave Benefits
for the positions does not presently contain the ATO language.
Staff is recommending that the Resolution Establishing Management
positions Exempt From Competitive Service and Prescribing Leave Benefits
for the Positions also be amended to include a provision for
Administrative Time Off.
Staff recommends that the city council adopt the Resolution Establishing
Management Positions Exempt From Competitive Service and Prescribing
Leave Benefits for the Positions to include the Economic Development
Manager classification and Administrative Time Off provisions.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DUBLIN

AMENDING RESOLUTION NO. 142-90 ESTABLISHING MANAGEMENT POSITIONS
EXEMPT FROM COMPETITIVE SERVICE AND PRESCRIBING
LEAVE BENEFITS FOR THE POSITIONS
WHEREAS, The City Council has adopted a Personnel Ordinance: and
WHEREAS, section 4(e) of the ordinance exempts Department Heads
and other Management positions from the Competitive Service: and
WHEREAS, the exemption from competitive service also exempts these
employees from the Personnel Rules, including the description of leave
benefits: and
WHEREAS, the city Council adopted resolution No. 142-90 and
subsequent resolutions which establish management positions and
prescribe leave benefits for those positions: and
WHEREAS, due to the addition of the new classification for the
position of Economic Development Manager and due to the previous
omission of the Administrative Time Off provision, it is appropriate to
amend Resolution No. 142-90.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin hereby amend Resolution No. 142-90 as follows:
A. The Department Head and Management Employees shall include the
addition of the Economic Development Manager classification.
BE IT FURTHER RESOLVED that the Resolution be amended to include
the following:
Section 21 "Administrative Time Off": At the discretion of the city
Manager, and upon recommendation of the department head where
applicable, an employee who is designated as exempt under Section 4
above, may be granted Administrative Time Off. The employee shall have
consistently worked in excess of normal working hours, excluding
incidental overtime, which is described as one (1) hour or less.
Administrative Time Off shall not be granted for increments greater than
eight (8) hours. .
