No cost to the City associated with abandoning easement DESCRIPTION: When Parcel Map 3000 was approved by Alameda County in 1981, the County rejected the offer of dedication of an access and public utility easement along the west side of the Chabot Channel off of Scarlett Court. In November of 1991, the City Council rescinded the County's rejection and accepted the offer of dedication. This easement is a portion of the street that is presently referred to as "Chabot Road," which is currently being constructed as part of the Dublin Boulevard Extension project. As sho~n in the Location Map, Exhibit 3, the dedication includes the bulb of a cul- de-sac at the present end of the road. The construction plans provide that Chabot Road is to be constructed as a connector between Scarlett Court and the Dublin Boulevard Extension. Therefore, the bulb of the cul-de-sac is not required for access purposes and may be abandoned. Once this portion of the access easement is abandoned, it would no longer encumber U-Haul's property and could be used as part of U-Haul's proposed expansion plan. The procedure for abandoning an easement is simpler than that for abandoning right- of-way in that an easement which contains no utilities and has not been used for its intended purpose for five consecutive years may be summarily vacated without going through the public hearing process. Staff contacted all of the utility companies and has been advised that none of them has existing facilities within the area proposed to be abandoned or a future need for that portion of the easement. Copies of letters from Pacific Bell and PG&E are attached. DSRSD has acknowledged its lack of interest by telephone. There is no cable television service in the area to be abandoned. Staff recommends that the City Council adopt the resolution vacating a portion of the access and utility easement on the westerly side of Chabot Channel. a: (9293) \auguss\agsgabnd ITEM NO. ~. ~/ COPIES TO: U-Haul Scarlett Drive RESOLUTION NO. -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN SUMMARILY VACATING A PORTION OF AN ACCESS AND PUBLIC UTILITY EASEMENT WITHIN PARCEL MAP 3000 WHEREAS, the Dublin City Council accepted an access and public utility easement within Parcel Map 3000 (Scarlett Court) on November 12, 1991; and WHEREAS, a portion of said access and public utility easement, as identified by Exhibit A attached, is not required by the City or by any utility company for access or utility purposes; and WHEREAS, said portion of access and public utility easement has not been used by the City or by a public utility for at least five consecutive years; NOW, THEREFORE, BE IT RESOLVED that pursuant to Streets and Highways Code Section 8330 et. seq., the City Council of the City of Dublin does hereby vacate the portion of said access and public utility easement as identified by Exhibit A. BE IT FURTHER RESOLVED that this resolution shall be recorded pursuant to Streets and Highways Code Section 8336. Upon recordation, said portion of access and public utility easement identified in Exhibit A shall no longer constitute an access and/or public utility easement.
