DESCRIPTION: On August 12th, the City Council authorized
Staff to solicit bids for exterior painting of the Shannon Community
Center. The dedication of Shannon Park is scheduled to be held on
September 21st, and in order to substantially complete the painting
work by that time, it is necessary to allow the successful bidder to
start as soon as possible.
Proposing to award the bid at the August 26th City Council meeting
would not allow enough time for prospective bidders to review the
specification and formulate a bid; however, awarding the bid at the
September 9th City Council meeting would not allow the contractor
sufficient time to obtain the necessary bonding and perform the work
before September 21st. The contract documents allow a total of 10
working days and specify that the work shall be substantially
completed on or before September 20th; therefore, the work must
commence on or before September 9th.
The City Attorney has advised that the City Council may authorize
Staff to award the bid to the lowest responsible bidder under these
circumstances. A three-working-day period of time would be allowed
between the bid opening and the bid award for the purpose of receiving
objections to the proposed award to the apparent low bidder. If bids
are opened on Wednesday, August 28th, at 2:00 p.m., award of bid could
be made on Tuesday, September 3rd, after 2:00 p.m. (This time frame
allows for a weekend and the Labor Day holiday.)
On this basis, Staff recommends that the City Council adopt the
resolution authorizing Staff to award the bid, provided that no
objections are received and that the lowest responsible bid does not
exceed the amount budgeted for the work. Based on some informal
estimates received, Staff anticipates that the bids will be fairly
close to the budgeted amount. If the low bid exceeds the budget, or
if objections to the award are received, Staff would not award the bid
and would come back to the City Council for direction.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AUTHORIZING THE CITY MANAGER TO AWARD CONTRACT 91-04
SHANNON CENTER EXTERIOR PAINTING
TO THE LOWEST RESPONSIBLE BIDDER
WHEREAS, the City Council authorized solicitation of bids
for Contract 91-04 Shannon Center Exterior Painting on August 12,
1991; and
WHEREAS, dedication of Shannon Park, the site of Shannon
Center, is scheduled to be held on September 21, 1991; and
WHEREAS, the City Council desires that work under Contract
91-04 be completed prior to the date of the dedication; and
WHEREAS, proposing award of bid at the regular City Council
meeting of August 26, 1991 would not allow sufficient time for
bidding, and proposing award of bid at the regular City Council
meeting of September 9, 1991, would not allow sufficient time to
complete the work prior to the dedication;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Dublin authorizes the City Manager to award Contract 91-04 to
the lowest responsible bidder, provided that:
1) The lowest and best bid for doing the work does not
exceed the approved budget for the project ($20,000).
2) Following the bid opening, all bidders are notified of
the City's intent to award Contract 91-04 to the apparent low bidder;
and no objections to the proposed award of bid are received within
three working days of said notification.
PASSED, APPROVED AND ADOPTED this 26th day of August, 1991.
