DESCRIPTION: The Final Map for Tract 3732 was approved by the Alameda
County Board of Supervisors in June of 1977, and the Final Map for Tract 4736 in February of 1981,
prior to the City of Dublin's incorporation. These two Tracts make up the Wineberry Way
subdivision located off of Village Parkway near the northerly City Limit.
At the time of Final Map approval for both Tracts, the County accepted the streets as County Roads
but rejected all of the utility easements that were offered for dedication. This practice was the
County's standard procedure at the time. The City has been accepting easements in more recently
approved Tracts.
The City has received a request from.facific Bell that the public utility easements in these Tracts be
accepted. These public utility easements consist of a six-foot-wide strip alon~ the front property line
of each lot (and also along the street-side property line of comer lots). There are underground
utilities located within the easement and may also be above-ground utility boxes on some lots.
The offer of dedication on the Owner's Certificate remains open for a period of twenty-five years,
during which time the City, as successor to the County of Alameda, may rescind the rejection and
accept the easements. Staff recommends that the City Council adopt the resolution.

RESOLUTION NO. -93
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
RESCINDING REJECTION OF PUBLIC UTILITY EASEMENTS
AND ACCEPfING EASEMENTS
TRACTS 3732. AND 4736
WHEREAS, by Resolution No. 173192 adopted June 21, 1977, the Board of
Supervisors of the County of Alameda did reject the offer of dedication of Public Utility Easements
for Tract 3732; and
WHEREAS, by Resolution No. 189769 dated February 3, 1981, the Board of
Supervisors of the County of Alameda did reject the offer of dedication of Public Utility Easements
for Tract 4736; and
WHEREAS, upon incorporation, the City of Dublin has succeeded the County of
Alameda's interest in said Tracts; and
WHEREAS, acceptance of the public utility easements will facilitate maintenance of
utility structures within the easements and is therefore in the best interest of the City;
NOW, THEREFORE, BE IT RESOLVED pursuant to the authority of Section
66477.2(a) of the Government Code of the State of California that the City Council hereby rescinds
the previous rejection of the offer of dedication of Public Utility Easements within Tracts 3732 and
4736.
BE IT FURTHER RESOLVED that the offer of dedication of Public Utility
Easements (P.U.E.) made by Amador Associates, a Limited Partnership, dated June 10, 1977 (Tract
3732) and January 16, 1981 (Tract 4736) on the aforesaid Tract Maps be, and the same is hereby
accepted.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed
to cause a certified copy of this resolution to be recorded at the office of the Recorder of Alameda
County.
